AN ORDINANCE AMENDING APPENDIX C OF THE CODE OF
ORDINANCES OF THE CITY OF FRIENDSWOOD, TEXAS,
APPENDIX C BEING THE ZONING ORDINANCE OF THE CITY,
BY CHANGING THE ZONING CLASSIFICATION OF A .4821-
ACRE TRACT OF LAND, LOCATED AT 307 E. EDGEWOOD
DRIVE, LOT 4, BLOCK 9, FRIENDSWOOD SUBDIVISION OUT
OF THE SARAH MCKISSICK/V.P. WILLIAMS LEAGUE,
GALVESTON COUNTY, TEXAS; PROVIDING FOR THE
GRANTING OF AN AMENDMENT TO THE SPECIFIC USE
PERMIT (SUP) APPROVED BY ORDINANCE 2011-18 ON MAY 5,
2011, TO ALLOW THE ADDITIONAL USE OF THE PROPERTY
FOR NAICS USE#442 —"FURNITURE AND HOME FURNISHING
STORES", AND FURTHER SUBJECT TO THE PRIOR
REGULATIONS, RESTRICTIONS, AND CONDITIONS OF
ORDINANCE 95-1, ADOPTED ON JANUARY 23, 1995
ESTABLISHING THE PLANNED UNIT DEVELOPMENT (PUD)
FOR THE USE OF THE SUBJECT PROPERTY; PROVIDING FOR
AMENDMENT OF THE OFFICIAL ZONING MAP; PROVIDING
A PENALTY IN AN AMOUNT NOT TO EXCEED $2,000 FOR
EACH DAY OF VIOLATION OF ANY PROVISION HEREOF;
AND PROVIDING FOR SEVERABILITY.
WHEREAS, 313 E. Edgewood, L.P., is the Owner of a .4821-acre tract of land, located
at 307 E. Edgewood Drive, Friendswood, Texas, being Lot 4, Block 9, Friendswood
Subdivision, out of the Sarah McKissick/V.P. Williams League, according to the map thereof
recorded in Volume 7, Page 20 (formerly Volume 254A, Page 18), of the Map Records of
Galveston, County, Texas, more specifically described in the attached Exhibit "A", which is
incorporated by reference for all purposes and made a part hereof(the"Property'); and
WHEREAS, the Owner previously made application to the City to change the zoning
classification of the Property, situated in a Planned Unit Development (PUD), by granting a
Specific Use Permit (SUP) to allow the additional use of the Property for NAICS use #621 —
"Ambulatory Health Care Services", NAICS use 452 — "Finance and Insurance", NAICS use
#531 — "Real Estate", NAICS use #54 — "Professional, Scientific and Technical Services",
NAICS use #55 — "Management of Companies and Enterprises", and NAICS use #8121 -
Personal Care Services", specifically excluding NAICS use #541940 (Veterinarian Services),
NAICS use #812113 (Nail Salons), and NAICS use #812199 (Tattoo Parlors and Ear Piercing
Services) as referenced in Ordinance 2011-18, adopted on May 5, 2011, and the related
regulations, restrictions, and conditions contained therein, (the"Prior Ordinance"); and
WHEREAS, the Owner has now requested an amendment to the Prior Ordinance by
making an application, (a copy of which is attached hereto as Exhibit `B", including a more
detailed property description which is incorporated by reference), to change the zoning
classification of the Property by granting a Specific Use Permit (SUP) amendment to add the
uses of the Property for NAICS use #442 — "Furniture and Home Furnishing Stores", NAICS
use#448 —"Clothing and Clothing Accessory Stores,"and NAICS use #451 —"Sporting Good,
Hobby, Book and Music Store" expressly subject to the prior regulations, restrictions, and
conditions of the Prior Ordinance (2011-18), and Ordinance 95-1, adopted on January 23, 1995
establishing the PUD for the use of the subject Property; and
WHEREAS, the Planning and Zoning Commission and the City Council have
conducted, in the time and manner required by law and the Zoning Ordinance of the City, a
public hearing on such request; and

