The Code of Ordinances of the City of Friendswood, Texas, is hereby amended by deleting from Article II of Chapter 14 thereof all of Section 14-26, which provides as follows: [Sec. 14-26 Adopted. The 1997 Edition of the Standard Building Code, including all appendices except appendix B thereof, as published by the Southern Building Code Congress International, Inc., is hereby adopted by reference and made a part of this chapter. A copy of such code is on file with the city secretary.] and substituting therefor a new Section 14-26 to provide as follows: Sec. 14-26. International Building Code Adopted. The International Building Code, 2000 Edition, as published by the International Code Council, Inc., is hereby adopted by reference and made part of this chapter. A copy of such code is on file with the city secretar� Section 2. The Code of Ordinances of the City of Friendswood, Texas, is hereby further amended by deleting from Article II of Chapter 14 thereof all of Section 14-27, which provides as follows: [Sec. 14-27. Amendments. The building code adopted in section 14-26 is hereby amended as set out in this section. 104.7.4.1. The following section 104.7.4.1 is hereby adopted to read as follows: 104.7.4.1. Plan-checking fees. When the valuation of the proposed construction exceeds $1,000.00 and a plan is required to be submitted by section 103.2, a plan-checking fee shall be paid to the building official at the time of submitting plans and speci�cations for checking. Said plan-checking fee shall be equal to one-half of the building permit fee as set forth in section 103.7.4. Section 108.2.1. The following section 108.2.1 is hereby adopted to read as follows: 108.2.1. The Construction Board of Adjustment and Appeals shall consist of seven members. Such board members shall be composed of individuals with knowledge and experience in the technical codes, such as design professionals, contractors, building industry representatives and licensed 11/13/02 2 -.,, electrical contractors. In addition to the regular members, there shall be two alternate members, one member at large from the building industry and one member at large from the public. A board member shall not act in a case in which has a personal or financial interest. Section 1507.10.8. The following section 1507.10.8 is hereby adopted to read as follows: 1507.10.8. Notwithstanding any other provision of this code to the contrary, no wood shingles or shakes shall be used in the construction of any structure except single family residential structures, and then only when treated by an approved fire retardant. All plans shall indicate the roofing materials to be used. Section 1507.3.6.1 The following section 1507.3.6.1 is hereby adopted to read as follows: 1507.3.6.1. Composition shingles may not be secured with staples. Section I815. The following section 1815 is hereby adopted to read as follows: 1815. Approval by registered professional engineer. 1815.01. All foundations are to be approved by a registered professional engineer. All plans must be submitted with original wet seals applied. Section 1903.9. The following section 1903.9 is hereby adopted to read as follows: 1903.9. Paving concrete shall consist of 3,000 psi rating (5 sack or design mix) reinforced with 6 inch X 6 inch #6 wire mesh as a minimum. Section 2306.4. The following section 2306.4 is hereby adopted to read as follows: 2306.4. In addition to the requirements of this code, subflooring over joists must be applied with continuous beads of glue and be screwshank nailed. Section 2308.1.1.1. The following section 2308.1.1.1 is hereby adopted to read as follows: 2308.1.1.1. All studs shall be spaced sixteen (16") inches o.c.] and substituting therefor a new Section 14-27 to provide as follows: 11/13/02 3 Sec. 14-27. Amendments to International Building Code. The 2000 Edition of the International Building Code, as adopted in Section 14-26 above, is hereby amended as follows: Section 101.1. Section 101.1 is hereby amended to read as follows 101.1. Title. These regulations shall be known as the Buildin� Code of the City of Friendswood, Texas,hereinafter sometimes referred to as "this code." Section 101.4.1. Section 101.4.1 is hereby amended to read as follows: 101.4.1 Electrical. The provisions of the NFPA 70 National Electrical Code, as published by the National Fire Protection Association, heretofore adopted by the City, as amended, shall apply to the installation of electrical systems, including alterations, repairs, replacement, equipment ap�liances fixtures, fittin s��purtenances thereto. Section 108.2.1. Section 108.2.1 is hereby amended to read as follows: 108.2.1. Plan Checking Fees. When the valuation of the proposed construction exceeds $1,000.00 and a plan is required to be submitted under section 106 hereof, a plan-checking fee shall be paid to the Building Official at the time of submittin�plans and specifications for checkin . Said plan-checkin� fee shall be equal to one-half of the buildin�permit