ORDINANCE NO. 2003-13
AN ORDINANCE OF THE CITY OF FRIENDSWOOD, TEXAS,
AMENDING ORDINANCE NO. 84-15 (THE "ZONING ORDINANCE" OF
THE CITI�, AND ORDINANCES NO. 86-6 AND 98-10 (SPECIFIC USE
PERMIT ORDINANCES FOR RELIGIOUS ORGANIZATIONAL
PURPOSES TO GOOD SHEPHERD EPISCOPAL CHURCH), BY
GRANTING TO GOOD SHEPHERD EPISCOPAL CHURCH A SPECIFIC
USE PERMIT TO ALLOW CONSTRUCTION OF BUILDINGS AND
STRUCTURES, AND USE OF PROPERTY, FOR RELIGIOUS
ORGANIZATIONAL PURPOSES, IN ACCORDANCE WITH A MASTER
PLAN; AUTHORIZING EXPANSION OF THE MAIN SANCTUARY,
CONSTRUCTION OF A FAMILY LIFE CENTER, CONSTRUCTION OF
ADDITIONAL PARKING FACILITIES, INSTALLATION OF
DRAINAGE FACILITIES, AND REMOVAL OF CERTAIN BUILDINGS
AND STRUCTURES; PROVIDING FOR THE AMENDMENT OF THE
OFFICIAL ZONING MAP; PROVIDING A PENALTY IN AN AMOUNT
NOT TO EXCEED $2,000 FOR EACH DAY OF VIOLATION OF ANY
PROVISION HEREOF; AND PROVIDING FOR SEVERABILITY.

WHEREAS, the City Council and Planning and Zoning Commission conducted a joint
public hearing on June 2, 2003, to consider the application of Good Shepherd Episcopal Church
to amend its specific use permit by approving a master plan for complete development of its
4.773 acre tract of land at 1207 Winding Way; and
WHEREAS, the property that is subject to the application is a 4.773 acre tract of land
out of Lot 14, Harvey and Stout Subdivision, Galveston County, Texas, said tract being more
particularly described in Ordinances Nos. 86-6 and 98-10, and which property is known
generally as 1207 Winding Way, Friendswood, Texas; and
WHEREAS, the hearing was duly called as provided by the laws of the State of Texas
and Ordinance No. 84-15 of the City, and at which all persons attending were allowed to be
heard on the question of whether or not the proposed expansion of buildings, structures and uses
on said property would adversely affect public health, safety, morale, convenience, or general
welfare, or whether or not same would violate the rights of any interested person; and
WHEREAS, the Planning and Zoning Commission has filed with the City Secretary its
written recommendation in favor of the application; and
WHEREAS, having heard the evidence presented at the joint public hearing, and having
received the recommendation of the Planning and Zoning Commission, the City Council finds
that the amendment to the specific use permit is not detrimental to the community and is in
conformance with the City's long range plan and comprehensive zoning regulations; now,
therefore,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FRIENDSWOOD,
STATE OF TEXAS:
Section 1. City of Friendswood, Texas, Ordinance No. 84-15, passed and approved
on November 19, 1984, and known as the Zoning Ordinance of the City, and Ordinances No. 86-
6 and 98-10, which ordinances grant to Good Shepherd Episcopal Church specific use permits
for the construction of certain buildings and structures and the conduct of religious
organizational uses on a 4.773 acre tract of land, are hereby amended to allow the construction
and use of buildings, structures and related improvements on such property as shown on that
certain "Master Plan," dated 5-14-03, a copy of which is attached hereto as Exhibit "A" and is
made a part hereof for all purposes. All such facilities and related improvements shall be
constructed on the site in accordance with such Master Plan unless amended as provided for by
the Zoning Ordinance.

Section 2. The official zoning map of the City shall be revised to show the above-
described property rezoned to "SPECIFIC USE—RELIGIOUS ORGANIZATIONAL
PURPOSES."
Section 3. This Ordinance shall in no way reduce, amend, supplement, or change any
provision of any ordinance of the City of Friendswood, other than to accomplish the rezoning of
the tract described in Section 1 to SPECIFIC USE — RELIGIOUS ORGANIZATIONAL
PURPOSES."
Section 4. Any person who shall violate any provision of this Ordinance shall be
deemed guilty of a misdemeanor and, upon conviction, shall be fined in an amount not to exceed
$2,000. Each day of violation shall constitute a separate offense.
Section 5. In the event any clause phrase, provision, sentence, or part of this Ordinance
or the application of the same to any person or circumstances shall for any reason be adjudged
invalid or held unconstitutional by a court of competent jurisdiction, it shall not affect, impair, or
invalidate this Ordinance as a whole or any part or provision hereof other than the part declared to
be invalid or unconstitutional; and the City Council of the City of Friendswood, Texas, declares
that it would have passed each and every part of the same notwithstanding the omission of any such
part thus declared to be invalid or unconstitutional, whether there be one or more parts.

Beginning at a found 1" iron pipe marking the north corner of the Final Plat of Taylor

1. Thence S 43° 35' 00" W – 630.00' with the northwesterly line of said Taylor Green
Subdivision to a found 5/8" iron rod ror corner;
2. Thence N 46° 25' 00" W – 330.00' with the northeasterly line of Sterlingwood
according to the plat thereof filed in Plat Record 18, Map No. 95 Galveston County
Map Records to a point for corner from which a found 1/2" iron rod bears N 32° 36'
12" E — 0.59' from said point;
3. Thence N 43° 35' 00" E – 630.00' with the southeasterly line of Pine Shadows
according to the plat thereof filed in Plat record 15, Map No. 24 Galveston County
