ORDINANCE NO. 2002-OS
AN ORDINANCE OF THE CITY OF FRIENDSWOOD, TEXAS,
ADOPTING A POLICY GOVERNING THE EXTENSION OF WATER
AND SEWER SERVICES TO PROPERTIES OUTSIDE THE CITY
LIMITS; PROVIDING EXCEPTIONS; AND PROVIDING OTHER
MATTERS RELATING TO THE SUBJECT .

WHEREAS,the City of Friendswood has and continues to work diligently to increase its
water and sewer capacities in preparation for full development of all lands within the City, such
endeavor involving significant expenditures (i.e. a second surface water plant and a second
elevated storage tank, as well as the future expansion of existing facilities such as the Blackhawk
WWTP, the City of Houston's Southeast Water Purification Plant and various trunk waterlines
around the City), all of which activity has placed the City in a position to proactively address,
encourage, and provide for future growth; and
WHEREAS, it is not economically viable for the City or its citizens and taxpayers to
provide a lifeline to businesses that have elected to locate outside of the City limits yet compete
with the City's economic development programs; and
WHEREAS, the City Council hereby finds and determines that the providing of potable
water and sanitary sewer service for developments located outside the corporate limits of the City
creates an undue economic burden on the citizen taxpayers of the City, and further depletes the
capacities of such services available for properties within the City, now, therefore
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FRIENDSWOOD,
STATE OF TEXAS:
Section 1. The facts and matters set forth in the preamble of this Ordinance are
hereby found to be true and correct.
Section 2. The City Council hereby adopts and establishes the following policy with
regard to the provision of potable water and sanitary sewer services to properties located outside
the corporate boundaries of the City.
"Potable Water/Sanitary Sewer Service Policy
For Properties Located
Outside City Limits
The City will not provide potable water or sanitary sewer utility services
outside the corporate limits of the City, except as follows:
a. the City will continue to honor the interlocal agreement with the
City of Pearland to provide utility service to certain residential development;
b. the City will continue to serve out of city commercial
developments that have been provided service prior to the date of adoption hereof;
c. upon prior approval by the City Council, to properties which
require such service to protect persons against undue risk from environmental
hazards; and
d. upon prior approval by the City Council, when the providing of
such services is reasonably necessary to preserve and protect the environmental
condition of the property being served, and no reasonable alternative is available
under the circumstances then existing."
Section 3. The City Manager is hereby authorized and directed to take such action as
he deems necessary and appropriate to implement this policy immediately upon adoption hereof.
