R2026-09 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF FRIENDSWOOD, TEXAS, AMENDING CHAPTER 7 "BENEFITS" OF THE CITY OF FRIENDSWOOD PERSONNEL POLICY MANUAL TO AMEND SECTION 7.02 "HOLIDAYS" TO PROVIDE FOR HOLIDAY PAY FOR CERTAIN PART-TIME EMPLOYEES; AND AMENDING THE CITY OF FRIENDSWOOD PERSONNEL POLICY MANUAL TO ADD A NEW SECTION TO BE NUMBERED AND ENTITLED 7.08"PAID TIME OFF FOR ELIGIBLE PART-TIME EMPLOYEES" TO PROVIDE FOR PAID TIME OFF FOR SUCH EMPLOYEES; RENUMBERING THE REMAINING SECTIONS OF SUCH CHAPTER; INCLUDING A SEVERABILITY CLAUSE; AND PROVIDING AN EFFECTIVE FOR C DATE. WHEREAS, on August 7, 2023, the City Council adopted an updated Personnel Policy Manual; and WHEREAS,the City desires to amend such manual in order to provide for holiday leave and paid time off for certain part-time employees;and WHEREAS, each employee should read and become familiar with the updated Personnel Policy Manual herein adopted;NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FRIENDSWOOD,STATE OF TEXAS: Section 1. That the facts and matters set forth in the recitals of this resolution are hereby found to be true and correct. Section 2. That the City Council of the City of Friendswood hereby amends Chapter 7 "Benefits," Section 7.02 "Holidays" of the City of Friendswood's Personnel Policy Manual to read as provided in Exhibit"A,"which is attached hereto and incorporated herein for all intents and purposes. Section 4. That the City Council of the City of Friendswood hereby amends Chapter 7 "Benefits" of the City of Friendswood's Personnel Policy Manual to add a new section to be entitled and numbered Section 7.08 "Paid Time Off for Certain Part-Time Employees," which section shall read as provided in Exhibit"B,"which is attached hereto and incorporated herein for all intents and purposes. Section 5. In the event any section, paragraph, subdivision, clause, phrase, provision, sentence, or part of this resolution or the application of the same to any person or circumstance shall for any reason be adjudged invalid or held unconstitutional by a court of competent jurisdiction, it shall not affect, impair, or invalidate this resolution as a whole or any part or provision hereof other than the part declared to be invalid or unconstitutional;and the City Council of the City of Friendswood,Texas,declares that it would have passed each and every part of the same, notwithstanding the omission of any such part thus declared to be invalid or unconstitutional,or whether there be one or more parts. Section 6. This resolution shall be effective immediately upon its passage and approval. Holidays Recognized The City provides full-time employees the following paid holidays during the fiscal year as approved by Council: 1. New Year's Day January 1 2. Martin Luther King.Jr.'s Birthday Third Monday in January 3. Presidents' Day Third Monday in February 4. Good Friday Friday before Easter Sunday 5. Memorial Day Last Monday in May 6. Floating Holiday One day of employee's choosing. Eligible part-time employees, as defined in section 7.08, ("PTO eligible part-time employees") will receive all of the above-referenced holidays, other than the floating holiday. Temporary and seasonal employees as well as non-PT() eligible part-time employees shall not be granted paid holidays. b. Payment and Eligibility Regular full-time employees will be paid at their base rate for hours equal to one workday for each holiday. PTO eligible part-time employees will be paid at their base rate for hours equal to one workday for each holiday, which workday will be based upon the employee's FTE status as indicated in the City's payroll records. c. Observance if the holiday falls on a Saturday. the preceding Friday shall be observed,and if a holiday falls on a Sunday.the following Monday shall be observed.As many employees as possible shall be given each holiday otT while providing for the maintenance of essential City functions. Shift personnel will observe official City holidays on the actual day of observance. Department Directors may revoke or restrict observance of any designated holiday in order to provide necessary municipal services to the public. Eligibility To he eligible for holiday pay. the employee must work the scheduled hours before and after the holiday unless an excused absence is approved by the Department Director. Employees on unpaid administrative leave will not receive holiday pay. Employees scheduled to work on an observed holiday, and who fail to work as scheduled without an excused absence,will not be eligible for holiday pay. An employee required to work on an observed holiday will receive the holiday pay plus the overtime rate of one- and one-half times the regular rate of pay for hours worked. An employee who is terminated for gross misconduct (e.g.. positive drugs. theft. destruction of City property, job abandonment. etc.) shall be ineligible for payment of accumulated holiday leave. Similarly. upon separation of service, PTO eligible part-time employees are not entitled to payment for accumulated holiday leave. e. Floating Holiday (lours equal to one regular workday will be paid as a floating holiday -- a day of the employee's choosing— with supervisor's approval. This holiday is awarded to a