ORDINANCE NO. 2014-01 AN ORDINANCE AMENDING CITY OF FRIENDSWOOD, TEXAS, ORDINANCE NO. 2013-37, PASSED AND APPROVED OCTOBER 7, 2013, SAME BEING AN ORDINANCE APPROVING AND ADOPTING THE CITY'S GENERAL BUDGET FOR FISCAL YEAR 2013-2014 BY APPROVING "BUDGET AMENDMENT 1II" TO THE "ORIGINAL GENERAL BUDGET OF THE CITY OF FRIENDSWOOD, TEXAS, FOR THE FISCAL YEAR 2013- 2014"; PROVIDING FOR SUPPLEMENTAL APPROPRIATION AND/OR TRANSFER OF CERTAIN FUNDS; PROVIDING FOR SEVERABILITY; AND PROVIDING OTHER MATTERS RELATED TO THE SUBJECT. WHEREAS, by Ordinance No. 2013-37, the City Council of the City of Friendswood, Texas, adopted its "Original General Budget for Fiscal Year 2013-2014"; and WHEREAS,the City Council has determined that revenues and/or reserves are available for supplemental appropriation, and/or that the transfer of certain funds interdepartmentally is economically feasible and in the best interest of prudent budgeting and for municipal purposes; and WHEREAS, Section 8.04 of The City Charter provides for amendments after adoption of the budget; and WHEREAS, the City Council desires to amend said Original General Budget to reflect such supplemental appropriation and/or transfer in the fiscal year 2013-2014; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FRIENDSWOOD, STATE OF TEXAS: Section 1. The facts and matters set forth in the preamble of this Ordinance are hereby found to be true and correct. Section 2. The "Original General Budget of the City of Friendswood, Texas, for the Fiscal Year 2013-2014," is hereby amended for municipal purposes as shown on "Budget Amendment IIF' to the "Original Budget of the City of Friendswood, Texas, for the Fiscal year 2013-2014"attached hereto. Said Budget Amendment III shall be attached to and made a part of such Original General Budget by the City Secretary and shall be filed as required by state law, a true and correct copy of which is attached hereto as Exhibits "A" and"B" and made a part hereof for all purposes. Section 3. In the event any clause,phrase,provision, sentence, or part of this ordinance or the application of the same to any person or circumstance shall for any reason be adjudged invalid or held unconstitutional by a court of competent jurisdiction, it shall not affect, impair, or invalidate this ordinance as a whole or any part or provision hereof other than the part declared to be invalid or unconstitutional; and the City Council of the City of Friendswood, Texas, declares that it would have passed each and every part of the same notwithstanding the omission of any such part thus declared to be invalid or unconstitutional,whether there be one or more parts. Community Services — Santa in the Park, $4,005. Appropriate funds to the Community Service Department received from the sales of tickets for amusement park rides at the Santa in the Park Event. The event was held on December 14, 2013. Funds received will offset the cost of expenses related to the event incurred in the operating budget for the Community Services Recreation Programs division. 2. Insurance Reimbursement for City Entry Sign on FM 2351, $14,840. Appropriate insurance reimbursement received from Liberty Mutual Insurance company to the Community Service Department. The City's Entry sign on FM 2351 was damaged in a vehicle accident on November 11, 2013. The reimbursement was received on December 3, 2013 and covers the cost of replacing the sign. 3. Police Investigation Fund Revenue, $955. Appropriate asset forfeiture funds received. Funds will be appropriated to the Police Investigation Fund (PIF) operating services account. 4. Police Department Rape Aggression Defense Donations, $100. Appropriate funds donated to the Police Department Rape Aggression Defense (R.A.D.) Program. Donations were received from the citizens participating in the R.A.D. classes. Funds will be appropriated to the Police Department Patrol operating supplies for R.A.D. program expenses and will be spent in Fiscal Year 2014. 5. Community Development Department, $9,321. Transfer funds from Fire Marshal Emergency Management operating budget to the Community Development Engineering division. Funds will reimburse the division for purchasing survey equipment and a second license with AutoCAD. Use of the equipment and software to survey and map City streets, drainage, and other infrastructure is essential to Emergency Management activities before and after an event. The funding source will be from the Emergency Management Performance Grant. 6. Community Development Department, $16.700. Transfer funds from General Fund Balance above the 90-day reserve to the Community Development Engineering division. The funds are to cover a structural and property condition assessment of Fire Station 1. As a result of the recently approved bond program, a new fire station will be built behind the Public Safety Building and Fire Station 4 will be expanded to become the new Station 1 (headquarter facility). Prior to determining the current Station 1's fate, an analysis of the building's condition is needed.
