AN ORDINANCE OF THE CITY OF FRIENDSWOOD, TEXAS,
AMENDING CHAPTER 26 OF THE CODE OF ORDINANCES OF
THE CITY OF FRIENDSWOOD, TEXAS, SAID CHAPTER 26
BEING THE ENVIIiONMENT ORDINANCES OF THE CITY OF
FRIENDSWOOD, BY AMENDING ARTICLE VII, OIL AND GAS,
BY AMENDING SECTION 26-221 BY ADDING A NEW
SUBSECTION (1) PROHIBITING THE PLACEMENT OF WELLS
ON ANY PROPERTY UTILIZED FOR RECREATIONAL
PURPOSES OR FACILITIES; PROVIDING FOR A PENALTY IN
AN AMOUNT NOT TO EXCEF,D $2,000 PER DAY OF
VIOLATION; AND PROVIDING FOR SEVERABILITY.

BE IT ORDAINED BY THE CITY COUNCIL OF THE CI'TY O�F
FRIENDSWOOD, TEXAS:
Section 1. Chapter 26 of the Code of Ordinances of the City of Friendswood,
Texas, said Chapter 26 being the Environment Ordinances of the City, Section 26-221,
Proximity of well, tanks or pipelines to buildings; permission; noise levels, shall be and is
hereby revised and amended by adding the following new subsection:
(1) No well shall be drilled on any property that is utilized for recreational
purposes, without the express written consent of the property owner. For the
�urposes of this section, "recreational purposes" shall include, but not be limited
to, land devoted to recreational or leisure pursuits, such as playing fields or
courts, publicly ar privately owned�arks or open space reserves, or publicly or
privately owned and operated golf courses, driving ran�es, or lakes. To the
greatest extent practicable, slant drilling shall be utilized to access reserves under
such recreationally used land, and such shall be given extra consideration bv
Council when considerin�permits for land adjacent to recreationall used land.

Section 2. Except as otherwise herein expressly amended, all other provisions
of Appendix C of the Code of Ordinances of the City of Friendswood, Texas, said
Appendix C being the Zoning Ordinance of the City, Ordinance No. 84-15, originally
adopted the 19th day of November, 1984, as it may have been previously amended,
remain unchanged and in full force and effect.
Section 3. Any person who shall violate any provision of this Ordinance shall
be deemed guilty of a misdemeanor and,upon conviction, shall be fined in an amount not to
exceed$2,000. Each day of violation shall constitute a separate offense.
Section 4. In the event any clause phrase, provision, sentence, or part of this
Ordinance or the application of the same to any person or circumstances shall for any
reason be adjudged invalid or held unconstitutional by a court of competent jurisdiction, it
shall not affect, impair, or invalidate this Ordinance as a whole or any part or provision
hereof other than the part declared to be invalid or unconstitutional; and the City Council of
the City of Friendswood, Texas, declares that it would have passed each and every part of
the same notwithstanding the omission of any such part thus declared to be invalid or
unconstitutional,whether there be one or more parts.
