ORDINANCE NO. 2012-06 AN ORDINANCE AMENDING CITY OF FRIENDSWOOD, TEXAS, ORDINANCE NO. 2011-31, PASSED AND APPROVED OCTOBER 3, 2011, SAME BEING AN ORDINANCE APPROVING AND ADOPTING THE CITY'S GENERAL BUDGET FOR FISCAL YEAR 2011-2012 BY APPROVING `BUDGET AMENDMENT IV" TO THE "ORIGINAL GENERAL BUDGET OF THE CITY OF FRIENDSWOOD, TEXAS, FOR THE FISCAL YEAR 2011- 2012"; PROVIDING FOR SUPPLEMENTAL APPROPRIATION AND/OR TRANSFER OF CERTAIN FUNDS; PROVIDING FOR SEVERABILITY; AND PROVIDING OTHER MATTERS RELATED TO THE SUBJECT. WHEREAS, by Ordinance No. 2011-31, the City Council of the City of Friendswood, Texas, adopted its"Original General Budget for Fiscal Year 2011-2012"; and WHEREAS, the City Council has determined that revenues and/or reserves are available for supplemental appropriation, and/or that the transfer of certain funds interdepartmentally is economically feasible and in the best interest of prudent budgeting and for municipal purposes; and WHEREAS, Section 8.04 of The City Charter provides for amendments after adoption of the budget; and WHEREAS, the City Council desires to amend said Original General Budget to reflect such supplemental appropriation and/or transfer in the fiscal year 2011-2012; now,therefore, E BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FRIENDSWOOD, ' STATE OF TEXAS: Section 1. The facts and matters set forth in the preamble of this Ordinance are hereby found to be true and correct. Section 2. The "Original General Budget of the City of Friendswood, Texas, for the Fiscal Year 2011-2012," is hereby amended for municipal purposes as shown on "Budget Amendment IV" to the "Original Budget of the City of Friendswood, Texas, for the Fiscal year 2011-2012" attached hereto. Said Budget Amendment IV shall be attached to and made a part of such Original General Budget by the City Secretary and shall be filed as required by state law, a true and correct copy of which is attached hereto as Exhibits "A" and"B" and made a part hereof for all purposes. Section 3. In the event any clause, phrase, provision, sentence; or part of this ordinance or the application of the same to any person or circumstance shall for any reason be adjudged invalid or held unconstitutional by a court of competent jurisdiction, it shall not affect, impair, or! invalidate this ordinance as a whole or any part or provision hereof other than the part declared to be invalid or unconstitutional; and the City Council of the City of Friendswood, Texas, declares that it! would have passed each and every part of the same notwithstanding the omission of any such part thus declared to be invalid or unconstitutional,whether there be one or more parts. Police Department Animal Control Donations. $1,304. Appropriate funds donated to the Police Department Animal Control Division. Donations were received from.November 11, 2011 through January 23, 2012. The funds will be used for animal control operating services. 2. Police Department Animal Control, $3,255. Appropriate funds received from the increase in animal adoption fees. The FY12 budget included revenues based on adoption fees of$25.00 per animal. However, in December 2011, the animal control adoption fee was increased to $85.00 for cats and $100.00 for dogs. The change in fees from the revenue collected in the amount of$3,255.00 will be appropriated to Animal Control operating budget for adoption related services. 3. Prior Year Unencumbered Capital, $105,504. Re-appropriate funds for a capital expenditure budgeted, but not expensed in fiscal year 2010-2011. The sewer cleaning and maintenance services were not completed before fiscal year- end September 30, 2011. The re-appropriation of the funding was omitted from the list of unencumbered capital expenditures approved by Council on FY 2011- 2012 budget amendment I. The funding source will be from working capital in the water and sewer fund. 4. Natural Gas Emergency Generators, $8,200, Appropriate funds to the Public Works Sewer Operations division for natural gas utility expenses for fiscal year 2011 - 2012. Funds are needed for the natural gas expense line item to cover the monthly utility expense needed to operate the 29 emergency generators purchased by the City through TDRA grant funding. The adopted budget for fiscal year 2011 —2012 did not include funding for the monthly costs of natural gas.