WHEREAS, the Planning and Zoning Commission has filed its written report with City
Council,which recommends approval of the application, subject to certain conditions; and
WHEREAS, the City Council deems it appropriate to grant such request, subject to
certain regulations,restrictions, and conditions; now,therefore,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FRIENDSWOOD,
STATE OF TEXAS:
Section 1. The facts and matters set forth in the preamble of this Ordinance are
hereby found to be true and correct.
Section 2. City of Friendswood,Texas, Ordinance No. 84-1.5, as amended, originally
adopted the 19th day of November, 1984, the same being Appendix C of the Friendswood City
Code, and also being the zoning ordinance of the City, is amended by changing the zoning
classification of the Property, a .4821-acre tract of land, located at 307 E. Edgewood Drive,
Friendswood, Texas, being Lot 4, Block 9, Friendswood Subdivision, out of the Sarah
McKissick/V.P. Williams League, according to the map thereof recorded in Volume 7, Page 20
(formerly Volume 254A, Page 18), of the Map Records of Galveston, County, Texas, by hereby
granting another Specific Use Permit (SUP) amendment to add more approved uses for the
Property, (situated in a PUD pursuant to Ordinance 95-1, adopted on January 23, 1995) for
NAICS use 4442 — "Furniture and Horne Furnishing Stores", expressly subject to the prior
regulations,restrictions, and conditions of Ordinance 95-1, establishing a PUD for the use of the
subject property, not in conflict with the terms of this Ordinance.
Section 3. The Zoning District Map of the City of Friendswood shall be revised and
amended to show the designation of the Property, as described and as provided in Section 2
above, with the appropriate reference thereon to the number and effective date of this
Ordinance, and a brief description of the nature of the change.
Section 4. This Ordinance shall in no manner amend, change, supplement, or revise
any provision of any ordinance of the City of Friendswood, save and except the change in zoning
classification of said Property as described in Section 2 hereof.

Section 5. In the event any section, paragraph, subdivision, clause, phrase, provision,
sentence, or part of this Ordinance or the application of the same to any person or circumstance
shall for any reason be adjudged invalid or held unconstitutional by a court of competent
jurisdiction, it shall not affect, impair, or invalidate this Ordinance as a whole or any part or
provision hereof other than the part declared to be invalid or unconstitutional; and the City
Council of the City of Friendswood, Texas, declares that it would have passed each and every
part of the same notwithstanding the omission of any and every part of the same notwithstanding
the omission of any such part thus declared to be invalid or unconstitutional, or whether there be
one or more parts.
Section 6. Any person who shall willfully, intentionally, or with criminal negligence
violate any provision of this Ordinance shall be deemed guilty of a misdemeanor and, upon
conviction thereof, shall be fined in an amount not to exceed $2,000.00. Each day of violation
shall constitute a separate offense.

I, Robin Killingsworth, aspire to open a furniture boutique/design consultation f
business at 307 E. Edgewood Dr. (FM 2351). In order to do so, I must acquire a
442 for a furniture and home furnishings store.
The main objective of my business will involve the sale of my services as an
interior decorator and "special order"furniture. My decorating services include, 1
but are not limited to; new/special order/custom designed furniture, furniture
rearrangement, rehanging art, restaging bookshelves/built-ins, drapery, and
color consultation.
The retail (mercantile) aspect of my business will involve the sale of casegoods {
(ex. end tables, consoles, bookshelves), home accents (ex.picture frames, vases,

lamps), and gift items (ex. stationary, luggage tags, journals).

I am aware that if I ever wish to sell upholstery I must "sprinkle"the building
according to group M occupancy code 903.2.7, #4. My current business plan
does not involve stocking upholstery, as mentioned above, upholstery will be by
special order only.
When it comes to receiving inventory and special order shipments, this will be
done at a location in Pearland, TX, well equipped for 18-wheelers.
