ORDINANCE NO. 2012-05 AN ORDINANCE AMENDING SECTIONS 14-2 (b) and (c) AND APPENDIX D OF THE CODE OF ORDINANCES OF THE CITY OF FRIENDSWOOD,TEXAS. WHEREAS, on January 9, 2012, the City Council of the City of Friendswood passed and adopted Ordinance No. 2011-38 to provide for certain amendments to Section 14-2(d) and Appendix D of the Code of Ordinances of the City of Friendswood, Texas to establish certaiii fees for various processes and permits to be issued by the City; and 1 WHEREAS, in order to provide for further consistency between Section 14-2 and Appendix D of the Code of Ordinances, the City Council deems it necessary to revise Section 14-2 and Appendix D in order to clarify the applicability of building contractor license fees. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FRIENDSWOOD, STATE OF TEXAS: Section 1. The title of Section 14-2 of the Code of Ordinances of the City of Friendswood, Texas is hereby amended to read as follows: "See. 14-2.—Registration and licensing of providers and repair services." Section 2. Sections 14-2(b)(1) and (c) of the Code of Ordinances of the City of Friendswood,Texas are hereby amended to read as follows: "(b) Definitions. For purposes of this section, the following terms and meanings shall have the meanings ascribed thereto: (1) Building contractor. Any person, firm, partnership, corporation or other entity engaged in, undertaking, or carrying on any business consisting of or related to the demolition, repair, or renovation of any building or structure, including any fixtures attached thereto. The term "building contractor" shall be understood to include any general, electrical, mechanical or plumbing contractor. (c) Registration;filing of application. It shall be unlawful for any building contractors to do business in the City of Friendswood without having first registered with the city and received a building contractors license. Registrants/applicants shall register and file applications with the city manager or his designee at city hall. Such registration/application form shall include the name of the building contractor, the principal office address (not a P.O. box), the name, address, and phone number(s) of an. individual who will be available to respond to questions or complaints, proof of comprehensive general liability insurance with minimum limits of $300,000.00 per occurrence, and such other information as the city manager deems necessary and appropriate for the proper identification and location of such applicant/registrant. Required policies of insurance shall be issued by a carrier duly authorized to write such coverage in Texas, and must also contain a completed operations endorsement. An applicant shall, under oath, provide the city manager with a statement describing the general nature of the business to be conducted and give true and correct information as may be called for on the registration form, application or certificate provided by the city. Contractors who are already registered with the city shall, in addition to payment of the annual fee required under Appendix D, be required to maintain proof of insurance as described herein." Section 3. City of Friendswood, Texas, Ordinance No. 88-21, as amended, originally adopted the 20a' day of March, 1989, the same being Appendix D of the Friendswood City Code,: and also being the fee schedule ordinance of the City, is hereby amended by the deletion noted follows: "SCHEDULE OF FEES Buildings and Building Regulations rlertri..:a..,R Ij e..ge .el Fees. Upon the deletion provided for in Section 3 of this ordinance, all remaining portions of Appendix D, subsection entitled "Building and Building Regulations"; shall be re-numbered to conform to the deletion provided for. Further, by virtue of such re-' numbering, former item No. 9 entitled "General Contractors License" and added through the adoption of Ordinance No. 2011-38 shall now be numbered No. 8 and read as follows: (9) Building Contractors License (one-time fee,then an annual fee of$50.00) $100.00 Section 5. In the event any section, paragraph, subdivision, clause, phrase, provision, sentence, or part of this Ordinance or the application of the same to any person or circumstance shall for any reason be adjudged invalid or held unconstitutional by a court of competent i jurisdiction, it shall not affect, impair, or invalidate this Ordinance as a whole or any part or provision hereof other any part or provision hereof other than the part declared to be invalid or i unconstitutional; and the City Council of the City of Friendswood, Texas, declares that it would! have passed each and every part of the same notwithstanding the omission of any and every part of the same notwithstanding the omission of any such part thus declared to be invalid or unconstitutional, or whether there be one or more parts.
