ORDINANCE NO. 2013-01
AN ORDINANCE AMENDING CITY OF FRIENDSWOOD, TEXAS,
ORDINANCE NO. 2012-26, PASSED AND APPROVED OCTOBER 1,
2012, SAME BEING AN ORDINANCE APPROVING AND ADOPTING
THE CITY'S GENERAL BUDGET FOR FISCAL YEAR 2012-2013 BY
APPROVING "BUDGET AMENDMENT III" TO THE "ORIGINAL
GENERAL BUDGET OF THE CITY OF FRIENDSWOOD, TEXAS, FOR
THE FISCAL YEAR 2012-2013"; PROVIDING FOR SUPPLEMENTAL
APPROPRIATION AND/OR TRANSFER OF CERTAIN FUNDS;
PROVIDING FOR SEVERABILITY; AND PROVIDING OTHER
MATTERS RELATED TO THE SUBJECT.
WHEREAS, by Ordinance No. 2012-26, the City Council of the City of Friendswood,
Texas, adopted its "Original General Budget for Fiscal Year 2012-2013'; and
WHEREAS, the City Council has determined that revenues and/or reserves are available
for supplemental appropriation, and/or that the transfer of certain funds interdepartmentally it
economically feasible and in the best interest of prudent budgeting and for municipal purposes;
and
WHEREAS, Section 8.04 of The City Charter provides for amendments after adoption
of the budget; and
WHEREAS, the City Council desires to amend said Original General Budget to reflect
such supplemental appropriation and/or transfer in the fiscal year 2012-2013; now, therefore,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FRIENDSWOOD,
STATE OF TEXAS:

Section 1. The facts and matters set forth in the preamble of this Ordinance are

hereby found to be true and correct.
Section 2. The "Original General Budget of the City of Friendswood, Texas, for the
Fiscal Year 2012-2013," is hereby amended for municipal purposes as shown on "Budget
Amendment III" to the "Original Budget of the City of Friendswood, Texas, for the Fiscal year
2012-2013" attached hereto. Said Budget Amendment III shall be attached to and made a part of
such Original General Budget by the City Secretary and shall be filed as required by state law, a
true and correct copy of which is attached hereto as Exhibits "A"and`B" and made a part hereof
for all purposes.
Section 3. In the event any clause,phrase, provision,sentence, or part of this ordinance
or the application of the same to any person or circumstance shall for any reason be adjudged
invalid or held unconstitutional by a court of competent jurisdiction, it shall not affect, impair, or
invalidate this ordinance as a whole or any part or provision hereof other than the part declared to be
invalid or unconstitutional; and the City Council of the City of Friendswood, Texas, declares that it
would have passed each and every part of the same notwithstanding the omission of any such part
thus declared to be invalid or unconstitutional, whether there be one or more parts.

Budget Amendment Summary
Fiscal Year 2012 — 2013
Budget Amendment III
January 7, 2013
1. Texas State Library Loan Program, $1,447. Appropriate funds received from
the Texas State Library Loan Program to the Library department. The
Friendswood Library participates in the Net Lending Program. Libraries agree tot
lend materials to the Texas public libraries through interlibrary loan. Libraries are
entitled to a reimbursement for net lends. The Friendswood Library completed
161 net loans. The funds were received on December 17, 2012.
2. Community Services — Santa in the Park, $6,335. Appropriate funds donated
to the Community Service Department for the Santa in the Park Event and
received from the sales of tickets for amusement park rides. The event was held
on December 8, 2012. Funds received will offset the cost of expenses related tol
the event incurred in the operating budget for the Community Services
Recreation Programs division.
3. Police Department Rape Aggression Defense Donations. $225. Appropriate
funds donated to the Police Department Rape Aggression Defense (R.A.D.)
Program. Donations were received from the Citizens participating in the R.A.D.
classes. Funds will be appropriated to the Police Department Patrol operating
supplies and membership expenses for R.A.D. program expenses.
4. Southwest Water Company Contract. $23,547. Appropriate funds to facilitate
the contract for water meter reading services. On November 5, 2012, City
Council completed the request for proposal process awarding the contract to
Southwest Water Company. The contract price for the service is $1.05 per mete
read for a total of$83,926 for fiscal year 2012-13. An additional amount of
$23,547 is needed to make up the difference from the FYI budget of$60,379 to
the new contract cost of $83,926. The amount budgeted in FYI was based on
the former contract price of$0.76 per meter reading. The funding source for the
additional amount requested is the Water and Sewer Fund Working Capital.
5. Tax Debt Service Fund. $17,195. Appropriate fund balance in the tax debt
service fund for the additional amount needed for the 2012-13 debt service
payment. The fiscal year 2012-13 adopted budget includes funding of $32,525
for the estimated debt service payment related for a 3-year capital lease to
purchase of a Dump Truck ($95,839), Street Roller ($13,838) and Concrete
Sealing Machine ($37,838). A financing proposal with Houston Community Bank
is being recommended for Council approval on January 7, 2013. The financing
proposal offers a 3-year capital lease with annual debt service payments of
$49,720; requiring additional funding of$17,195.
