HomeMy WebLinkAboutOrdinance No. 99-12 ORDINANCE N0. 99-12 AN ORDINANCE FINDING AND DETERMINING THAT PUBLIC CONVENIENCE AND NECESSITY NO LONGER REQUIRE THE CONTINUED EXISTENCE OF A PORTION OF THAT CERTAIN 0.6796 ACRES BEING A PORTION OF MUSTANG ROAD DEDICATFsD PUBLIC RIGHT OF WAY LOCATED IN THE CENTRAL PARK SUBDIVISION, LOT 3, BLOCK H, IN THE SARAH MCKISSICK OR J.E. WILLIAMS LEAGUE, GALVESTON COUNTY, TEXAS. * * * * * * * * * * WHEREAS, Friendswood Independent School District, the abutting property owners, has petitioned the City of Friendswood, Texas, to vacate, abandon, and close the hereinafter described public right of way; and WHEREAS, the City Council has determined that such public right of way should be vacated, abandoned, and closed for the reason that the same is no longer needed by the public or the City, and that the public convenience will not be harmed by such vacation, abandonment and closure; now therefore, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FRIENDSWOOD, STATE OF TEXAS: Section 1. The facts and matters set forth in the preamble of this Ordinance are hereby found to be true and correct. Section 2. The City Council of the City of Friendswood, Texas, hereby finds and determines that public convenience and necessity no longer require the existence of the .06797 acres being a portion of Mustang Road, out of Lot 3, Block H, Central Park Subdivision in the Sarah McKissick or J. R. Williams League, public right of way described in Exhibit "A" attached hereto and made a part hereof for all purposes. ORD.VAC/LST03 Section 3 . The Mayor is hereby authorized to execute and the City Secretary is hereby authorized to attest, respectively, a quitclaim deed, a copy of which is attached hereto and made a part hereof, conveying the public right of way described in Exhibit "A" to Friendswood Independent School District. E. Williams League, Galveston County, Texas, according to the plat thereof filed in Volume 105, Page 151, Galveston County Map Records and being more particularly described in the attached metes and bounds description identified as Exhibit "A" and made a part hereof by reference.