fee. Section 108.2.2. Section 108.2.2 is hereby amended to read as follows: 108.2.2. The Construction Board of Adjustment and Appeals shall consist of seven members. Such board members shall be composed of individuals with knowledge and experience in the technical codes such as desi�professionals, contractors, building industry representatives and licensed electrical contractors. In addition to its regular members the Board shall also consist of two alternate members one member at large from the building industrv and one member at large from the public. A board member shall not act on a case in which he or she has a personal or financial interest Section 110.1. Section 110.1 is hereby amended by adding a new last sentence to read as follows: 110.1....For the purpose of this section the moving of furniture or other personal property items into a�ropert�prior to issuance of a certificate of occupancy shall constitute the occupancy or use of the propert� Section 1507.9.9. Section 1507.9.9 is hereby amended to read as follows• 11/13/02 4 1507.9.9. Notwithstanding any other provision of this code to the contrary, no wood shin�les or shakes shall be used in the construction of anX structure, except single family residential structures, and then, only when treated by an approved fire retardant. All plans shall indicate the type of roofing materials proposed to be used. Section 1612.3. Section 1612.3 is hereby amended to read as follows: 1612.3 Flood Hazard Areas. The Flood Insurance Study for the City of Friendswood, Texas, as amended or revised, with accompanying Flood Insurance Rate Map (FIRM) and Flood Boundary and Floodway Map (FBFM) including related supportin� data and revisions thereto, is hereby adopted by reference and declared to be a part of this section. Section 1805.1. Section 1805.1 is hereby amended by adding a new �rst sentence to read as follows: 1805.1. All foundations are to be desi ng ed by a re istg ered professional engineer, and all plans shall be submitted with original wet seal stamps applied thereto.... Section 2308.9.1. Section 2308.9.1 is hereby amended to read as follows: 2308.9.1. The size, hei�ht and spacin� of studs shall be in accordance with Table 2308.9.1, except that utility grade studs shall not be spaced more than sixteen inches (16") on center, or support more than a roof and ceiling or exceed ei ht feet 8') in hei�ht for exterior walls and load-bearing walls or ten feet (10') for interior non-load-bearing walls. Two inch by four inch (2" x 4"� studs shall be spaced a maximum of sixteen inches (16") on center and two inch by six inch (2" x 6") studs shall be spaced a maximum of twenty-four inches (24") on center. 3409.2. The first paragraph of Section 3409.2 is hereby amended to read as follows: 3409.2 ApplicabilitY. Structures existin�prior to the effective date hereof, in which there is work involvin� additions alterations or chan e�_f occubancv, shall be made to conform to the requirements of this section or the provisions of Sections 3402 through 3406. Section 3. The Code of Ordinances of the City of Friendswood, Texas, is hereby further amended by adding to Article II of Chapter 14 thereof a new Section 14-28 to provide as follows: Sec. 14-28. Trash on construction sites. 11/13/02 5 Trash and/or discarded construction materials for all construction sites shall be contained in an enclosure desi�ned to prevent redistribution of the contents thereof(construction debris) by action of the wind, rain or other natural force. Section 4. The Code of Ordinances of the City of Friendswood, Texas, is hereby further amended by adding to Article II of Chapter 14 thereof a new Section 14-29 to provide as follows: Sec. 14-29. Site drainage. No improvement to any lot, tract or parcel of land within the City shall be authorized until a site drainage plan for surface water drainage is submitted and approved in accordance with this section and the ap�licable provisions of the City's flood dama�prevention regulations contained in Chapter 34 of this Code. No draina�e plan shall be approved that provides for the drainage of surface waters onto or throu�h adjacent properties, or which impounds or otherwise restricts natural flows, to the detriment to any adjacent or upstream property owner. Section 5. The Code of Ordinances of the City of Friendswood, Texas, is hereby further amended by adding to Article II of Chapter 14 thereof a new Section 14-30 to provide as follows: Section 14-30. Restoration of property to original condition. If construction work on any lot, tract or parcel of land within the City is stopped or abandoned for a period of 180 days and the extension of applicable permits are not obtained in accordance with applicable codes of the City such construction site shall be returned to its original natural state All partiallX constructed buildings, foundations, temporary utility facilities and other associated partially constructed improvements shall be com�letely removed and the site shall be cleaned of all materials properly graded and re-ve etated 5ection 6. The Code of Ordinances of the City of Friendswood, Texas, is hereby further amended by deleting from Article III of Chapter 14 thereof all of Section 14-59, which provides as follows: [Sec. 14-59. Circuits. (a) All wiring shall be copper, with the exception of temporary saw poles. 