ORDINANCE NO. 2002-24
AN ORDINANCE OF THE CITY OF FRIENDSWOOD, TEXAS,
AMENDING ORDINANCE NO. 84-15, AS AMENDED, SAME BEING
THE ZONING ORDINANCE OF THE CITY, BY ESTABLISHING THE
ZONING CLASSIFICATION OF A CERTAIN 58.70 ACRE TRACT OF
LAND, MORE OR LESS, LOCATED OFF FM 528; IMPOSING CERTAIN
CONDITIONS; PROVIDING A PENALTY OF AN AMOUNT NOT TO
EXCEED $2,000 FOR EACH DAY OF VIOLATION OF ANY PROVISION
HEREOF; AND PROVIDING FOR SEVERABILITY.

WHEREAS, the Planning and Zoning Commission and the City Council have conducted
hearings to consider the zoning classification for a certain 58.70 acre tract of land located off FM
528, currently subject to annexation proceedings by the City; and
WHEREAS, such hearings were duly called as provided by law and the zoning ordinance
of the City, and during such hearings all persons desiring to be heard regarding the proposed
zoning classification were given an opportunity to do so; and
WHEREAS, the Planning and Zoning Commission has recommended that such land
under consideration be given the zoning classification of Community Shopping Center (CSC)
and Business Park (BP) as set forth herein; and
WHEREAS, as a result of the said public hearings and the recommendation from the
Planning and Zoning Commission, the City Council finds that such proposed classifications are
in conformance with the Long Range Land Use Plan and the comprehensive zoning ordinance;
now, therefore,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FRIENDSWOOD,
STATE OF TEXAS:
Section 1. City of Friendswood, Texas, Ordinance No. 84-15, as amended, originally
passed and approved November 19, 1984, and being the zoning ardinance of the City, is hereby
amended by designating that certain 58.70 acre tract of land, more or less, located off FM 528,
more particularly described on Exhibit "A" attached hereto and incorporated herein as if set forth
at length, to carry the zoning classifications as follows:
1. Approximately sixteen (16) acres constituting the first 750 feet off FM 528
to bear the zoning classification "Community Shopping Center (CSC)";
and
2. The remainder of the 58.70 acre tract of land to bear the zoning
classification"Business Park(BP)."
Section 2. The official zoning map of the City shall be revised to reflect the zoning
classifications granted hereby.
Section 3. This Ordinance shall in no way reduce, amend, supplement, or change any
provision of any ordinance of the City of Friendswood, other than to accomplish the zoning
designations described herein.
Section 4. Any person who sha11 violate any provision of this Ordinance shall be
deemed guilty of a misdemeanor and, upon conviction, shall be fined in an amount not to exceed
$2,000. Each day of violation shall constitute a separate offense.
Section 5. In the event any clause phrase, provision, sentence, or part of this Ordinance
or the application of the same to any person or circumstances shall for any reason be adjudged
invalid or held unconstitutional by a court of competent jurisdiction, it shall not affect, impair, or
invalidate this Ordinance as a whole or any part or provision hereof other than the part declared to
be invalid or unconstitutional; and the City Council of the City of Friendswood, Texas, declares that

it would have passed each and every part of the same notwithstanding the omission of any such part
thus declared to be invalid or unconstitutional,whether there be one or more parts.
