ORDINANCE NO. 2011-13 AN ORDINANCE AMENDING APPENDIX C OF THE FRIENDSWOOD CITY CODE, SAID APPENDIX C BEING CITY OF FRIENDSWOOD, TEXAS, ORDINANCE NO. 84- 15, AS AMENDED, ORIGINALLY ADOPTED THE 19TH DAY OF NOVEMBER, 1984, AND BEING THE ZONING ORDINANCE OF THE CITY, BY AMENDING SUBSECTION D OF SECTION 15 "AMENDMENTS" TO CLARIFY LANGUAGE REGARDING THE NOTICE OF JOINT PUBLIC HEARINGS; PROVIDING A PENALTY OF AN AMOUNT NOT TO EXCEED $2,000 FOR EACH DAY OF VIOLATION OF ANY PROVISION HEREOF; AND PROVIDING FOR SEVERABILITY. I BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FRIENDSWOOD,! STATE OF TEXAS: Section 1. City of Friendswood, Texas, Ordinance No. 84-15, as amended, originally i adopted the 19u day of November, 1984, same being Appendix C of the Friendswood City Code, and also being the zoning ordinance of the City, is hereby amended by amending Subsection (D) of Section 15 "Amendments"as follows: "Section 15. Amendments. D. Notice ofjoint hearings. 1. Notice of any joint public hearing involving a proposed change in a zoning classification [held pufsuant to suh- .eet:,.., C of this seetio., 151 shall be given, in writing, to each owner of real property, as indicated by the most recently approved city tax roll, which lies within 200 feet of any property on which [a} said change in classification is proposed, such notice to be given not less than ten days prior to the date on which such hearing is to be held. Notice of[suehi all joint public [hearing} hearings shall also be published in the official newspaper of the city, or a newspaper having general circulation in the city, at least 15 days prior to the date on which such hearing is to be held. i In addition, notice of any joint public hearing involving a proposed change in zoning classification shall be given by causing a sign to be erected on the property which would be affected by the proposed change stating the time and place of the hearing. Such sign shall be erected not less than ten days prior to the date on which such hearing is to be held. Section 2. Any person who shall violate any provision of this Ordinance shall be deemed guilty of a misdemeanor and, upon conviction, shall.be fined in an amount not to exceed $2,000. Each day of violation shall constitute a separate offense. Section 3. In the event any clause, phrase, provision, sentence, or part of this Ordinance or the application of the same to any person or circumstances shall for any reason be adjudged invalid or held unconstitutional by a court of competent jurisdiction, it shall not affect, impair, or invalidate this Ordinance as a whole or any part or provision hereof other than the part declared to be invalid or unconstitutional; and the City Council of the City of Friendswood, Texas, declares that it would have passed each and every part of the same notwithstanding the omission of any such part thus declared to be invalid or unconstitutional, whether there be one or more parts.
