ORDINANCE NO. 2011-19 AN ORDINANCE AMENDING CITY OF FRIENDSWOOD, TEXAS, ORDINANCE NO. 2010-28, PASSED AND APPROVED OCTOBER 4, 2010, SAME BEING AN ORDINANCE APPROVING AND ADOPTING THE CITY'S GENERAL BUDGET FOR FISCAL YEAR 2010-2011 BY APPROVING `BUDGET AMENDMENT VIII" TO THE "ORIGINAL GENERAL BUDGET OF THE CITY OF FRIENDSWOOD, TEXAS, FOR THE FISCAL YEAR 2010-201199; PROVIDING FOR SUPPLEMENTAL APPROPRIATION AND/OR TRANSFER OF CERTAIN FUNDS; PROVIDING FOR SEVERABILITY; AND PROVIDING OTHER MATTERS RELATED TO THE SUBJECT. WHEREAS, by Ordinance No. 2010-28, the City Council of the City of Friendswood, i Texas, adopted its"Original General Budget for Fiscal Year 2010-2011"; and i WHEREAS, the City Council has determined that revenues and/or reserves are available for supplemental appropriation, and/or that the transfer of certain funds interdepartmentally is i economically feasible and in the best interest of prudent budgeting and for municipal purposes; F and WHEREAS, Section 8.04 of The City Charter provides for amendments after adoption of the budget; and WHEREAS, the City Council desires to amend said Original General Budget to reflect such supplemental appropriation and/or transfer in the fiscal year 2010-2011; now, therefore, BE-IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FRIENDSWOOD, STATE OF TEXAS: i Section 1. The facts and matters set forth in the preamble of this Ordinance are hereby found to be true and correct. Section 2. The "Original General Budget of the City of Friendswood, Texas, for the Fiscal Year 2010-2011," is hereby amended for municipal purposes as shown on "Budget Amendment VIII" to the "Original Budget of the City of Friendswood, Texas,For the Fiscal year 2010-2011" attached hereto. Said Budget Amendment VIII shall be attached to and made a part of such Original General Budget by the City Secretary and shall be filed as required by state law, a true and correct copy of which is attached hereto as Exhibits "A" and `B" and made a part hereof for all purposes. Section 3. In the event any clause, phrase,provision, sentence, or part of this ordinance or the application of the same to any person or circumstance shall for any reason be adjudged invalid or held unconstitutional by a court of competent jurisdiction, it shall not affect, impair, or invalidate this ordinance as a whole or any part or provision hereof other than the part declared to be invalid or unconstitutional; and the City Council of the City of Friendswood, Texas, declares that it would have passed each and every part of the same notwithstanding the omission of any such part thus declared to be invalid or unconstitutional,whether there be one or more parts. Program 380 Economic Development Grant (EC Friendswood I, LP), 1197. Appropriate designated general fund balance for a Program 380 Economic Development Grant reimbursement. The economic development agreement, dated July 2, 2007, between the City of Friendswood and EC Friendswood I, LP granted the Developer reimbursement for fees paid to the City .relating to the construction and development of a 28,940 square feet, two-story office building project, named Friendswood Medical Wellness Center, located at 1505 E. Winding Way. The agreement granted reimbursement to the Developer for construction and development fees paid to the City related to the project in an amount not to exceed $50,000. On December 9, 2008, the developer received a reimbursement for fees paid to the City in the amount of $38,997. The . requested reimbursement of $1,197 is for additional fees paid to the City for the build out of one of the remaining tenant lease spaces at 1505 East Winding Way. i 2. Animal Control Facility Construction and Testing, $132,020. Transfer of funds saved from design engineering and surveying to the construction and testing phase of the Animal Control facility project. City Council approved funding in the amount of $250,000 for project design engineering and surveying on February 22, 2010 and $750,000 for project construction on August 2, 2010. Of the design engineering and surveying funding appropriation, $117,980 was expended. On April 18, 2011, City Council approved the bid award of $877,542 i for construction and $4,439 for testing on the Animal Control Facility project.
