ORDINANCE NO. 2012-33
AN ORDINANCE AMENDING CITY OF FRIENDSWOOD, TEXAS,
ORDINANCE NO. 2011-31, PASSED AND APPROVED OCTOBER 3,
2011, SAME BEING AN ORDINANCE APPROVING AND ADOPTING
THE CITY'S GENERAL BUDGET FOR FISCAL YEAR 2011-2012 BY
APPROVING "BUDGET AMENDMENT XIH" TO THE "ORIGINAL
GENERAL BUDGET OF THE CITY OF FRIENDSWOOD, TEXAS, FOR
THE FISCAL YEAR 2011-2012"; PROVIDING FOR SUPPLEMENTAL
APPROPRIATION AND/OR TRANSFER OF CERTAIN FUNDS;
PROVIDING FOR SEVERABILITY; AND PROVIDING OTHER
MATTERS RELATED TO THE SUBJECT.

WHEREAS, by Ordinance No. 2011-31, the City Council of the City of Friendswood;
Texas, adopted its "Original General Budget for Fiscal Year 2011-2012'; and
WHEREAS, the City Council has determined that revenues and/or reserves are available
for supplemental appropriation, and/or that the transfer of certain funds interdepartmentally is
economically feasible and in the best interest of prudent budgeting and for municipal purposes;
and
WHEREAS, Section 8.04 of The City Charter provides for amendments after adoption
of the budget; and
WHEREAS, the City Council desires to amend said Original General Budget to refleit
such supplemental appropriation and/or transfer in the fiscal year 2011-2012; now, therefore,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FRIENDSWOOD,
STATE OF TEXAS:

Section 1. The facts and matters set forth in the preamble of this Ordinance are
hereby found to be true and correct.
Section 2. The "Original General Budget of the City of Friendswood, Texas, for the
Fiscal Year 2011-2012," is hereby amended for municipal purposes as shown on "Budget
Amendment XIII"to the "Original Budget of the City of Friendswood, Texas, for the Fiscal year
2011-2012" attached hereto. Said Budget Amendment XIII shall be attached to and made a part
of such Original General Budget by the City Secretary and shall be filed as required by state law;
a true and correct copy of which is attached hereto as Exhibits "A" and `B" and made a part
hereof for all purposes.
Section 3. In the event any clause, phrase, provision, sentence, or part of this ordinance
or the application of the same to any person or circumstance shall for any reason be adjudged
invalid or held unconstitutional by a court of competent jurisdiction, it shall not affect, impair, or
invalidate this ordinance as a whole or any part or provision hereof other than the part declared to be
invalid or unconstitutional; and the City Council of the City of Friendswood, Texas, declares that it
would have passed each and every part of the same notwithstanding the omission of any such part
thus declared to be invalid or unconstitutional,whether there be one or more parts.

Budget Amendment Summary
Fiscal Year 2011 — 2012
Budget Amendment XIII
November 5, 2012
1. City of Pearland Household Hazardous Waste Agreement, $2,740.
Appropriate funds to pay for the collection of household hazardous waste. From
August 25, 2012 to September 30, 2012 over 3,424 pounds of waste materials
has been processed by the City of Pearland. As discussed with Council during
an FY13 budget work session, additional funds are needed to cover this expense
which exceeds the FY 2011-12 budget. At the October 1, 2012 City Council
meeting, Council terminated the contract to end on September 30, 2012. An
appropriation of funds is needed from undesignated General Fund balance to
pay the current invoice.
2. Library Renovation/Expansion, $377. Appropriate funds from the Library
operating budget for additional costs related to the pre-design library renovations,
expenses. The library expansion project's initial pre-design expense was
- $14,500. There are additional expenses related to the pre-design project totaling
$377. Council approved the pre-design service agreement with Hall Barnum
Lucchesi Architects at the January 9, 2012 Council meeting.
3. Criminal Justice Grant Reimbursement, $47,486. Funds were received from
the Edward Byrne Memorial Justice Assistance Program Grant to reimburse the
City for expenditures related to the equipment and accessories purchased to
retrofit a Police Department Law Enforcement Vehicle. On October 3, 2011, the
City Council approved advanced funds for the retrofit project. The approval of
the appropriation was made in FY11 Budget Amendment XIV.
4. Police Investigation Fund Revenue, $3,192. Appropriate state asset forfeiture
funds received by the City from the Harris County District Attorney's Office.
Funds will be appropriated to the Police Investigation Fund (PIF) operating
services account.
5. Police Department Animal Control, $4,503. Appropriate funds received from
the increase in animal adoption fees. The FY12 budget included revenues based
on adoption fees of$25 per animal. However, in December 2011, the animal
control adoption fees were increased to $85 for cats and $100 for dogs. The
change in fees from the revenue collected in the amount of$4,503 will be i
appropriated to Animal Control operating budget for adoption related services.

6. Police Department Animal Control Donations. $20. Appropriate funds
donated to the Police Department Animal Control division. The donation was
received from DJ Wall for $20. The funds will be appropriated to the Animal
Control operating budget.
7. Police Department Investigation Fund Revenue. $4,617. Appropriate funds
received from FBI and Houston HIDTA to the Police Department Criminal
Investigation division. The City has a Memorandum of Understanding with both
agencies for reimbursement of personnel overtime spent on Drug Task Force
activities. The reimbursement from the FBI is $2,589 for the activities from June
2012 through August 2012. The reimbursement from HIDTA is $1,928 for
activities in July 2012. The funds will be appropriated to the Police Department
Criminal Investigations Division personnel overtime account.
8. 2010 Bulletproof Vest Partnership Grant Funds. $4,222. Appropriate grant
funds received from the Bureau of Justice for reimbursement of expenditures
incurred by the City to provide bulletproof vests for police officers. The FY10
grant was awarded on October 10, 2010. The grant funding allows the Police
Department to purchase National Institute of Justice (NIJ) compliant armored
vests within a two-year period starting on April 1, 2010 to August 31, 2012. The
- grant reimburses 50% of each vest purchased up to a total award amount of
$5,212. The bulletproof vests have a 5-year replacement schedule and eleven
vests were scheduled to be replaced during this grant period.
9. Community Service Senior Program Bus. $67,312. Funds were received from
the Public Transportation Division of the Texas Department of Transportation
(TxDOT) 5310 program to reimburse the City for expenditures related to the
purchase of a transportation vehicle for the elderly and persons with disabilities.
On February 28, 2011, the City Council approved advanced funds for the
purchase of the Bus. The funds were received in June 2012,
