HomeMy WebLinkAboutOrdinance No. 2026-22 ORDINANCE NO. 2026-22 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF FRIENDSWOOD,TEXAS, AMENDING ORDINANCE NO. 2025-23, PASSED AND APPROVED AUGUST 25, 2025, THE SAME BEING AN ORDINANCE APPROVING AND ADOPTING THE CITY'S GENERAL BUDGET FOR FISCAL YEAR 2025-26, BY APPROVING "BUDGET AMENDMENT X" THERETO;PROVIDING FOR SUPPLEMENTAL APPROPRIATION AND/OR TRANSFER OF CERTAIN FUNDS; PROVIDING FOR SEVERABILITY; PROVIDING FOR OTHER MATTERS RELATED TO THE SUBJECT; AND PROVIDING FOR THE EFFECTIVE DATE. ****************************************************************************** WHEREAS, by Ordinance No. 2025-23, the City Council of the City of Friendswood, Texas,adopted its "Original General Budget for Fiscal Year 2025-26";and WHEREAS, the City Council has determined that revenues and/or reserves are available for supplemental appropriation, and/or that the transfer of certain funds interdepartmentally is economically feasible and in the best interest of prudent budgeting and for municipal purposes; and WHEREAS, Section 8.04 of the City Charter provides for amendments after adoption of the budget; and WHEREAS, the City Council desires to amend said Original General Budget to reflect such supplemental appropriation and/or transfer in the fiscal year 2025-26;NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FRIENDSWOOD, STATE OF TEXAS: Section 1. The facts and matters set forth in the preamble of this ordinance are hereby found to be true and correct. Section 2. The "Original General Budget of the City of Friendswood, Texas, for the Fiscal Year 2025-26"is hereby amended for municipal purposes as shown on"Budget Amendment X" to the "Original Budget of the City of Friendswood, Texas, for the Fiscal Year 2025-26" attached hereto. Said Budget Amendment X shall be attached to and made a part of such Original General Budget by the City Secretary and shall be filed as required by state law. A true and correct copy of said amendment is attached hereto as Exhibits "A" and "B" and is incorporated herein for all intents and purposes. Section 3. In the event any clause,phrase,provision,sentence,or part of this ordinance or the application of the same to any person or circumstance shall for any reason be adjudged invalid or held unconstitutional by a court of competent jurisdiction, it shall not affect, impair, or invalidate this ordinance as a whole or any part or provision hereof other than the part declared to be invalid or unconstitutional; and the City Council of the City of Friendswood, Texas, declares that it would have passed each and every part of the same notwithstanding the omission of any such part thus declared to be invalid or unconstitutional, whether there be one or more parts. Section 4. This ordinance shall take effect immediately from and after its passage by the City Council of the City of Friendswood,Texas. Blackhawk Boulevard — Harris County Precinct 2 Reimbursement, $3,205,186. Appropriate funds received from Harris County Precinct 2 for a portion of Blackhawk Boulevard Reconstruction Phase II-C. Council appropriated advanced funding at the June 1, 2026, City Council meeting. Therefore, the funds will be appropriated back to unassigned general fund balance. 2. 2021 General Obligation Bond Arbitrage Rebate and Yield Reduction Payment, $145,062. Appropriate funds for the arbitrage rebate and yield reduction payment related to the 2021 General Obligation Improvement and Refunding Bonds. Willdan Financial Services completed their arbitrage installment calculations and determined a positive rebate liability. The funding source is interest earnings on the Bonds. 3. Police Department—Animal Services Donation, $1,975. Appropriate donation received from the Rotary Club of Friendswood for grooming and cleaning equipment. The funds will be appropriated to the Animal Service division's operating equipment account. 4. Library Department— Donation, $411. Appropriate donation received from the Rotary Club of Friendswood for Library books. The funds will be appropriated to the Library's books account. 5. Parks and Recreation Department—Tree Donation, $503. Appropriate donation received from the Heritage Gardeners, Inc, for a tree at Stevenson Park. The funds will be appropriated to the Parks division's landscaping account. 6. Parks and Recreation Department— Memorial Tree Donation, $531. Appropriate donation received from P. Guiliano for a memorial magnolia tree at Stevenson Park. The funds will be appropriated to the Parks division's landscaping account. 7. Greenbriar Bridge Project—Additional Engineering, $26,125. Appropriate funds for additional engineering services required for the Greenbriar Bridge Rehabilitation. Council approved the first amendment to the contract at the July 6, 2026, City Council meeting. The funding source will be unassigned general fund balance. 8. Utility Pipe Rack Relocation Project, $246,648. Appropriate settlement proceeds related to a bond performance claim against Cracon, Inc. The City entered into a settlement agreement with Travelers Insurance on June 18, 2026. Funds will be appropriated for additional engineering ($32,000) and construction costs ($214,648). 9. Blackhawk Building Perimeter Fence Replacement, $236,222.* Appropriate funds for the Blackhawk Building perimeter fence replacement. The current fence is past its useful life and irreparable. The funding source will be unassigned general fund balance ($118,111) and water and sewer working capital ($118,111). 10. Blackhawk Boulevard Phase II-C — Materials Testing, $154,085. Appropriate funds for Blackhawk Boulevard Phase II-C construction materials testing. Council approved an agreement with Paradigm Consultants, Inc. at the July 6, 2026, City Council meeting. The funding source will be streets improvement fund undesignated fund balance. Page 1 of 2 11. Public Works Department— Backhoe Replacement, $162,317*. Appropriate funds to replace PW164, a backhoe in the sewer utilities division. Council approved the purchase from Mustang Machinery at the July 6, 2026, City Council meeting. The funding source is water and sewer working capital. 12. Lift Station #2 Rehabilitation — Easement, $1,750. Appropriate funds for a Texas New Mexico & Power easement related to the Lift Station #2 Rehabilitation project. The City entered into an agreement for survey services with Lesak Enterprises, LLC on June 25, 2026. The funding source will be 2025 water and sewer revenue bonds. 13. Parks and Recreation Department— Memorial Bench Donation, $2,009. Appropriate donation received from S. Cervantes for a memorial bench at Stevenson Park. The funds will be appropriated to the Parks division's operating equipment account. 14. Parks and Recreation Department—Centennial Park Field Repair, $1,561. Appropriate reimbursement received to repair a sports field at Centennial Park. The field was damaged by a vendor during the July 4th celebration. The funds will be appropriated to the Parks division's operating maintenance account. 15. Library Department— Bathroom Door ADA Compliance, $16,046*. Appropriate funds to bring Library bathroom doors into compliance with Americans with Disabilities Act.