new full- time employee upon completion of 90 days of service. All full-time employees employed longer than 90 days will receive floating holiday hours on January I" of each year. The hours of one Floating Holiday may he carried over from one year to the next,not to exceed hours equivalent to two holidays. Purpose Paid time off leave is designed to provide part-time employees, who meet the eligibility requirements of this section, flexibility and control in scheduling time away from work for vacations, emergencies, appointments, inclement weather, or other personal needs. b. Scope This section applies to eligible part-time employees as defined in subsection c of this section. It does not apply to full-time employees, temporary employees, interns, or seasonal employees. c. Definitions The following words,terms, and phrases,when used in this section, shall have the meanings ascribed to them in this subsection, except where the context clearly indicates a different meaning: Biweekly means each pay period in a two-week payroll cycle. Eligible part-time employee means a person who is classified as a part-time employee with an FTE status of 0.50 or greater as indicated in the City's payroll records. Full-time equivalent (FTE) means an employee's scheduled weekly hours divided by the standard full-time schedule of 40 hours, rounded as designated by the director of human resources. Maximum PTO accrual hours means the cap on PTO hours an employee may hold at any time. PTO means paid time off. d. Computation (1) Eligible part-time employees begin accruing PTO leave on (i) the start of the first full biweekly pay period after April 6,2026,or(ii)their most recent date of hire, whichever is later. (2) When an employee has reached their maximum PTO accrual hours, each pay period additional accruals will be added to the employee's bank; and if not used during that pay period, the oldest accruals will be deducted to maintain the maximum PTO accrual hours allowed. (3) Should a paid holiday fall during the eligible part-time employee's PTO leave, the employee will receive holiday pay for those designated hours instead of PTO pay. (4) Should an eligible part-time employee's scheduled PTO leave be canceled or interrupted by the City for its convenience or due to an emergency, the City Manager may extend the period during which accrued PTO leave may be used. (5) The accrued PTO hours of an eligible part-time employee being transferred or promoted to a full-time position shall be converted on a 1:1 basis to accrued vacation hours on the date of the transfer or promotion. An eligible part-time employee being transferred or promoted to another part-time position, for which the employee will remain qualified as an eligible part- time employee, shall retain accrued PTO hours. An employee who moves from an eligible part-time position to a part-time position for which the employee no longer qualifies as an eligible part-time employee may use their accrued PTO hours in their new position but will not accrue additional PTO hours. Personnel Policy 38 �Nosw J City of Friendswood Personnel Policy Manual '��%' `�M BENEFITS 4 �4 iE+i5 f4' Effective Date: August 7, 2023 t`:it Revision Date: June 6,2024 Chapter 7 April 6, 2026 (6) If an employee's designated FTE status changes, the accrual rate and maximum PTO accrual hours will adjust prospectively effective the first full pay period following approval of the change. (7) Employees on a leave of absence, other than USERRA leave, are required to use all accrued PTO hours as part of the leave. (8) Time off without sufficient PTO balance will be unpaid. f. PTO Usage (1) PTO may be used for vacation, personal time, short-term illness, and other approved absences, subject to supervisory approval and scheduling needs. (2) Eligible part-time employees are permitted to use their PTO allotment in increments accepted by timekeeping system. (3) It is the responsibility of eligible part-time employees to monitor and manage their own balance to allow for adequate reserves for future use. g. Approval Required All PTO leave taken must be approved in advance by the employee's supervisor. This approval will necessarily balance the needs of the City and the needs of the employee. When there are conflicting requests from employees,the supervisor will distribute the PTO and vacation leaves fairly among the requesting employees. Except for special circumstances with Department Director approval,not more than 80 hours can be used consecutively. h. Non-Accrual PTO hours shall not be accrued for any pay period during which an employee is receiving donated time for more than half of their regularly scheduled work hours. Unless otherwise required by law, PTO hours will not accrue while eligible part- time employees are on disability, leave of absence, family and medical leave, parental leave, workers' compensation leave or any other inactive status. PTO hours may not be advanced before earned. i. Separation An employee may not use PTO leave during the two weeks' notice period prescribed by Section 5.01.f. When an employee leaves employment with the City of Friendswood,the employee will not receive payment for any unused PTO hours accrued at the time of separation. Personnel Policy 139
