ORDINANCE NO. 2013-32 AN ORDINANCE AMENDING CITY OF FRIENDSWOOD, TEXAS, ORDINANCE NO. 2012-26, PASSED AND APPROVED OCTOBER 1, 2012, SAME BEING AN ORDINANCE APPROVING AND ADOPTING THE CITY'S GENERAL BUDGET FOR FISCAL YEAR 2012-2013 BY APPROVING "BUDGET AMENDMENT XIV" TO THE "ORIGINAL GENERAL BUDGET OF THE CITY OF FRIENDSWOOD, TEXAS, FOR THE FISCAL YEAR 2012- 2013"; PROVIDING FOR SUPPLEMENTAL APPROPRIATION AND/OR TRANSFER OF CERTAIN FUNDS; PROVIDING FOR SEVERABILITY; AND PROVIDING OTHER MATTERS RELATED TO THE SUBJECT. WHEREAS, by Ordinance No. 2012-26, the City Council of the City of Friendswood, Texas, adopted its "Original General Budget for Fiscal Year 2012-2013"; and WHEREAS, the City Council has determined that revenues and/or reserves are available for supplemental appropriation, and/or that the transfer of certain funds interdepartmentally is economically feasible and in the best interest of prudent budgeting and for municipal purposes; and WHEREAS, Section 8.04 of The City Charter provides for amendments after adoption of the budget; and WHEREAS, the City Council desires to amend said Original General Budget to reflect such supplemental appropriation and/or transfer in the fiscal year 2012-2013; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FRIENDSWOOD, STATE OF TEXAS: Section 1. The facts and matters set forth in the preamble of this Ordinance are hereby found to be true and correct. Section 2. The "Original General Budget of the City of Friendswood, Texas, for the Fiscal Year 2012-2013," is hereby amended for municipal purposes as shown on `Budget Amendment XIV"to the "Original Budget of the City of Friendswood, Texas, for the Fiscal year 2012-2013" attached hereto. Said Budget Amendment XIV shall be attached to and made a part of such Original General Budget by the City Secretary and shall be filed as required by state law, a true and correct copy of which is attached hereto as Exhibits "A" and "B" and made a part hereof for all purposes. Section 3. In the event any clause,phrase, provision, sentence, or part of this ordinance or the application of the same to any person or circumstance shall for any reason be adjudged invalid or held unconstitutional by a court of competent jurisdiction, it shall not affect, impair, or invalidate this ordinance as a whole or any part or provision hereof other than the part declared to be invalid or unconstitutional; and the City Council of the City of Friendswood, Texas, declares that it would have passed each and every part of the same notwithstanding the omission of any such part thus declared to be invalid or unconstitutional,whether there be one or more parts. Community Service Keep Friendswood Beautiful donations. $1,709. Appropriate donations received for Keep Friendswood Beautiful in the Community Service department. Donations totaling $1,709 were received beginning November 5, 2012 to August 5, 2013 for Spring Sparkle, Fig Fest, and Movies in the Park. Funds will be appropriated to the Keep Friendswood Beautiful division of the Community Services department's operating budget. The funds will be used for improvements at Stevenson Park. 2. Community Services, July 4th donation, $4,040. Appropriate funds donated from David Weekley Homes, Joyce Tolliver- Allstate Insurance, Randy Stine - BMW of Clear Lake, and Alinda Marting to the Community Services department for the July 4th event sponsorships. Funds will be appropriated to the overtime account in the July 4th Program division to help offset overtime expenses incurred during the event. 3. Community Services July 4t" Program Division. $3,484. Appropriate donations from the sale of wristbands at the July 4 event to help offset overtime and other payroll expenses incurred during the event. 4. Community Service Keep Friendswood Beautiful donation. $3,500. Appropriate donations to Keep Friendswood Beautiful in the Community Service department. The funds will be used to purchase two solar lights that will be installed among the other existing lights around the playground at Stevenson Park. 5. Police Department Rape Aggression Defense Donations, $500. Appropriate funds donated to the Police Department Rape Aggression Defense (R.A.D.) Program. Donations were received from the Citizens participating in the R.A.D. classes. Funds will be appropriated to the Police Department Patrol operating supplies for R.A.D. program expenses. 6. Police Investigation Fund Revenue. $6,000. Appropriate state asset forfeiture funds received by the City from the Harris County District Attorney's Office. Funds will be used for services to design and install custom graphics and decals on the DARE vehicle. Funds will be appropriated to the Police Investigation Fund vehicle capital account. 7. Police Department Animal Control, $5,575. Appropriate funds received from animal adoption fees in excess of the FY13 adopted budget. The FY13 budget included revenues based on prior years collections with adoption fees of$85 for cats and $100 for dogs. The funds will be appropriated to the Animal Control operating budget for adoption related services.
