HomeMy WebLinkAboutOrdinance No. 2000-22 ORDINANCE NO. 2000-22 AN ORDINANCE OF THE CITY OF FRIENDSWOOD, TEXAS, AMENDING APPENDIX C OF THE FRIENDSWOOD CITY CODE, SAID APPENDIX C BEING CITY OF FRIENDSWOOD, TEXAS, ORDINANCE NO. 84-15, AS AMENDED, ORIGINALLY ADOPTED THE 19TH DAY OF NOVEMBER, 1984, AND BEING THE ZONING ORDINANCE OF THE CITY, BY AMENDING SECTION 7.P., THE PERMITTED USE TABLE TO DELETE THE REQUIREMENT FOR A SPECIFIC USE PERMIT FOR MULTI- FAMILY DWELLINGS AND TWO FAMILY DWELLINGS IN MFR-L, MFR-M, AND MFR-H DISTRICTS AND TO ALLOW SUCH DEVELOPMENTS AS A PERMITTED USE IN SUCH DISTRICTS; BY AMENI��N:: SUBPARAGRAPH A. OF SUBSECTION 2 OF SECTION 9.H. SITE PLAN PROCESS, TO REQUIRE SITE PLANS IN MFR-L, MFR-M, AND MFR-H DISTRICTS; PROVIDING OTHER MATTERS RELATING TO THE SUBJECT; PROVIDING A PENALTY OF AN AMOUNT NOT TO EXCEED $2,000 FOR EACH DAY OF VIOLATION OF ANY PROVISION HEREOF; AND PROVIDING FOR SEVERABILITY. � � * � * � WHEREAS, Council is desirous of streamlining the land development process for in order to encourage economic development of land within the City; and WHEREAS, Council has determined that requiring specific use permits far multi- family residentially zoned properties is �u�licative and removal of the specific use pertnit procedure and process will not adversely affect the public health, safety, and welfare, or sound planning in the City, nor be contrary to the City's Comprehensive Plan; and WHEREAS, the Planning and Zoning Commission has recommended adoption of the following amendment; now therefore, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FRIENDSWOOD, STATE OF TEXAS: Multi-Family Residential SUPs Page 1 of 3 Section 1. Appendix C of the Code of Ordinances of the City of Friendswood, Texas, said Appendix C being the Zoning Ordinance of the City, Section 7.P., Permitted Use Table, is hereby amended by deleting the "S" from the columns headed MFR-L, MFR-M, and MFR-H for the rows designated "Two family dwellings" and "Multifamily dwellings"therein, and replacing such"S"with a P. Section 2. Appendix C of the Code of Ordinances of the City of Friendswood, Texas, said Appendix C being the Zoning Ordinance of the City, subparagraph a. of subsection 2. of Section 9.H., Site Plan Process, is hereby amended by adding the following before the semi-colon at the end of the paragraph: ar multi-family residential, low density (MFR-L), multi-family residential medium density(MFR-M), and multi-family residential high density(MFR-H) Section 3. Appendix C of the Code of Ordinances of the City of Friendswood, Texas, said Appendix C being the Zoning Ordinance of the City, Section 7., subsections B.3, C.3., and D.3., are amended by deleting the following language: B.3. "All multi-family dwellir�g development in district MFR-L shall be subject to the grant of a specific use permit pursuant to subsection G of Section 9 hereof." C.3. "All multi-family dwelling development in district MFR-M shall be subject to the grant of a specific use permit pursuant to subsection G of Section 9 hereof. D.3. "All multi-family dwelling development in district MFR-H shall be subject to the grant of a specific use permit pursuant to subsection G of Section 9 hereof Section 4. Except as otherwise herein expressly amended, all other provisions of Appendix C of the Code of Ordinances of the City of Friendswood, Texas, said Appendix C being the Zoning OrdinancP of the City, Ordinance No. 84-15, originally Multi-Family Residential SUPs Page 2 of 3 adopted the 19th day of November, 1984, as it may have been previously amended, remain unchanged and in full force and effect. Section 5. Any person who shall violate any provision of this Ordinance shall be deemed guilty of a misdemeanor and,upon conviction, shall be fined in an amount not to exceed$2,000. Each day of violation shall constitute a separate offense. Section 6. In the event any clause phrase, provision, sentence, or part of this Ordinance or the application of the same to any person or circumstances shall for any reason be adjudged invalid or held unconstitutional by a court of competent jurisdiction, it shall not affect, impair, or invalidate this Ordinance as a whole or any part or provision hereof other than the part declared to be invalid or unconstitutional; and the City Council of the City of Friendswood, Texas, declares that it would have passed each and every part of the same notwithstanding the omission of any such part thus declared to be invalid or unconstitutional,whether there be one or more parts.
