All persons wishing to be heard during such hearings were given an opportunity to do so; and WHEREAS, such 61.53 acre tract of land, more or less, is contiguous to and adjoins the corporate boundary line of the City; and WHEREAS, such 61.53 acre tract of land, more or less, is uninhabited; and , WHEREAS, such 61,53 acre tract of land, more or less, was the subject of a land exchange agreement between the City of Friendswood and the City of League City; and WHEREAS, pursuant to the land exchange agreement, the City of Friendswood agreed to release such 61.53 acre tract of land, more or less, and the City's extraterritorial jurisdictional rights therein, to the Ciry of League City in exchange far the City of League City releasing a certain 58.70 acre tract of land, more or less, and its extraterritorial jurisdic�ional rights therein, to the City of Friendswood; and WHEREAS, the City Council of the City of Friendswood, Texas, hereby fmds and determines that the disannexation or discontinuance of such territory from the City is necessary and appropriate; now therefore BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FRIENDSWOOD, STATE OF TEXAS: ORD.2002-23 Certinn 1, The facts and matters set forth in the preamble of this Ordinance are hereby found to be true and correct. S�ectio�2. The below described 61.53 acre tract of land, more or less, is hereby disannexed and discontinued from the corporate limits of the City of Friendswood, Texas. Said 61.53 acre tract of land, more or less, hereby disannexed and discontinued from the City of Friendswood, Texas, is more particularly described by metes and bounds in Exhibit A attached hereto and for all things made a part hereof. Sectinn_�. In the event any clause, phrase, provision, sentence, or part of this Ordinance or the application of the same to any person or circumstances shall for any reason be adjudged invalid or held unconstitutional by a court of competent jurisdiction, it shall not affect, impair, or invalidate this Ordinance as a whole or any part or provision hereof other than the part declared to be invalid or unconstitutional; and the City Council of the City of Friendswood, Texas, declares that it would have passed each and every part of the same notwithstanding the omission of any such part thus declared to be invalid or unconstitutional, whether there be one or more parts.