11/13/02 6 (b) Branch circuits in dwelling units shall be a minimum 12-2 copper. (c) "Pancake"-type outlet boxes shall not be used except by special authorization by the city electrical inspector.] Section 7. The Code of Ordinances of the City of Friendswood, Texas, is hereby further amended by deleting from Article III of Chapter 14 thereof all of Section 14-71, which provides as follows: [Sec. 14-71. Construction board of adjustment and appeals. The construction board of adjustment and appeals, as specified in section 108 of the Standard Building Code, shall be utilized for the regulation and examination of electricians performing work within the city.] and substituting therefor a new Section 14-71 to provide as follows: Sec. 14-71. Construction board of adjustment and a� ep a1s• The construction board of adjustment and appeals, as specified in section 112 of the International Building Code, shall be utilized for the regulation and examination of electricians within the citv. Section 8. The Code of Ordinances of the City of Friendswood, Texas, is hereby further amended by deleting the last sentence from Section 14-132 of Article III of Chapter 14 thereof, which last sentence provides as follows: Sec. 14-132. Permits for partial jobs. ...[Before the second electrician is issued a permit for the completion of the electrical work on the job, the electrical inspector shall first give three days' noticed to the electrician holding the original or first permit, if he can be found, to show good cause within three days why the second permit shall not be issued.] Section 9. The Code of Ordinances of the City of Friendswood, Texas, is hereby further amended by adding to Article III of Chapter 14 thereof a new Section 14-173 to provide as follows: Sec. 14-173. Master sign electrician. An examination for a master sign electrician's license shall be of such a nature as to show the applicant's satisfactorv knowled�e of the National Electrical 11/13/02 7 Code, such state statutes as are a�plicable, other recognized rec�uirements pertainin�; to electrical sign work and his ability to correctiv dia�ram and to instruct other persons in the making of practical electrical sign installations with correct sizes and values of required materials and devices. A master sign electrician designation shall only allow the holder of the license to do electrical work associated with the direct connection of the sign com�onents to the electrical su�lv for the sign. Extension or addition of circuits from any electrical source to the sign is not permitted for this license desi nag tion• Section 10. The Code of Ordinances of the City of Friendswood, Texas, is hereby further amended by deleting from Article III of Chapter 14 thereof all of Section 14-192, which provides as follows: [Sec. 14-192. Applications. Every application for a license as a master electrician or journeyman electrician shall be made upon a form furnished by the electrical inspector. Every application shall state the name, date of birth, residence and business address of the applicant, a statement of his active and practical experience, and shall state whether the applicant has previously been licensed as a master electrician or other classification of electrician, and, if so, when and by what state, county or city, and whether any such license has ever been suspended or revoked. A master electrician's application shall provide proof of four years of practical experience as a journeyman or licensed electrical engineer. A journeyman electrician's application shall provide proof of four years of electrical experience or the equal amount of time in an electrical trade school or a secondary school. Applications shall be accompanied by the license fee prescribed by resolution of the city council and printed in appendix D of this Code.] and substituting therefor a new 5ection 14-192 to provide as follows: Sec. 14-192. Applications. Ever�pplication for a license as a master electrician journe,�� electrician, or master sign electrician shall be made upon a form furnished by the citv's electrical inspector. Ever�pplication shall state the name date of birth residence and business address of the applicant a statement of his active and practical experience and shall state whether the applicant has previousl,,,� licensed as a master or other classification of electrician and if so, when and bv what state, county or city, and whether anv such license has ever been suspended or revoked. A master electrician's application shall provide proof of four (4) vears of nractical experience as a journeyman or licensed electrical en�ineer A journevman electrician's application shall