ORDINANCE NO.2012-20 AN ORDINANCE REPEALING SECTION 14-421 OF THE CODE OF ORDINANCES OF THE CITY OF FRIENDSWOOD, TEXAS ADOPTING THE INTERNATIONAL PROPERTY MAINTENANCE CODE; ! AND PROVIDING FOR SEVERABILITY. WHEREAS, the City of Friendswood, Texas has adopted numerous building regulation codes as promulgated by the International Code Council, Inc., which codes include standardized regulations pertaining to, among other things, plumbing, electrical, mechanical and various other services to be performed in connection with structures located within the City; and WHEREAS, among the standardized codes previously adopted by the City is the 2009 Edition of the International Property Maintenance Code ("IPMC") which provides guidelines and requirements for the continued use and maintenance of plumbing, mechanical, electrical and fire protection systems in existing residential and nonresidential structures; and WHEREAS, on June 4, 2012 City Council and City Staff conducted a work session to discuss the merits of the continued adoption of the IPMC, at which time it was determined that adherence to the requirements of the IPMC presented significant budgetary concerns as it relates to the City's current code enforcement processes; and WHEREAS, on the basis of such discussions the City Council deems it appropriate that the provisions of the IPMC should be repealed from the City's Code of Ordinances; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FRIENDSWOOD, STATE OF TEXAS: Section 1. The facts and matters set forth in the preamble of this Ordinance are hereby found to be true and correct. Section 2. Section 14-421 of the Code of Ordinances of the City of Friendswood, Texas is hereby repealed. Section 3. In the event any section, paragraph, subdivision, clause, phrase, provision, sentence, or part of this Ordinance or the application of the same to any person or circumstance shall for any reason be adjudged invalid or held unconstitutional by a court of competent jurisdiction, it shall not affect, impair, or invalidate this Ordinance as a whole or any part or provision hereof other than the part declared to be invalid or unconstitutional; and the City Council of the City of Friendswood, Texas declares that it would have passed each and every part of the same notwithstanding the omission of any and every part of the same notwithstanding the omission of any such part thus declared to be invalid or unconstitutional, or whether there be one or more parts.
