HomeMy WebLinkAboutOrdinance No. 99-21 . • � ' , .-.._ .�.. , , • ORDINANCE NO. 99-21 AN ORDINANCE AMENDING APPENDIX C OF THE CITY OF FRIENDSWOOD CITY CODE, SAID APPENDIX C BEING THE ZONING ORDINANCE OF THE CITY, BY AMENDING THE REGULATION MATRIX FOR COMMERCIAL AND RESIDENTIAL DISTRICTS TO DELETE THE HEIGHT COLUMNS AND RELATED NOTES; SUBPARAGRAPH b. OF PARAGRAPH 2 OF SUBSECTION Q OF SECTION 7 THE�EOF BY DELETING THE PRESENT LANGUAGE AND REPLACING IT TO ALLOW BUILDING HEIGHTS TO EXCEED 35 FEET IN THE OFFICE PARK, LIGHT INDUSTRIAL, INDUSTRIAL, BUSINESS PARK, AND PLANNED UNIT DEVELOPMENT DISTRICTS, PROVIDED ADDITIONAL SETBACKS ARE MET; PROVIDING A PENALTY IN AN AMOUNT NOT TO EXCEED $2,000 FOR EACH DAY OF VIOLATION OF ANY PROVISION HEREOF; AND PROVIDING FOR SEVERABILITY. * * * * * * * * BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY FRIENDSWOOD, STATE OF TEXAS: Section 1. The Code of Ordinances of the City of Friendswood, Texas, is hereby amended by amending the Regulation Matrix Commercial Districts and Regulation Matrix- Residential Districts by deleting the columns labeled height maximum and related notes, as follows: Section 2. The Code of Ordinances of the City of Friendswood, Texas, is hereby amended by amending subparagraph b of paragraph 3 of subsection Q of Section 7 by deleting the current language which reads: [A building or structure may not exceed two (2) stories, to a ma�mum of thirty-five (35) feet, measured from the minimum habitable floor elevation as required by City Ordinances.] and replacing it with the following: b. A buildin� or structure may not exceed thirty-five 35) feet in height measured from the minimum habitable floor elevation, provided however that buildin�s or structures in Office Park (OP , Li�ht Industrial (LI�. Industrial (I), Business Park (BP), and Planned Unit Development (PUD) districts may exceed thirtv-five (35) feet in height when: F W DU Iei ght.Ord\10/20/99 . � ' . ..� ,� • 1. The buildin� setback from the nearest propertv line is equal to the buildin� height. Further, the building or structure shall fit under an ima i�nary line that is no g;reater than 45.0 de�rees at the property line from a horizontal line established at the minimum habitable floor elevation. 2. The minimum setback for any buildin�; or structure in Office Park �OP), Li�ht Industrial (LI), Industrial (I�, Business Park (BP,�, and Planned Unit Development (PUD) which is greater than thirtv-five (35) feet in height, shall be one-hundred (100) feet plus the buildin� or structure height from the nearest property line of residentially zoned land. 3. The minimum setback for buildings or structures taller than thirt� five (35) feet shall be that which provides the �reatest distance from the nearest property line of residentially zoned land, as determined bv either 1. or 2. above. 4. Buildings or structures of thirtv-five feet or less in height shall meet the setback re�uirements as defined in this Ap�endix.. Section 3. That in the event any clause, phrase, provision, sentence, or part of this Ordinance or the application of the same to any person or circumstance shall for any reason be adjudged invalid or held unconstitutional by a court of competent jurisdiction, it shall not affect, impair, or invalidate this Ordinance as a whole or any part or provision hereof other than the part declared to be invalid or unconstitutional; and the City Council of the City of Friendswood, Texas, declares that it would have passed each and every part of the same notwithstanding the omission of any such part thus declared to be invalid or unconstitutional, whether there be one or more parts. Section 4. Any person who shall violate any provision of this Ordinance shall be deemed guilty of a misdemeanor and, upon conviction, shall be fined in an amount not to exceed $2,000.00.