provide proof of four years (4) of electrical experience or the equal amount of time in an electrical trade or secondarv school. A master sign electrician's application shall provide proof of 11/13/02 8 four 4Z e�practical experience as a sign electrician/installer. The license fee, as prescribed by resolution of the city council and printed in Appendix D of this Code, shall accompany each application. Section 11. The Code of Ordinances of the City of Friendswood, Texas, is hereby further amended by deleting from Article III of Chapter 14 thereof all of Section 14-196, which provides as follows: [Sec. 14-196. Issuance. Upon the submission of satisfactory proof that an applicant has successfully completed the examination as a master or a journeyman electrician as provided in division 6 of this article, the electrical inspector, upon payment of such fees and upon fulfillment of such other requirements as are specified in this article, shall issue to each applicant the class of license which such person is qualified to receive under the provisions of this article.] and substituting therefor a new Section 14-196 to provide as follows: Sec. 14-196. Issuance. Upon the submission of satisfactory proof that an a�plicant has successfull�pleted the examination as a master, journevman or master si�n electrician, as provided in division 6 of this article, the electrical inspector upon payment of such fees and upon fulfillment of such other requirements as are specified in this article, shall issue to each applicant the class of license that such person is qualified to receive under the�rovisions of this article. Section 12. The Code of Ordinances of the City of Friendswood, Texas, is hereby further amended by deleting from Article III of Chapter 14 thereof all of Section 14-197, which provides as follows: (Sec. 14-197. Restriction on work beyond scope of license. It shall be unlawful for the holder of any license issued under the provisions of this article to engage in any phase of the electrical business or perform any work in the electrical trade other than such business or work authorized by the class of license or permit held by him, except that a helper or a journeyman electrician may perform work laid out for him by a holder of a license enabling such holder to do such work.] and substituting therefor a new Section 14-197 to provide as follows: Sec. 14-197. Restriction on work beyond scope of license It shall be unlawful for the holder of any license issued under the provisions of this article to en�age in any phase of the electrical business or 11/13/02 9 perform anv work in the electrical trade, other than such business or work authorized bv the class of license or permit held by him. The master or journeyman electrician responsible for a project shall be present on the site whenever unlicensed labor is bein� used to install electrical materials, products, ar ec�uipment. Section 13. The Code of Ordinances of the City of Friendswood, Texas, is hereby further amended by deleting from Article IV of Chapter 14 thereof all of Section 14-232, which provides as follows: [Sec. 14-232. Standard Plumbing Code adopted. The Standard Plumbing Code, 1997 Edition, including appendices, except appendix A, thereto, as published by the Southern Building Code Congress International, Inc., a copy of which is on file with the city secretary, is hereby adopted and made a part of this article, save and except that, should any provision thereof be in conflict with the Examination Plumbing Code and Study Guide adopted in section 14-231, the Examination Plumbing Code and Study Guide shall prevail.] and substituting therefor a new Section 14-232 to provide as follows: Sec. 14-232. International Plumbing Code adopted. The International Plurnbing Code, 2000 Edition, as published b� International Code Council, Inc., a co�y of which is on file with the cit� secretary, is hereby adopted and made a part of this article; provided however in the event of conflict between the International Plumbing Code and the Exafnination Plumbing Code and Studv Guide, adopted pursuant to section 14- 231 above, the Examination PlumbinQ Code and Studv Guide shall og vern. Section 14. The Code of Ordinances of the City of Friendswood, Texas, is hereby further amended by deleting from Article IV of Chapter 14 thereof all of Section 14-233, which provides as follows: [Sec. 14-233. Amendments. The plumbing code adopted in section 14-232 is hereby amended as set out in this section. Section 106.5.2. The following section 106.5.2 is hereby adopted to read as follows: 106.5.2. The fees for all plumbing work shall be as established by resolution and printed in appendix D of the Code. 11/13/02 10 Section 106.5.3. The following section 106.5.3 is hereby adopted to read as follows: 106.5.3. The code official shall authorize the refunding of fees where the full amount of any fee paid hereunder was erroneously paid or collected. Section 108.4. Section 108.4 is hereby deleted in its entirety. Section 