ORDINANCE NO. 2011-33 AN ORDINANCE AMENDING CITY OF FRIENDSWOOD, TEXAS, ORDINANCE NO. 2010-28, PASSED AND APPROVED OCTOBER 4, 2010, SAME BEING AN ORDINANCE APPROVING AND ADOPTING THE CITY'S GENERAL BUDGET FOR FISCAL YEAR 2010-2011 BY APPROVING "BUDGET AMENDMENT XIV" TO THE "ORIGINAL GENERAL BUDGET OF THE CITY OF FRIENDSWOOD, TEXAS, FOR THE FISCAL YEAR 2010-201199; PROVIDING FOR SUPPLEMENTAL APPROPRIATION AND/OR TRANSFER OF CERTAIN FUNDS; PROVIDING FOR SEVERABILITY; AND PROVIDING OTHER MATTERS RELATED TO THE SUBJECT. x & * * ]F x k k nF k WHEREAS, by Ordinance No. 2010-28, the City Council of the City of Friendswood,' Texas, adopted its "Original General Budget for Fiscal Year 2010-2011'; and WHEREAS,the City Council has determined that revenues and/or reserves are available for supplemental appropriation, and/or that the transfer of certain funds interdepartmentally is economically feasible and in the best interest of prudent budgeting and for municipal purposes; and WHEREAS, Section 8.04 of The City Charter provides for amendments after adoption of the budget; and WHEREAS, the City Council desires to amend said Original General Budget to reflect such supplemental appropriation and/or transfer in the fiscal year 2010-2011; now,therefore, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FRIENDSWOOD, STATE OF TEXAS: i Section 1. The facts and matters set forth in the preamble of this Ordinance are hereby found to be true and correct. Section 2. The "Original General Budget of the City of Friendswood, Texas, for the Fiscal Year 2010-2011," is hereby amended for municipal purposes as shown on "Budget. Amendment XIV" to the "Original Budget of the City of Friendswood, Texas, for the Fiscal year 2010-2011" attached hereto. Said Budget Amendment XIV shall be attached to and made apart of such Original General Budget by the City Secretary and shall be filed as required by state law, a true and correct copy of which is attached hereto as Exhibits "A" and `B" and made a part hereof for all purposes. Section 3. In the event any clause,phrase, provision, sentence, or part of this ordinance or the application of the same to any person or circumstance shall for any.reason be adjudged invalid or held unconstitutional by a court of competent jurisdiction, it shall not affect, impair, or, invalidate this ordinance as a whole or any part or provision hereof other than the part declared to be invalid or unconstitutional; and the City Council of the City of Friendswood, Texas, declares that it would have passed each and every part of the same notwithstanding the omission of any such part thus declared to be invalid or unconstitutional,whether there be one or more parts. Edward Byrne Memorial Justice Assistance Program Grant, $47,485. Appropriate funds in advance for the purchase of equipment and accessories to retrofit a Police Department Law Enforcement Vehicle. The Edward Byrne Memorial Justice Assistance Program grant was awarded to the City on September 9, 2011. The grant is specifically for equipment and accessories to retrofit the 2010 Ford F450 Van into an Emergency Response Vehicle. The van was purchased in Fiscal Year 2010 and is being used for high-risk tactical. situations. The retrofit will include interior and exterior upgrades to provide storage and safe transport of equipment and personnel. The retrofit will also allow the van to serve as an inner perimeter Command Post in emergency. situations. The funding source for the expenditures has been identified as undesignated general fund balance. The grant reimbursement of 100% will replenish undesignated general fund balance used for the expenses to retrofit the vehicle. 2. Police Department Criminal Investigations Division Reimbursement, $3,082. Appropriate funds received from FBI and Houston HIDTA to the Police Department Criminal Investigation division. The City has a Memorandum of Understanding with both agencies for reimbursement of personnel overtime spent on Drug Task Force activities. This reimbursement is for activities in the month of July 2011. The funds will be appropriated to the Police Department Criminal Investigations Division personnel overtime account.
