ORDINANCE NO.2011-24 AN ORDINANCE AMENDING CITY OF FRIENDSWOOD, TEXAS, ORDINANCE NO. 2010-28, PASSED AND APPROVED OCTOBER 4, 2010, SAME BEING AN ORDINANCE APPROVING AND ADOPTING THE CITY'S GENERAL BUDGET FOR FISCAL YEAR 2010-2011 BY APPROVING "BUDGET AMENDMENT X" TO THE "ORIGINAL GENERAL BUDGET OF THE CITY OF FRIENDSWOOD, TEXAS, FOR THE FISCAL YEAR 2010-2011'; PROVIDING FOR SUPPLEMENTAL APPROPRIATION AND/OR TRANSFER OF CERTAIN FUNDS; PROVIDING FOR SEVERABILITY; AND PROVIDING OTHER MATTERS RELATED TO THE SUBJECT. WHEREAS, by Ordinance No. 2010-28, the City Council of the City of Friendswood Texas, adopted its "Original General Budget for Fiscal Year 2010-2011'; and �1 WHEREAS,the City Council has determined that revenues and/or reserves are available for supplemental appropriation, and/or that the transfer of certain funds interdepartmentally is economically feasible and in the best interest of prudent budgeting and for municipal purposes; and WHEREAS, Section 8.04 of The City Charter provides for amendments after adoption of the budget; and WHEREAS, the City Council desires to amend said Original General Budget to reflect such supplemental appropriation and/or transfer in the fiscal year 2010-2011; now,therefore, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FRIENDSWOOD, STATE OF TEXAS: Section 1. The facts and matters set forth in the preamble of this Ordinance are hereby found to be true and correct. Section 2. The "Original General Budget of the City of Friendswood, Texas, for the Fiscal Year 2010-2011," is hereby amended for municipal purposes as shown on "Budget Amendment X" to the "Original Budget of the City of Friendswood, Texas, for the Fiscal year 2010-2011" attached hereto. Said Budget Amendment X shall be attached to and made a part of such Original General Budget by the City Secretary and shall be filed as required by state law, a true and correct copy of which is attached hereto as Exhibits "A" and `B" and made a part hereof for all purposes. Section 3. In the event any clause, phrase,provision, sentence, or part of this ordinance or the application of the same to any person or circumstance shall for any reason be adjudged invalid or held unconstitutional by a court of competent jurisdiction, it shall not affect, impair, or invalidate this ordinance as a whole or any part or provision hereof other than the part declared to be invalid or unconstitutional; and the City Council of the City of Friendswood, Texas, declares that it i would have passed each and every part of the same notwithstanding the omission of any such part thus declared to be invalid or unconstitutional,whether there be one or more parts. Appropriate Senior Program Donations, $1,476. Appropriate funds donated from non-residents to the Senior Programs. Funds totaling $1,475 donated from October 1, 2010 through June 15, 2011 in fiscal year 2011 will be appropriated. Funds will be used for senior program activities and senior program trips. 2. Library Book Donations Revenue Appropriation. $9,963. Appropriate funds received from the fall 2010 and spring 2011 book sales. The funds will be used for Library sponsored community events and Library supplies in fiscal year 2011. 3. Fire Station #3 Rehabilitation Project, $302,072. Appropriate funds for the estimated cost of the Fire Station #3 rehabilitation project. Total cost of the project is estimated at $322,016; including $19,962 for project contingencies. A matching grant from the Texas Department of Rural Affairs will fund $172,016 of the project cost and the City will fund $150,000 of the project. The funding appropriation of $302,072 is net of an insurance reimbursement of $19,944 received in FY10 from Hurricane Ike damages at the Fire Station #3. The funding source for this expense will be the undesignated general fund balance. Pending the outcome of the project bid award, the estimated cost and funding appropriation needed for the Fire Station #3 rehab project may be amended.