305.6.1. The following section 305.6.1 is hereby adopted to read as follows: 305.6.1. Building sewers that connect to private sewage disposal systems shall be a'minimum of 12 inches below finished grade at the point of septic tank connection. Building sewers shall be a minimum of 12 inches below grade. Section 904.1. The following section 904.1 is hereby adopted to read as follows: 904.1. All open vent pipes that extend through a roof shall be terminated at least 6 inches above the roof, except that where a roof is to be used for any purpose other than weather protection, the vent extensions shall be run at least 7 feet (2134 mm) above the roof.] and substituting therefor a new Section 14-233 to provide as follows: Sec. 14-233. Amendments. The 2000 Edition of the International Plumbing Code as ado tep d in Section 14-232 above, is hereby amended as follows: Section 101.1. Section 101.1 is hereby amended to read as follows: 101.1 Title. These re�ulations shall be known as the Plumbing Code of the City of Friendswood, Texas, hereinafter sometimes referred to as "this code." Section 106.6.2. Section 106.6.2 is hereby amended to read as follows• 106.6.2 Fee Schedule. The fees for permits reyuired hereunder shall be in accordance with the schedule of fees as established from time to time by the Citv Council, and as more fully set forth in A�pendix D of the Friendswood Cit. Code. Section 106.6.3. Section 106.6.3 is hereby amended to read as follows• 11/13/02 11 106.6.3. Fee Refunds. The code official shall authorize the refundin� of fees where the full amount of any fee paid hereunder was erroneously_paid or collected. Section 109.2. Section 109.2 is hereby amended to read as follows: 109.2 Membership of the Board of Appeals. The board shall be �pointed by the City Council of the City and the qualifications of inembers of the board, and the terms for which such members shall serve, shall be as determined bv the City Council. The City Council may remove any member of the board at any time, with or without cause, re�ardless of whether such member has been appointed for a definite or an indefinite term. Section 305.6.1. Section 305.6.1 is hereby amended to read as follows: 305.6.1. Sewer Depth. Building sewers, which connect to private sewage disposal systems, shall be a minimum of twelve inches (12") below finished grade at the point of septic tank connection. Building sewers shall be a minimum of twelve inches (12") below rg ade. Section 904.1. Section 904.1 is hereby amended to read as follows: 904.1. Roof extension. The 1997 Edition of the Standard Mechanical Code, including appendices except appendix B thereof, as published by the Southern Building Code Congress International, Inc., an authentic copy of which has been filed with the city secretary, is hereby adopted by reference and made a part of this article.] and substituting therefor a new Section 14-256 to provide as follows: Sec. 14-256. International Mechanical Code adopted The 2000 Edition of the International Mechanical Code includin appendices except Appendix B thereof as published by the International Code 11/13/02 12 Council, Inc., an authentic co�y of which has been filed with the city secretary, is hereby adopted by reference and made a part of this article. Section 16. The Code of Ordinances of the City of Friendswood, Texas, is hereby further amended by adding to Article V of Chapter 14 thereof a new Section 14-257 to provide as follows: Sec. 14-257. Amendments. The 2000 Edition of the International Mechanical Code, as adopted in Section 14-256 above, is hereby amended as follows: Section 101.1. Section 101.1 is hereby amended to read as follows: 101.1 Title. These re�ulations shall be known as the Mechanical Code of the City of Friendswood, Texas, hereinafter sometimes referred to as "this code." Section 106.5.2. Section 106.5.2 is hereby amended to read as follows: 106.5.2 Fee Schedule. The fees for �ermits required hereunder shall be in accordance with the schedule of fees as established from time to time b.�� City Council, and as more fully set forth in A�pendix "D" of the Friendswood City Code. International Fuel Gas Code adopted. The 2000 Edition of the International Fuel Gas Code, includin� appendices as published by the International Code Council, Inc., a copy of which has been filed with the city secretary, is hereb.