ORDINANCE NO. 2012-21 AN ORDINANCE AMENDING CITY OF FRIENDSWOOD, TEXAS, ORDINANCE NO. 2011-31, PASSED AND APPROVED OCTOBER 3, 2011, SAME BEING AN ORDINANCE APPROVING AND ADOPTING THE CITY'S GENERAL BUDGET FOR FISCAL YEAR 2011-2012 BY APPROVING "BUDGET AMENDMENT X" TO THE "ORIGINAL GENERAL BUDGET OF THE CITY OF FRIENDSWOOD, TEXAS, FOR THE FISCAL YEAR 2011- 2012"; PROVIDING FOR SUPPLEMENTAL APPROPRIATION AND/OR TRANSFER OF CERTAIN FUNDS; PROVIDING FOR SEVERABILITY; AND PROVIDING OTHER MATTERS RELATED TO THE SUBJECT. WHEREAS, by Ordinance No. 2011-31, the City Council of the City of Friendswood, Texas, adopted its "Original General Budget for Fiscal Year 2011-2012"; and WHEREAS, the City Council has determined that revenues and/or reserves are available' for supplemental appropriation, and/or that the transfer of certain funds interdepartmentally is economically feasible and in the best interest of prudent budgeting and for municipal purposes; and WHEREAS, Section 8.04 of The City Charter provides for amendments after adoption of the budget; and WHEREAS, the City Council desires to amend said Original General Budget to reflect such supplemental appropriation and/or transfer in the fiscal year 2011-2012; now, therefore, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FRIENDSWOOD, STATE OF TEXAS: Section 1. The facts and matters set forth in the preamble of this Ordinance arej hereby found to be true and correct. Section 2. The "Original General Budget of the City of Friendswood, Texas, for the Fiscal Year 2011-2012," is hereby amended for municipal purposes as shown on "Budget Amendment X" to the "Original Budget of the City of Friendswood, Texas, for the Fiscal year 2011-2012" attached hereto. Said Budget Amendment X shall be attached to and made a part of such Original General Budget by the City Secretary and shall be filed as required by state law, a� true and correct copy of which is attached hereto as Exhibits "A" and "B" and made a part hereof' for all purposes. Section 3. In the event any clause, phrase, provision, sentence, or part of this ordinance or the application of the same to any person or circumstance shall for any reason be adjudged invalid or held unconstitutional by a court of competent jurisdiction, it shall not affect, impair, or ( invalidate this ordinance as a whole or any part or provision hereof other than the part declared to be{ invalid or unconstitutional; and the City Council of the City of Friendswood, Texas, declares that it would have passed each and every part of the same notwithstanding the omission of any such part, thus declared to be invalid or unconstitutional,whether there be one or more parts. Police Department Animal Control Donations, $20, Appropriate funds donated to the Police Department Animal Control division. The donation was received on July 18, 2012. As designated by the donor, the funds will be used for animal control medical expense. 2. Police Department Animal Control. $7,292. Appropriate funds received from the increase in animal adoption fees. The FY12 budget included revenues based on adoption fees of$25 per animal. However, in December 2011, the animal control adoption fees were increased to $85 for cats and $100 for dogs. The change in fees from the revenue collected in the amount of$7,292 will be appropriated to Animal Control operating budget for adoption related services. 3. Administrative Services Municipal Court. $16,000. Appropriate funds from the Court Technology fund to provide audio/video equipment in the Municipal Court Room and lobby. The equipment includes two (2) LED screens in the Court Room and one (1) LED screen in the lobby to display information relevant to court proceedings and informational videos prior to Court sessions. The cost includes equipment and installation. 4. Police Department Patrol Division, $10,000. Appropriate donation of$3,000 from Friendswood Police Officer's Association and $7,000 from the Police Investigation Fund. The funds will be used to purchase a new dog for the K-9 unit. The City's current K-9, Chico, will be retiring from service. 5. Community Services July 4th Program Division, $2,253. Appropriate donations from the sale of wristbands at the July 4 event to program operating supplies. 6. Police Department, Patrol Division, $866. Appropriate insurance reimbursement from TML IRP for insurance claim to Patrol Unit P266. Funds will be used to offset repair costs. 7. Police Investigation Fund Revenue, $1,891. Appropriate state asset forfeiture funds received by the City from the Harris County District Attorney's Office. Funds will be appropriated to the Police Investigation Fund (PIF) operating supplies account and operating services account. FYOrd 2012-21 Exhibit A Exhibit A Page 2 8. Public Works Customer Service Division. $4,200. Appropriate funds from water and sewer working capital to water and sewer customer service to cover the cost of the contract extension with South West Water Company through December 31, 2012. Council authorized the extension on July 2, 2012. 9. Soundproofing at Public Safety Building, $1,600. Transfer funds from the Fire Marshal budget to Community Services Facility Operations — Public Safety. The funds will be used to install a sheet rock wall from the top of the current gym wall to the roof deck, insulation will be installed on top of the current ceiling tiles and sound deflectors will be installed above the return air vents in the Fire Marshal's Offices. Because of the open air return air system in the PSB, increased utilization of the gym and its proximity to the Fire Marshal office this need has been prompted.
