�/ A RESOLUTION OF THE CITY COUNCIL OF TI�E CITY
V (1� OF FRIENDSWOOD, TEXAS, DETERMINING THAT LAND
0�� IS NEEDED FOR CONSTRUCTION AND MAINTENANCE
\� OF BLACKHAWK BLVD; ACCEPTING THE DEDICATION
�/ � OF SAID LAND FROM THE GALLOWAY SCHOOL,
� PROPERTY OWNERS.

WHEREAS, the City Council of the City of Friendswood now finds and deteirnines that `�

public convenience and necessity requires the City of Friendswood to acquire property over and
across a tr•act of land containing 1.2603 acre tract of land, partially situated in the Sarah
,�� McKissick Survey, Abstract No. 549, Hairis County, Texas, and partially situated in the John

,�{ Dickinson Survey, Abstract No. 15, Harris County, Texas, and being a poi4ion of Restricted

� Reserve "A" out of Autumn Creek Section 9, a subdivision plat recorded under Film Code No.
�� 497014 of the Map of Records of Han•is County, Texas, a more specific description of said
�
�� 1.2603 acre tract of land is contained in Exhibit "A", Special Wairanty Deed, and made a part
��
4� thereof, (herein after the"Land"); and
�� WIIEREAS, the City of Friendswood, ttuough its duly authorized representative, has
� �
negotiated with the owners of said tract of land for the dedication of such properry for the herein
stated puLpose and has been able to agree with such owners as to the fair market value thereof;now,
therefore, ,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FRIENDSWOOD, !
TEXAS:
Section 1. The facts and matters set foi4h in the preamble of this Resolufion are hereby �I
found to be true and coirect. '
Section 2. The City Council of the City of Friendswood finds that bona fide '
negotiations have been conducted by the authorized representative of the City far the acquisition of ,
the property over the herein described tract of land, and that said negotiations were successful, and
that the acquisition of the property for the negotiated price is approved.
Section 3. The Mayor is authorized to execute any documentation necessaiy to accept,
document,and record said Easement.
PASSED,APPROVED,AND RESOLVED this 25th day of July,2011.

THAT THE GALLOWAY SCHOOL ("Grantor"), for and in consideration of Zero Dollars
($0.00) and other good and valuabie consideration paid in cash to the Grantor by the G�antee
herein named, has GRANTED, BARGAINED, SOLD AND CONVEYED and by these presents
does GRANT, BARGAIN, SELL AND CONVEY unto the CITY OF FRIENDSWOOD, a Home-
Rule Gity of the State of Texas ("Grantee"), ail of the property described as being 1.2603 acre
tract of land, partially situated in the Sarah McKissick Survey, Abstract No. 549, Harris County,
Texas, and partially situated in the John Dickinson Survey, Abstract No. 15, Harris County,
Texas, and being a portion of Restricted Reserve "A" out of Autumn Creek Section 9, a
subdivision plat recorded under Film Code No. 497014 of the Map of Records of Harris County,
Texas (the "Property").
THIS CONVEYANCE IS MADE BY GRANTOR AND ACCEPTED BY GRANTEE subject
to the terms, conditions and provisions hereof and further subject to aIl appiicable easements,
�� conditions, restrictions, covenants, mineral or royalty interests, mineral reservations, surtace
,� waivers, liens, encumbrances, regulations or orders of municipal and/or other governmental