�pted and made a part of this article. Section 18. The Code of Ordinances of the City of Friendswood, Texas, is hereby further amended by adding to Article VI of Chapter 14 thereof a new Section 14-282 to provide as follows: Sec. 14-282. Amendments. The 2000 Edition of the International Fuel Gas Code, as ado�ted in Section 14-281 above, is hereby amended as follows: Section 101.1. Section 101.1 is hereby amended to read as follows: 101.1 Title. These regulations shall be known as the Fuel Gas Code of the City of Friendswood, Texas, hereinafter sometimes referred to as "this code." Section 106.5.2. Section 106.5.2 is hereby amended to read as follows: 106.5.2 Fee Schedule. The fees for permits required hereunder shall be in accordance with the schedule of fees as established from time to time by the City Council, and as more fully set forth in A�pendix D of the Friendswood Cit.y Code• Section 106.S.3. Section 106.5.3 is hereby amended to read as follows• 106.5.3. Fee Refunds. The code official shall authorize the refundin� of fees where the full amount of any fee paid hereunder was erroneouslv aid or collected. Section 109.2. Section 109.2 is hereby amended to read as follows• 11/13/02 14 109.2 Membership of the Board of Appeals. The board shall be appointed by the City Council and the qualifications of inembers of the board, and the terms for which such members shall serve, shall be as determined by the City Council. The City Council may remove any member of the board at anX time, with or without cause, regardless of whether such member has been �pointed for a definite or an indefinite term. Section 19. The Code of Ordinances of the City of Friendswood, Texas, is hereby further amended by adding to Chapter 14 thereof a new Article X to provide as follows: ARTICLE X. MISCELLANEOUS CODES Sec. 14-361. International Ener,�y Conservation Code adopted. The 2000 Edition of the International Energy Conservation Code, as published by the International Code Council, Inc., an authentic copy of which has been filed with the city secretary, is hereby adopted and made part of this article. Sec. 14-362. International Property Maintenance Code adopted. The 2000 Edition of the International Property Maintenance Code as published by the International Code Council, Inc. an authentic copy of which has been filed with the city secretary, is hereby adopted and made a part of this article. Sec. 14-363. International Residential Code for One-and Two-Family Dwellings adopted. The International Residential Code for One-and Two-Family Dwellings 2000 Edition, includin a��pendices as published by the International Code Council, Inc., an authentic copy of which has been filed with the city secretar� is hereby adopted and made a part of this article. Section 20. The Code of Ordinances of the City of Friendswood, Texas, is hereby fizrther amended by deleting from Article III of Chapter 30 thereof all of Section 30-61, which provides as follows: [Sec. 30-61. Adopted. The city council hereby adopts the 1997 Edition of the Standard Fire Prevention Code, including appendices, as published by the Southern Building Code Congress International, Inc.] and substituting therefor a new Section 30-61 to provide as follows: 11/13/02 15 Sec. 30-61. International Fire Code adopted. The International Fire Code, 2000 Edition, including appendices, as published by the International Code Council, Inc., an authentic co�y of which has been filed with the city secretary, is hereby adopted and made a part of this Ordinance, except as follows: (a) Section 101.1 is hereby amended to read as follows: 101.1 Title. These regulations shall be known as the Fire Code of the City of Friendswood, Texas, hereinafter sometimes referred to as "this code." (b) Section 102.6 is hereby amended to read as follows: 102.6 Referenced Codes and Standards. The codes and standards referenced in this code shall be those that are listed in Chapter 14 hereof, and such codes and standards shall be considered part of the requirements of this code to the prescribed extent of each such reference. Where differences occur between the provisions of this code and the referenced standards, the provisions of the most restrictive shall ap�ly. Whenever amendments have been adopted to the referenced codes and standards, each reference to said code and standard shall be considered to reference the amendments as well. (c) Section 108 is hereby amended to read as follows: 108. Board of A�peals. The City of Friendswood Zoning Board of Adjustment and Ap�eals shall act as the Fire and Life Safety Code Board of Adjustments and A�peals. (d) Section 109.3 is hereby deleted in its entiretx. (e) Section 508.5.1 is hereby amended to read as follows: 505.5.1 Where Required. Where a portion of the facility or buildin� hereafter constructed or moved into or within the jurisdiction is more than three hundred feet (300) from a hydrant on a fire anparatus access road as measured by an approved route around the exterior of the facility or building on-site �re hydrants and mains shall be provided where required by the code official. (fl Section 903.2.8 is hereby amended to read as follows• 11/13/02 16 903.2.8. Group R-2. An automatic s�rinkler system shall be provided throughout all buildings with a Group R-2 fire area of two stories or more in height, including basements, or where having more than 8 dwelling unit• Section 21. The Code of Ordinances of the City of Friendswood, Texas, is hereby further amended by deleting from Article III of Chapter 30 thereof all of Section 30-76, which provides as follows: [Sec. 30-76. Adopted. The 1997 Edition of the Life Safety Code, including