ORDINANCE NO. 2011-18 AN ORDINANCE AMENDING APPENDIX C OF THE CODE OF ORDINANCES OF THE CITY OF FRIENDSWOOD, TEXAS, APPENDIX C BEING THE ZONING ORDINANCE OF THE CITY, BY CHANGING THE ZONING CLASSIFICATION OF A .4821-ACRE TRACT OF LAND, LOCATED AT 307 E. EDGEWOOD DRIVE, OUT OF LOT 4, BLOCK 9 FRIENDSWOOD SUBDIVISION IN THE SARAH MCKISSICK LEAGUE OF J. R. WILLIAMS LEAGUE; PROVIDING FOR THE GRANTING OF A NEW SPECIFIC USE - PERMIT (SUP) TO ALLOW THE USE OF THE PROPERTY FOR NAICS USE #621 — AMBULATORY HEALTH CARE SERVICES, NAICS USE #52 — FINANCE C� AND INSURANCE, NAICS USE #531 — REAL ESTATE, NAICS USE #54 - PROFESSIONAL, SCIENTIFIC AND TECHNICAL SERVICES, NAICS USE #55 - MANAGEMENT j OF COMPANIES AND ENTERPRISES, AND NAICS USE #8121 - PERSONAL CARE SERVICES, AND PROVIDING EXCLUSIONS; PROVIDING FOR AMENDMENT OF THE OFFICIAL ZONING MAP; PROVIDING A PENALTY IN AN AMOUNT NOT TO EXCEED $2,000 FOR EACH DAY OF VIOLATION OF ANY PROVISION HEREOF; AND PROVIDING FOR SEVERABILITY. WHEREAS, BSR, LLC, is the Owner of a .4821-acre tract of land, located at 307 E. Edgewood Drive, out of Lot 4, Block 9 Friendswood Subdivision, in the Sarah McKissick League of J. R. Williams League, according to the map thereof recorded in Volume 254, Page 18, Galveston County Map Records, Galveston, County, Friendswood, Texas (the "Property"), a survey and description of which is attached hereto as Exhibit"A" and made a part hereof; and WHEREAS, the Owner has made application to the City to change the zoning classification of the Property by granting a Specific Use Permit (SUP) to allow the use of the Property for NAICS use 4621 — Ambulatory Health Care Services, NAICS use #52 — Finance and Insurance, NAICS use #531 — Real Estate, NAICS use #54 - Professional, Scientific and Technical Services), NAICS use #55 - Management of Companies and Enterprises, and NAICS use #8121 -Personal Care Services, a copy of which is attached hereto as Exhibit`B" and made a part hereof; and WHEREAS, the Planning and Zoning Commission and the City Council have conducted, in the time and manner required by law and the Zoning Ordinance of the City, a public hearing on such request; and WHEREAS, the Planning and Zoning Commission has filed its written report with City. Council, which recommends approval of the application, subject to certain conditions; and i WHEREAS, the City Council deems it appropriate to grant such request, subject to certain regulations, restrictions, and conditions; now, therefore, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FRIENDSWOOD, STATE OF TEXAS: , Section 1. The facts and matters set forth in the preamble of this Ordinance are hereby found to be true and correct. Section 2. City of Friendswood, Texas, Ordinance No. 84-15, as amended, originally adopted the 191h day of November, 1984, the same being Appendix C of the Friendswood City Code, and also being the zoning ordinance of the City, is amended by changing the zoning classification of a .4821-acre tract of land, located at 307 E. Edgewood Drive, out of Lot 4, r ` Block 9 Friendswood Subdivision, in the Sarah McKissick League of J. R. Williams League, Ord 2011-18 2 according to the map thereof recorded in Volume 254, Page 18, Galveston County Map Records, Galveston, County, Friendswood, Texas (the "Property"), by hereby granting a new Specific Use Permit to allow for the use of the Property for NAICS use #621 — Ambulatory Health Care Services, NAICS use #52 — Finance and Insurance, NAICS use #531 —Real Estate, NAICS use #54 - Professional, Scientific and Technical Services, NAICS use #55 - Management of Companies and Enterprises, and NAICS use #8121 - Personal Care Services, but excluding NAICS use #541940 (Veterinary Services), NAICS 812113 (Nail Salons), and NAICS 812199 (tattoo parlors and ear piercing services). Section 3. The Zoning District Map of the City of Friendswood shall be revised and amended to show the designation of the Property, as described and as provided in Section 2 above, with the appropriate reference thereon to the number and effective date of this Ordinance, and a brief description of the nature of the change. Section 4. This Ordinance shall in no manner amend, change, supplement, or revise any provision of any ordinance of the City of Friendswood, save and except the change in zoning classification of said Property as described in Section 2 hereof. Section 5. In the event any section, paragraph, subdivision, clause, phrase, provision,- sentence, or part of this Ordinance or the application of the same to any person or circumstance shall for any reason be adjudged invalid or held unconstitutional by a court of competent jurisdiction, it shall not affect, impair, or invalidate this Ordinance as a whole or any part or provision hereof other any part or provision hereof other than the part declared to be invalid on unconstitutional; and the City Council of the City of Friendswood, Texas, declares that it would have passed each and every part of the same notwithstanding the omission of any and every part of the same notwithstanding the omission of any such part thus declared to be invalid or unconstitutional, or whether there be one or more parts. Section 6. Any person who shall willfully, intentionally, or with criminal negligence violate any provision of this Ordinance shall be deemed guilty of a misdemeanor and, upon conviction thereof, shall be fined in an amount not to exceed $2,000.00. We would like to rent a couple of offices to a Real Estate company of which I Jason Alexander(representing TA Properties)would be the renter. Eventually we would like to rent the entire building to similar real estate services such as insurance sales,title companies,loan officers,and management companies. We would like to also be prepared if one day our other company Bergamos Spa Retreat(AMI,LLC) would like to expand its business and building capacity that we have the option of incorporating the 307 E. Edgewood site into 313 E.Edgewood by merging the sites together. We feel that having these zoning requirements would be sufficient for any changes we wish to do to this site in the future.
