OF SECTION 1 OF APPENDIX A THEREOF, SAID APPENDIX A BEING THE CITY'S SIGN ORDINANCE, AND SUBSTITUTING THEREFOR A NEW PARAGRAPH o; PROVIDING A DEFINITION OF "MONUMENT SIGN"; ESTABLISHING A MAXIMUM HEIGHT OF SEVEN FEET FOR ALL MONUMENT SIGNS, EXCLUDING ANY CONCEALED POLE BASE; PROVIDING A PENALTY; AND PROVIDING FOR SEVERABILITY. * * * � * BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FRIENDSWOOD, STATE OF TEXAS: • Section 1. The Code of Ordinances of the City of Friendswood, Texas, is hereby amended by striking all of Paragraph o of Section 1 of Appendix A thereof, said Appendix A being the City's Sign Ordinance, which reads as follows: [o. Monument sign: A ground sign mounted on the ground and not elevated above the ground by any columns, poles, uprights, or braces.] and substituting therefor a new Paragraph o, which shall read as follows; o. Monument siQn: A sign not more than seven feet (7') in hei�ht from natural �round level to the hi�hest portion of the sign. Such signs shall be desi�ned and constructed to substantially aUpear as a solid mass such as a block, rectangle, or square, and shall be sup�orted by an integral structural framework. Section 2. Any person who shall violate any provision of this Ordinance shall be deemed guilty of a misdemeanor and, upon conviction, shall be fined in an amount not to exceed $2,000. Each day of violation shall constitute a separate offense. Section 3. In the event any clause phrase,provision, sentence, or part of this Ordinance or the application of the same to any person or circumstances shall for any reason be adjudged FW D/SIGNS-MONUMENT/12/27/2001 invalid or held unconstitutional by a court of competent jurisdiction, it shall not affect, impair, or invalidate this Ordinance as a whole or any part or provision hereof other than the part declared to be invalid or unconstitutional; and the City Council of the City of Friendswood, Texas, declares that it would have passed each and every part of the same notwithstanding the omission of any such part thus declared to be invalid or unconstitutional, whether there be one or more parts.
