HomeMy WebLinkAboutOrdinance No. 2000-42 ORDINANCE N0. 2000-42 AN ORDINANCE AMENDING CITY OF FRIENDSWOOD, TEXAS, ORDINANCE NO. 85-19, AS AMENDED, ORIGINALLY ADOPTED THE 25th DAY OF SEPTEMBER, 1985, BEING APPENDIX B OF THE FRIENDSWOOD CITY CODE, AND BEING AN ORDINANCE PROVIDING RULES AND REGULATIONS GOVERNING PLATS AND THE SUBDIVISION OF LAND WITHIN THE CITY, BY ADDING A NEW PROVI5ION TO SUBSECTI01 ;a) OF SECTION III, GENERAL REQUIREMENTS AND MINIMUM D�SIGN STANDARDS, PROVIDE THAT CERTAIN ORDINANCES FOR PLANNED UNIT DEVELOPMENT DISTRICTS WILL CONTROL OVER THE SUBDIVISION ORDINANCE, PROVIDING FOR A PENALTY, AND PROVIDING FOR SEVERABILITY. � � * � � WHEREAS, it is hereby declared by the City Council that the granting of the modification of subdivision requirements or design standards by adoption and approval of ordinances for Planned Development Districts will not be detrimental to the public safety, health, or welfare or injurious to other property; and WHEREAS, in circumstances where alt�:rnative development proposed by the subdivider will serve the public interest as well or better than the standards contained in the subdivision ordinance or design standards, will fulfill the public interest, and be an improvement to said property; NOW, THEREFORE, be it ordained by the City Council of the City of Friendswood, State of Texas: Section 1. The facts and matters set forth in the preamble of this Ordinance are hereby found to be true and correct. Section 2. Appendix B of the Code of Ordinances of the City of Friendswood, Texas, said Appendix B being the Subdivision Ordinance of the City, subsection a., of Section III, Subdivision/PUD Conflict PAGE 1 General Requirements and Minimum Design Criteria, is hereby amended by adding the following sentence at the end of the subsection: Provided however, City Council may, through the following ordinances, approve standards different than those contained in this Appendix B or the Design Criteria Manual. Where different standards are approved, whether those standards are more stringent or less stringent, they shall control: (1) an ordinance reclassifying land to a planned unit development district PUD or (2) an ordinance approving a specific use permit for a PUD district. Section 3. Penalty Any person who shall violate any provision of this Ordinance shall be deemed guilty of a misdemeanar and, upon conviction, shall be fined in an amount not to exceed$2,000. Each day of violation shall constitute a separate offense. Section 4. Severability. In the event any clause phrase,provision, sentence, or part of this Ordinance or the application of the same to any person or circumstances shall for any reason be adjudged invalid or held unconstitutional by a court of competent jurisdiction, it shall not affect, impair, or invalidate this Ordinance as a whole or any part or provision hereof other than the part declared to be invalid or unconstitutional; and the City Council of the City of Friendswood, Texas, declares that it would have passed each and every part of the same notwithstanding the omission of any such part thus declared to be invalid or unconstitutional,whether there be one or more parts.
