ORDINANCE NO. 2012-25
AN ORDINANCE AMENDING APPENDIX D OF THE
CODE OF ORDINANCES OF THE CITY OF
FRIENDSWOOD, TEXAS, BY PROVIDING FOR THE
ADJUSTMENT TO VARIOUS PROCESS AND PERMIT
FEES.
WHEREAS, Appendix D of the Code of Ordinances of the City of Friendswood, Texas
establishes certain fees for various processes and permits to be issued by the City; and
WHEREAS, the City of Friendswood has initiated the process for reviewing and
updating Appendix B, Section IV of the Code of Ordinances pertaining to subdivisio
development and providing for dedication of parkland and related matters, and in furtherance of

such review and update has completed an individualized determination of the assessment of fees
in lieu of parkland dedication pursuant to the attached Exhibit A," which determination has
produced the calculation of a per-dwelling unit fee which is roughly proportional to the increased
demands imposed upon the City through development to furnish parks and open space areas tc
meet the recreational needs of its current and future residents; and
WHEREAS, in order to properly codify the per-dwelling unit fee to be imposed upor�
persons required to dedicate parkland to the City, the City Council deems it necessary to revrs l
the City's fee schedule as set forth in this ordinance.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
FRIENDSWOOD, STATE OF TEXAS:
Section 1. City of Friendswood, Texas, Ordinance No. 88-21, as amended, originally
adopted the 20s' day of March, 1989, the same being Appendix D of the Friendswood City Code,
and also being the fee schedule ordinance of the City, is hereby amended to include as follows:
"SCHEDULE OF FEES
Appendix B. Subdivisions

Per-dwelling unit dedication fee $600.00
Section 2. In the event any section, paragraph, subdivision, clause, phrase, provision,
sentence, or part of this Ordinance or the application of the same to any person or circumstance,
shall for any reason be adjudged invalid or held unconstitutional by a court of competent'
jurisdiction, it shall not affect, impair, or invalidate this Ordinance as a whole or any part or,
provision hereof other any part or provision hereof other than the part declared to be invalid or'
unconstitutional; and the City Council of the City of Friendswood, Texas, declares that it would

have passed each and every part of the same notwithstanding the omission of any and every part
of the same notwithstanding the omission of any such part thus declared to be invalid or
unconstitutional, or whether there be one or more parts.
PASSED AND APPROVED on first reading this l't day of October ,2012.
PASSED, APPROVED, and ADOPTED on second and final reading this 5th day of
November,2012.
