R2012-15 A RESOLUTION OF THE CITY OF FRIENDSWOOD APPROVING COOPERATION WITH THE GULF COAST COALITION OF CITIES TO REVIEW CENTERPOINT ENERGY HOUSTON ELECTRIC, LLC'S REQUESTED APPROVAL OF AN ADNSTMENT TO ITS ENERGY EFFICIENCY COST RECOVERY FACTOR; HIRING LEGAL AND CONSULTING SERVICES TO NEGOTIATE WITH THE COMPANY AND DIR�CT ANY NECESSARY LITIGATION AND APPEALS; FINDING THAT THE M��TING AT WHICH THIS RESOLUTION IS PAS5ED IS OPEN TO THE PUBLIC AS REQUIRED BY LAW; REQUIRING NOTICE OF THIS RESOLUTION TO L�GAL COUNSEL 'i[ X 'iC iG X % X X WHEREAS, on or about May 1, 2012, CenterPoint Energy Houston Electric, LLC ("CenterPoinY' or "Company"), pursuant to PURA § 39.905 and Public Utility Commission of Texas ("Commission" or "PUC") Substantive Rule § 25.181(fl(4), filed with the Commission an application for a 2013 Energy Efficiency Cost Recovery Factor, PUC Docket No. 40356; and WHEREAS, the City of Friendswood will cooperate with similaxly situated city members and other city participants located within the CenterPoint service area in conducting a �I review of the Company's application and to hire and direct legal counsel and consultants and to II prepare a common response and to negotiate with the Company and direct any necessary ' litigation; and ' WHEREAS, working with the Gulf Coast Coalition of Cities ("GCCC") to review the rates charged by CenterPoint allows members to accomplish more collectively than each city ' could do acting alone; and WHEREAS, GCCC has a history of participation in PUC dockets and projects, as well as cou��t proceedings, affecting transmission and distribution utility rates in CenterPoinYs service area to protect the interests of municipalities and electric customers residing within municipal boundaries; and WHEREAS, PURA § 33.023 provides that costs incuiz•ed by cities in ratemaking activities are to be reimbursed by the regulated utility. THEREFOR�, BE IT RESOLVED BY THE CITY COUNCIL OP THE CITY OF FRIENDSWOOD, TEXAS: Section 1. That the City is authorized to pai�ticipate with the GCCC in Docket No. 40356. Section 2. That subject to the right to teirninate employment at any time, the City of Friendswood hereby authorizes the hiring of the law fiim of Lloyd Gosselink and consultants to negotiate with the Company, make recommendations to the City regarding reasonable rates and to direct any necessary administrative proceedings or coui�t litigation associated with an appeal of this application filed with the PUC. Section 3. That the City's reasonable rate case expenses shall be reimbursed by CenterPoint. Under no circumstances shall the City of Friendswood be responsible to Lloyd Gosselink Rochelle and Townsend, P.C., or consultants hired by Lloyd Gosselink Rochelle and 'il Townsend, P.C., for any expenses resulting from this case. , Section 4. That it is hereby officially found and deteimined that the meeting at which � this Resolution is passed is open to the public as required by law and the public notice of the �I time,place, and purpose of said meeting was given as required. i, Section 5.
