ORDINANCE NO. 2013-43
AN ORDINANCE AMENDING SECTION 2-40, SECTION 14-2,
SECTION 86-1, SECTION 86-2, APPENDIX B, APPENDIX C
AND APPENDIX D OF THE CODE OF ORDINANCES OF THE
CITY OF FRIENDSWOOD, TEXAS, BY PROVIDING FOR THE
ADDITION OR ADJUSTMENT OF ZONING
ADMINISTRATION FEES, BUILDINGS AND BUILDING
REGULATIONS FEES, BUSINESSES PERMIT FEES, UTILITY
SERVICE SECURITY DEPOSITS AND UTILITY SERVICE
FEES.
WHEREAS, Section 2-40, Section 14-2, Section 86-1, Section 86-2, Appendix B, Appendix
C and Appendix D of the Code of Ordinances of the City of Friendswood, Texas, establish certain
zoning administration fees, buildings and building regulations fees, businesses permit fees, utility
security deposits and service fees for utility services provided by the City and
WHEREAS, in order to recover a portion of the cost of providing services associated with
City zoning administration, building regulations, businesses and utilities and in keeping pace with
standards adopted by neighboring municipalities, the City Council deems it necessary to revise the
City's fee schedule as set forth in this ordinance.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FRIENDSWOOD, STATE
OF TEXAS:
Section 1. Section 2-40 of the Code of Ordinances of the City of Friendswood, Texas is
hereby amended as follows:
"(a) A fee set by resolution and printed in Appendix C and Appendix D to this Code shall be
submitted with all applications to the board of adjustment when the applicant is requesting
action by such board which requires the calling of a public hearing thereon.
(b)Any person violating any provision of this section shall be deemed guilty of a
misdemeanor and, upon conviction, shall be fined in an amount not to exceed $200.00."
Section 2. Section 14-2(d) of the Code of Ordinances of the City of Friendswood, Texas
is hereby amended as follows:
"(d) Fees. Building contractor license fees are hereby fixed pursuant to Appendix D of the
Code of Ordinances and represent the administrative cost to the city for processing such
applications and issuing necessary license certificates. License fees shall be paid in full at the
time of issuance of the license."
Section 3. Section 86-1(b) of the Code of Ordinances of the City of Friendswood, Texas
is hereby amended as follows:
"(b) Funds submitted to the city as a security deposit shall be returned to the customer after
the expiration of two years from the date such deposit is made; provided that such customer
seeking a refund has not be delinquent on a payment for water, sewer and/or garbage
collection for the preceding two-year period. The city may waive the requirement of a
security deposit for new customers as set forth in this section upon receipt of evidence that
such customer has not be delinquent in the payment of water, sewer and/or garbage collection
services during such preceding two-year period (or 12 preceding utility billing periods) to the
suppliers of such services. In addition, new customers with prior history with the city within
the preceding five years who were not delinquent on payments for water, sewer and/or
garbage collection services may also have such security deposits waived.
Section 4. Section 86-2 of the Code of Ordinances of the City of Friendswood, Texas is
hereby amended by the addition of the following subsections (6)through(9) as follows:
"(6) Same day service connection. A same day service connection fee is hereby fixed
pursuant to Appendix D of the Code of Ordinances and represents the administrative and
operating cost to the city for same day processing a new utility application, generating and

completing service initiation. The fee will be assessed and paid in full upon customer request
through completion of an application for utility service."
"(7) Meter replacement. A meter replacement fee is hereby fixed pursuant to Appendix D of
the Code of Ordinances and represents the administrative and operating cost to the city for
customer requested replacement of a utility meter.
"(8) Utility meter removal. A meter removal/pulled meter service fee is hereby fixed
pursuant to Appendix D of the Code of Ordinances and represents the administrative and
operating cost to the city for removal of a utility meter due to non-payment of two or more
consecutive billed consumption periods.
"(9) Proof of residency. A printing service fee is hereby fixed pursuant to Appendix D of the
Code of Ordinances and represents the administrative and operating cost to the city for
providing customer requested proof of residency documentation.
Section 5. City of Friendswood, Texas, Ordinance No. 88-21, as amended, originally
adopted the 20th day of March, 1989, the same being Appendix D of the Friendswood City Code, and
also being the fee schedule ordinance of the City,is hereby amended as follows:

if request is received prior to expiration of six months from date of
permit issuance [shall be] for the building permit fee only.
k. [The city] adopt[s]the Building Valuation Data Table and appropriate
Regional Modifier,as published annually in May by the Southern Building
Code Congress international for the purpose of uniformly determining the
valuation of improvements to be permitted. Such valuations shall be used

Section 6. City of Friendswood, Texas, Ordinance No. 2000-01, as amended, originally
adopted the 1 sc day of January, 2000, the same being Appendix B of the Friendswood City Code, and
also being the fee schedule ordinance of the City, is hereby amended as follows:

Section 7. City of Friendswood, Texas, Ordinance No. 84-15, as amended, originally
adopted the 19`1' day of November, 1984, the same being Appendix C of the Friendswood City Code,
and also being the fee schedule ordinance of the City, is hereby amended as follows:

Section 8. In the event any section, paragraph, subdivision, clause, phrase, provision,
sentence, or part of this ordinance or the application of the same to any person or circumstance shall for
any reason be adjudged invalid or held unconstitutional by a court of competent jurisdiction, it shall not
affect, impair, or invalidate this Ordinance as a whole or any part or provision hereof other than the part
declared to be invalid or unconstitutional; and the City Council of the City of Friendswood, Texas,
declares that it would have passed each and every part of the same notwithstanding the omission of any
such part thus declared to be invalid or unconstitutional, whether there be one or more parts.
