AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
FRIENDSWOOD, TEXAS, AUTHORIZING THE ABANDONMENT OF THE
CITY'S INTEREST IN A TWENTY-FOOT (20') SANITARY SEWER
EASEMENT TRAVERSING LOTS ADDRESSED AS 3727, 3723, 3715, 3711 E
FM 528 AND 18001 BLACKHAWK BOULEVARD,AND LOCATED WITHIN
THE FRIENDSWOOD CITY CENTER SUBDIVISION FINAL PLAT, SAID
EASEMENT BEING APPROXIMATELY 0.706-ACRES AND RECORDED IN
THE HARRIS COUNTY CLERK'S REAL PROPERTY RECORDS UNDER
FILE NO. RP-2020-59908; AUTHORIZING THE MAYOR TO EXECUTE A
QUITCLAIM DEED RELEASING THE CITY'S INTEREST IN SAID
EASEMENT; AND ESTABLISHING THE EFFECTIVE DATE.

WHEREAS, a twenty-foot (20') sanitary sewer easement was dedicated to the City of
Friendswood and recorded in the Harris County Clerk's Real Property Records under File No.RP-
2020-59908,which property is more specifically described in Exhibit"A,"which is attached hereto
and incorporated herein for all intents and purposes(the "Easement"); and
WHEREAS, the owners of the property addressed as 3727, 3723, 3715, 3711 E FM 528
Rd and 18001 Blackhawk Boulevard, located within the Friendswood City Center Subdivision
Final Plat, over which the Easement traverses,applied to the City to vacate the Easement in order
to allow for landscaping along the Community Overlay District(COD)major thoroughfare and to
provide for a new sanitary sewer line within the parking lots of future sites within the Friendswood
City Center Project; and
WHEREAS,pursuant to Section 70-25 of the Friendswood City Code,the owners supplied
all required information to the City for the vacation of the Easement; and
WHEREAS,after conducting a public hearing in the time and manner required by law,the
Planning and Zoning Commission of the City of Friendswood provided its final report
recommending approval of the request to vacate the Easement to the City Council; and
WHEREAS,on February 2,2026,the City Council conducted a public hearing to consider
any public comments concerning the request to vacate the Easement; and
WHEREAS, after considering the testimony and evidence received at the public hearing
and the Planning and Zoning's report, the City Council has determined that the Easement should
be vacated in order to allow for landscaping along the Community Overlay District(COD)major
thoroughfare, and a new easement should be granted; and
WHEREAS, City Council has further determined that all public notices have been posted
and published,all required hearings on this matter have been held,and that this ordinance complies
with the applicable provisions of the City Charter, the Friendswood City Code, and all other
applicable laws;NOW THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FRIENDSWOOD,
STATE OF TEXAS:
Section 1. That the facts and matters set forth in the preamble of this ordinance are
hereby found to be true and correct.
Section 2. That the City Council of the City of Friendswood, Texas, hereby
authorizes the abandonment of the City's interest in the Easement encumbering the owners'
property as described in Exhibit "A."
Section 3. That the Mayor is hereby authorized to execute the Quitclaim Deed,which
is attached as Exhibit"B."
Section 4. This ordinance shall take effect immediately from and after its final
adoption by the City Council of the City of Friendswood,Texas.
INTRODUCED, READ AND PASSED on first and final reading by the affirmative vote
of the City Council of the City of Friendswood on this the 2nd day of February, 2026.

528)based on a width of 120 feet,from which point a found 5/8 inch iron rod at the southwest
comcr of said 28.9270 acre tract bears South 08 degrees 47 minutes 23 seconds East,a distance
of 1,289.36 feet;
THENCE,with said south R.O.W.line and the north line of said 135.778 acre tract,South 81
degrees 12 minutes 37 seconds West,a distance of 40.00 feet to the POINT OF BEGINNING;
THENCE,through and across said 135,778 acre tract,the following four(4)courses:
I.) South 08 degrees 47 minutes 23 seconds East.a distance of 20.00 feet;
2.) South 81 degrees 12 minutes 37 seconds West.a distance of'1,549.58 feet;
