HomeMy WebLinkAboutOrdinance No. 2001-21 ' , . , ORDINANCE NO. 2001-21 AN ORDINANCE AMENDING APPENDIX C OF THE FRIENDSWOOD CITY CODE, SAID APPENDIX C BEING CITY OF FRIENDSWOOD, TEXAS, ORDINANCE NO. 84-15, AS AMENDED, ORIGINALLY ADOPTED THE 19TH DAY OF NOVEMBER, 1984, AND BEING THE ZONING ORDINANCE OF THE CITY, BY STRIKING ALL OF PARAGRAPHS 3, 4, AND 5 OF SUBSECTION H OF SECTION 9 THEREOF AND SUBSTITUTING THEREFOR NEW PARAGRAPHS 3, 4, AND 5; AND BY DELETING THE REFERENCE TO "FINAL SITE PLAN" IN PARAGRAPH 6 THEREOF; PROVIDING THAT THE COMMERCIAL SITE PLAN APPROVAL PROCESS SHALL INCLUDE ONE REVIEW AND APPROVAL PROCEDURE; PROVIDING OTHER MATTERS RELATING TO THE SUBJECT; PROVIDING A PENALTY OF AN AMOUNT NOT TO EXCEED $2,000 FOR EACH DAY OF VIOLATION OF ANY PROVISION HEREOF; AND PROVIDING FOR SEVERABILITY. � � * * BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FRIENDSWOOD, STATE OF TEXAS: Section 1. Appendix C of the Code of Ordinances of the City of Friendswood, Texas, said Appendix C being the Zoning Ordinance of the City, is hereby amended by striking all of Paragraphs 3, 4, and 5 of Subsection H of Section 9 thereof, which reads as follows: [3. Content. The content of both preliminary and final site plans are described above in section 9.G.3. An applicant shall submit copies of preliminary or final site plans for consideration by the commission. 4. Preliminary approval. An applicant for development which requires a site plan shall first submit a preliminary site plan to the commission. After the proposed preliminary site plan is first considered by the commission, the commission shall render a decision thereon within 30 days. Such decision may consist of approval or disapproval. Preliminary approval will expire 90 days after the approval by the commission of the preliminary site plan. Upon expiration of that time, the applicant must resubmit a new preliminary site plan that conforms to current ordinances. Provided, however, that the applicant may request an extension in writing, which may be granted by the commission, for a period not to exceed a total of 90 days. 5. Final approval. An applicant may submit a final site plan for consideration by the commission at any time after preliminary approval is FWD/Site Plan Amendment-Page 1 granted. After the proposed final site plan is first considered by the commission, the commission shall render a decision thereon within thirty days. Such decision may consist of a recommendation to council to approve or disapprove the final site plan. Approval will expire one year after the approval by the commission of the final site plan. Upon expiration of that time, the applicant must resubmit a new preliminary and final site plan that conform to current ordinances. Provided, however, that the applicant may request an extension in writing, which may be granted by the commission, for a period not to exceed a total of six months.] and substituting therefor new Paragraphs 3, 4, and 5, which shall read as follows: 3. Content. The content of site plans are described above in section 9.G.3. 4. Sta ff review. An applicant for development that requires a site plan shall first consult with staff regardin� the ordinance requirements and pro�osed development plan. An applicant shall consult with staff until all significant issues surrounding the proposed site plan and development are resolved, prior to proceedin�to the commission. 5. Commission action. An applicant may submit a site �lan for consideration bv the commission at any time after staff review is completed. After the proposed site plan is first considered by the commission, the commission shall render a decision thereon within thirtv (30) days. Any corrections, changes, or conditions required to ensure the plan com�lies with all existing ordinances that are imposed by the commission shall be�rovided to the applicant, in writing, and shall become a part of the a�proved site plan which if not met, may be cause for enforcement action or invalidation of the site plan. Approval will expire one vear after the approval of the site plans by the commission. Upon expiration of that time, the applicant must resubmit a site plan that conforms to current ordinances. Provided, however the applicant may request an extension in writin�, which may be granted bv the commission, for a period not to exceed a total of six (6)months. Section 2. Appendix C of the Code of Ordinances of the City of Friendswood, Texas, said Appendix C being the Zoning Ordinance of the City, is hereby amended by striking the word"final" from Paragraph 6 of Subsection H of Section 9 thereo£ Following the approval of a [final] site plan, the building official shall inspect the development to insure that it is in full compliance with the approved site plan. FWD/Site Plan Amendment-Page 2 Section 3. Any person who shall violate any provision of this Ordinance shall be deemed guilty of a misdemeanor and, upon conviction, shall be fined in an amount not to exceed $2,000. Each day of violation shall constitute a separate offense. Section 4. In the event any clause phrase,provision, sentence, or part of this Ordinance or the application of the same to any person or circumstances shall for any reason be adjudged invalid or held unconstitutional by a court of competent jurisdiction, it shall not affect, impair, or invalidate this Ordinance as a whole or any part or provision hereof other than the part declared to be invalid or unconstitutional; and the City Council of the City of Friendswood, Texas, declares that it would have passed each and every part of the same notwithstanding the omission of any such part thus declared to be invalid or unconstitutional,whether there be one or more parts.