all appendices thereto, as published by the National Fire Protection Association, Inc., is hereby adopted. An authentic copy of such code is on file with the city secretary.] and substituting therefor a new Section 30-76 to provide as follows: Sec. 30-76. Life Safety Code adopted. The 2000 Edition of the Life Safety Code including all a�endices thereto, as published by the National Fire Protection Association Inc. an authentic copv of which has been filed with the city secretary is hereby adopted and made a part of this Ordinance, except as follows: Section 22. The Code of Ordinances of the City of Friendswood, Texas, is hereby further amended by deleting from Article II of Chapter 74 thereof all of Section 74-53, which provides as follows: [Sec. 74-53. Markings. (a) Signs. (1) The owner, manager or person in charge of any building to which fire lanes have been approved by the fire marshal or his authorized representative shall post and maintain appropriate signs in conspicuous places along such fire lanes stating: "No Parking--Fire Lane." Such signs shall be 12 inches wide and 18 inches high, with a companion sign 12 inches wide and six inches high stating: "Tow-Away Zone. (2) Any "No Parking--Fire Lane" or "Tow-Away Zone" sign shall be painted on a white background with symbols, letters and borders in red. Standards for mounting, including but not limited to the 11/13/02 17 height above the grade at which such signs are to be mounted, shall be adopted by the fire marshal. (3) Where the placement of such signs is not applicable or when, in the opinion of the fire marshal or his representative, such signs would cause a burden on the management, curb markings may be used. (b) Curb markings. Any "No Parking--Fire Lane" or °Tow-Away Zone" curb markings shall be painted on a red background with symbols and letters in yellow. Such lettering shall be a minimum of four inches in height. Such lettering shall state: "No Parking--Fire Lane--Tow-Away Zone."] and substituting therefor a new Section 74-53 to provide as follows: Sec. 74-53 Markings. (a) Signs. (1) The owner, mana eg r, or person in charge of any building for which fire lanes have been approved by the fire marshal or his authorized representative, shall post and maintain a�propriate signs in conspicuous places along such fire lanes statin :g "No Parking — Fire Lane." Such signs shall be twelve inches (12") wide and eighteen inches (18") high, with a companion si�n twelve inches (12") wide and six inches (6") hi ng stating: "Tow- Away Zone." (2) Any "No Parking — Fire Lane" or "Tow-Away Zone" si n s�hall_ be painted on a white background with symbols letters and borders in red, using not less than two inch (2") lettering. Si�ns shall be permanently affixed to a stationary post and the bottom of the sign shall be six feet, six inches (6'6") above �nished grade. Signs shall be spaced no more than thirty feet 30') apart Signs may be installed on buildings walls or fences as approved by the fire marshal. (3) Where the placement of such signs is not applicable or when in the opinion of the fire marshal or his representative such si�ns would cause a burden on the management curb markings or stripin may be used. (b) Curb Markings/Striping. Any "No Parking — Fire Lane" or "Tow-Away Zone" curb markings or striping shall be painted on a red 11/13/02 18 background, with symbols and letters in white. Such lettering shall be a minimum of four inches (4") in height at thirty-foot (30') intervals on the red background markin�s alon� both sides of the fire lanes. Such lettering shall state: "No Parking — Fire Lane — Tow-Away Zone." Fire lanes marked on pavement surfaces shall be marked by lines of red traffic paint twelve inches (12") in width to show the boundaries of the lane. Where a curb is available, the striping shall be in the vertical face of the curb. Section 23. Any person who shall violate any provision of this Ordinance, or any provision contained in any code adopted hereby, shall be deemed guilty of a misdemeanor and, upon conviction, shall be fined in an amount not to exceed $2000. Each day of violation of any such provision shall constitute a separate offense. Section 24. All ordinances or parts of ordinances inconsistent or in conflict herewith are, to the extent of such inconsistency or conflict, hereby repealed. Section 25. In the event any clause phrase, provision, sentence, or part of this Ordinance or the application of the same to any person or circumstances shall for any reason be adjudged invalid or held unconstitutional by a court of competent jurisdiction, it shall not affect, impair, or invalidate this Ordinance as a whole or any part or provision hereof other than the part declared to be invalid or unconstitutional; and the City Council of the City of Friendswood, declares that it would have passed each and every part of the same notwithstanding the omission of any such part thus declared to be invalid or unconstitutional, whether there be one or more parts.
