R2013-13 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF FRIENDSWOOD, TEXAS, DEDICATING THE USE OF REAL PROPERTY AS MUNICIPAL PARK LAND AND DECLARING ITS ACCEPTANCE AND INCLUSION INTO 1776 MEMORIAL PARK; AND REPEALING ALL OTHER RESOLUTIONS INCONSISTENT OR IN CONFLICT HEREWITH. Whereas, by virtue of that certain deed dated December 31, 1975 and recorded in Volume 2653, Pages 647 through 650, of the Deed Records of Galveston County, Texas, the City of Friendswood, Texas (the "City") acquired an approximately 12.6 acre parcel of land from Mary Louise Fitch Soule and husband, Harold M. Soule, to be used exclusively as a public park, which park is located on Edgewood Drive and Clear Creek and known as "1776 Memorial Park;" and Whereas, the City is the owner and holder of certain additional parcels of land located adjacent to 1776 Memorial Park and located in Imperial Estates, Section One (1), which parcels are legally described as: Lots 6 through 28, 30 through 38, 40, 41, 43 and 45 through 47, of Imperial Estates, Section One (1), a subdivision in Galveston County, Texas, according to the map or plat thereof, recorded in Volume 254-A, Page 81 of the Map Records of Galveston County, Texas. and which additional parcels of land shall, for the purposes of this resolution, be described as the "Buyout Lots;" and Whereas, the City Council wishes to expand the boundaries of 1776 Memorial Park to accept the Buyout Lots as additional acreage to be included into 1776 Memorial Park and to dedicate the same to municipal park use; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FRIENDSWOOD, TEXAS: Section 1. The City Council of the City of Friendswood, Texas, hereby declares that the Buyout Lots as described in this resolution shall be and they are hereby accepted as additional acreage to be included into 1776 Memorial Park and that the same is dedicated to municipal park use. Section 2. Upon passage of this resolution, the City Manager shall direct that any and all necessary actions be taken in order to re-define the boundaries of 1776 Memorial Park so as to reflect the inclusion of the Buyout Lots as described herein. Section 3. All resolutions or parts of resolutions inconsistent or in conflict herewith are,to the extent of such inconsistency or conflict, hereby repealed.
