HomeMy WebLinkAboutOrdinance No. 2000-25 ORDINANCE NO. 2000-25 AN ORDINANCE AMENDING ORDINANCE NO. 99-37, WHICH AMENDED APPENDIX C OF THE FRIENDSWOOD CITY CODE, SAID APPENDIX C BEING CITY OF FRIENDSWOOD, TEXAS, ORDINANCE NO. 84-15, AS AMENDED, ORIGINALLY ADOPTED THE 19TH DAY OF NOVEMBER 1984, AND BEING THE ZONING ORDINANCE OF THE CITY, AND WHICH CREATED THE DOWNTOWN OVERLAY DISTRICT BY DELETING THE SUNSET PROVISION OF SAID ORDINANCE NO. 99-37; AND AMENDING SAID APPENDIX C BY SECTION 7.5 BY DELETING THE HEIGHT REQUIREMENT CONTAINEB IN PARACi�_4"l� 4 AND ADDING LANGUAGE REGARDING SETBACKS; BY DELETING PARAGRAPH 8.a., REQUIRING CERTAIN LANDSCAPING; BY AMENDING PARAGRAPH 9a. BY ADDIlVG SUBPARAGRAPH 5, PROHIBITING GARAGE BAYS OPENING ONTO FRIENDSWOOD DRIVE; BY REPLACING THE CURRENT LANGUAGE IN PARAGRAPH 9.B.1. IN ITS ENTIRETY WITH NEW VISUAL SCREENING STANDARDS; PROVIDING A PENALTY OF AN AMOUNT NOT TO EXCEED $2,000 FOR EACH DAY OF VIOLATION OF ANY PROVISION HEREOF; AND PROVIDING FOR SEVERABILITY. * � � * * � BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FRIENDSWOOD, STATE OF TEXAS: Section �. Cit;� Ui rriendswc•nd �,rdinance No. 99-37, passed, approved and adopted on the 18th day of October, l 999, is hereby amended by repealing what is contained therein as Section 3: "Section 3. This Ordinance shall expire nine (9)months after the effective date hereof, unless repealed earlier or extended by Council." Section 2. Appendix C of the Friendswood City Code, same being city of Friendswood, Texas, Ordinance No. 84-15, as amended, originally passed and approved the 19tn day of November, 1984, and being the Zoning Ordinance of the City, is hereby further amended by deleting the fr:llowing pa;ugr��li;�. f.-�m Sec�ion 7.5 in its entirety: DOD Amendments Page 1 of 4 "4. Area and height regulations. Height of building and structures shall in no case exceed two stories or 35 feet." and adding the following language to paragraph 4: 4. Area regulations shall be determined by the underlying districts, except that all front setbacks must be a minimum of 30 feet. Section 3. Appendix C of the Friendswood City Code, same being city of Friendswood, Texas, Ordinance No. 84-15, as amended, originally passed and approved the 19tn day of November, 1984, and being the Zoning Ordinance of the City, is hereby further amended by deleting the following from Subsection 7.5 of Section 7 the following paragraph 8.a.: 8. Landscaping. The minimum requirements for areas within the DOD areas follows: "a. Properties with frontage along the entryway shall provide a minimum ten- foot wide landscape buffer along the entire length of the lot." Section 4. App�ndix C of the Friendswood City Code, same being City of Friendswood, Texas, Ordinance No. 84-15, as amended, originally passed and approved the 19th day of November, 1984, and being the Zoning Ordinance of the City, is hereby further amended by amending paragraph 9.a. of subsection 7.5 of Section 7 by adding a new subsection 5, to read as follows: 5. Garage bays, or other similar large openings designed for automotive or industrial work, or designed for automobiles to drive into, mav not face Friendswood Drive within the Downtown Overlav District. Provided, however, that this prohibition shall not ir��lude drive-thro�khs such as are typically found at banks or fast food establisl;cnents. DOD Amendments Page 2 of 4 Section 5. Appendix C of the Friendswood City Code, same being City of Friendswood, Texas, Ordinance No. 84-15, as amended, originally passed and approved the 19th day of November, 1984, and being the Zoning Ordinance of the City, is hereby further amended by amending paragraph 9.b. 1 of subsection 7.5 of Section 7 by deleting the current language in its entirety: "Residential development not facing the entryway (i.,e., subdivisions, etc.) shall be required to install an opaque screening wall no closer than five feet from the street right- of-way. Said wall shall be a minimum of six feet in height." and replacing it with a new paragraph 9.b.1 to read as follows: Residential developments not facing the entryway shall be required to install a visual barrier to a minimum mature height of six (6) feet as measured from the finished �rade. The barrier shall be set back from the street right of way line by a minimum of five (5) feet. Various materials may be utilized, including landscaped earth berms, provided the materials are durable and require low maintenance. All barriers are required to be maintained by the property owner or a Home Owners Association set up for such purposes and filed of record. Subdivision plats submitted for residential property along the entrvwav corridors shall include detailed information and visual representations of the proposed barrier, and such other information as the Commission mav reasonabl determine to be necessary. Section 6. Except as otherwise herein expressly amended, all other provisions of Appendix C of the Code of Ordinances of the City of Friendswood, Texas, said Appendix C DOD Amendments Page 3 of 4 being the Zoning Ordinance of the City, Ordinance No. 84-15, originally adopted the 19t'' day of November, 1984, as it may have been prev:dusly amended, remain unchanged and in full force and effect. Section 7. Any person who shall violate any provision of this Ordinance shall be deemed guilty of a misdemeanor and, upon conviction, shall be fined in an amount not to exceed $2,000. Each day of violation shall constitute a separate offense. Section 8. In the event any clause phrase, provision, sentence, or part of this Ordinance or the application of the same to any person or circumstances shall for any reason be adjudged invalid or held unconstitutional by a court of competent jurisdiction, it shall not affect, impair, or invalidate this Ordinance as a whole or �r,y part or provision hereof other than the part declared to be invalid or unconstitutional; and the City Council of the City of Friendswood, Texas, declares that it would have passed each and every part of the same notwithstanding the omission of any such part thus declared to be invalid or unconstitutional,whether there be one or more parts.
