ORDINANCE NO. 2003-10 AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE CITY OF FRIENDSWOOD, TEXAS, BY DELETING SECTION 10-56 THEREOF AND SUBSTITUTING THEREFOR A NEW SECTION 10-56 REQUIRING LICENSING OF DOGS AND CATS WITHIN THE CITY ANNUALLY, INITIALLY WITHIN SEVEN DAYS FOLLOWING THE ISSUANCE OF A VACCINATION CERTIFICATE; BY DELETING SECTION 10-59 THEREOF AND SUBSTITUTING THEREFOR A NEW SECTION 10-59 STATING THAT THE LICENSE YEAR SHALL BEGIN ON THE DATE THE VACCINATION CERTIFICATE WAS ISSUED; BY DELETING SECTION 10-71 THEREOF AND SUBSTITUTING THEREFOR A NEW SECTION 10-71 REQUIRING A RABIES VACCINATION BOOSTER WITHIN ONE (1) YEAR OF THE INITIAL VACCINATION FOR EACH DOG OR CAT WITHIN THE CITY VACCINATED AGAINST RABIES BY FOUR (4) MONTHS OF AGE, AND REQUIRING EACH DOG OR CAT WITHIN THE CITY TO BE GIVEN A RABIES VACCINATION AT LEAST ONCE EVERY THREE (3) YEARS; PROVIDING A PENALTY OF AN AMOUNT NOT TO EXCEED $2,000 FOR EACH DAY OF VIOLATION OF ANY PROVISION HEREOF; PROVIDING FOR SEVERABILITY; AND REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES INCONSISTENT HEREWITH. � � � � � � * � � BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FRIENDSWOOD, STATE OF TEXAS: Section 1. The Code of Ordinances of the City of Friendswood, Texas is hereby amended by deleting Section 10-56 thereof and substituting therefar a new Section 10-56 to provide as follows: "[Sec. 10-56. Required. Every person owning, harboring, or having in his or her possession any dog or cat is hereby required to obtain from the licensing autharity an annual license for each such dog or cat, which must be obtained within seven days following the annual rabies vaccination required herein. It shall be unlawful for any person to own, harbor, or have in his or her possession within the city a dog or cat for which a current valid license has not been obtained as provided herein.]" "Sec. 10-56. Required. Everyperson owning, harborin�, or having in his or her possession any dog or cat is hereb ��required to obtain from the licensing authoritv an a annual license for each such dog or cat, which must initially be obtained within seven days followin� the rabies vaccination required herein, and annuallv thereafter. It shall be unlawful for an�person to own, harbor, or have in his or her �ossession within the citv a dog or cat for which a current valid license has not been obtained as provided herein." Section 2. The Code of Ordinances of the City of Friendswood, Texas is hereby amended by deleting Section 10-59 thereof and substituting therefor a new Section 10-59 to provide as follows: ["Sec. 10-59. Valid Period. Such license and registration required by section 10-56 and 10- 96(i) hereof shall be valid for a period not to exceed one year, and shall coincide with the beginning and expiration dates of the rabies vaccination certificate."] "Sec. 10-59. Valid Period. Such license and registration required bv section 10-56 and 10- 96(i) hereof shall be valid for a period not to exceed one vear, be ig nning on the month and dav the rabies vaccination certificate was issued." Section 3. The Code of Ordinances of the City of Friendswood, Texas, is hereby amended by deleting Section 10-71 thereof and substituting therefor a new Section 10-71 to provide as follows: ["Sec. 10-71. Vaccination required. Each person owning, harboring, or having in his or her possession a dog or cat shall have such animal vaccinated against rabies, by the time such is animal is four months of age, by means of an anti-rabies vaccine approved by the TDH, and administered by a duly licensed veterinarian. Such immunization shall be administered annually and no animal over 2 four months of age shall be brought into the city, unless such vaccine has been administered."] "Sec. 10-71. Vaccination required. Each person ownin�, harboring, or having in his or her possession a dog or cat shall have such animal vaccinated against rabies, by the time such is animal is four months of age, bv means of an anti-rabies vaccine approved b�the TDH, and administered by a duly licensed veterinarian. Each person ownin�, harboring, or having in his or her possession a do�or cat that has been vaccinated a�ainst rabies bv the age of four months shall have the animal given a rabies booster within the twelve (12 month interval following the initial vaccination, bv means of an anti-rabies booster approved bv the TDH, and administered bv a duly licensed veterinarian. Each person ownin�, harborin�, or having in his or her possession a dog or cat shall have such animal revaccinated a�ainst rabies at a minimum of at least once ever� three years with a rabies vaccine licensed by the United States Department of Agriculture. The vaccine must be administered bv a dulv licensed veterinarian in accordance with label recommendations." Section 4. Any person who shall violate any provision of this Ordinance shall be deemed guilty of a misdemeanor and, upon conviction, shall be fined in an amount not to exceed $2,000. Each day of violation shall constitute a separate offense. Section 5. All ordinances or parts of ordinances inconsistent or in conflict herewith are,to the extent of such inconsistency or conflict, hereby repealed. Section 6. In the event any clause phrase, provision, sentence, or part of this Ordinance or the application of the same to any person or circumstances shall for any reason be adjudged invalid or held unconstitutional by a court of competent jurisdiction, it shall not affect, impair, or invalidate this Ordinance as a whole or any part or provision hereof other than the part declared to be invalid or unconstitutional; and the City Council of the City of Friendswood, Texas, declares that it would have passed each and every part of the same notwithstanding the omission of any such part thus declared to be invalid or unconstitutional,whether there be one or more parts. 3 PASSED AND APPROVED on first reading this 7t" day of July, 2003.
