ORDINANCE NO.2011-06 I AN ORDINANCE AMENDING CITY OF FRIENDSWOOD, TEXAS, ORDINANCE NO. 2010-28, PASSED AND APPROVED OCTOBER 4, 2010, SAME BEING AN ORDINANCE APPROVING AND ADOPTING THE CITY'S GENERAL BUDGET FOR FISCAL YEAR 2010-2011 BY APPROVING "BUDGET AMENDMENT III" TO THE "ORIGINAL GENERAL BUDGET OF THE CITY OF FRIENDSWOOD, TEXAS, FOR THE FISCAL YEAR 2010- 2011"; PROVIDING FOR SUPPLEMENTAL APPROPRIATION AND/OR TRANSFER OF CERTAIN FUNDS; PROVIDING FOR SEVERABILITY; AND PROVIDING OTHER MATTERS RELATED TO THE SUBJECT. WHEREAS, by Ordinance No. 2010-28, the City Council of the City of Friendswood, Texas, adopted its "Original General Budget for Fiscal Year 2010-2011"; and WHEREAS, the City Council has determined that revenues and/or reserves are available for supplemental appropriation, and/or that the transfer of certain funds interdepartmentally is economically feasible and in the best interest of prudent budgeting and for municipal purposes; and WHEREAS, Section 8.04 of The City Charter provides for amendments after adoption of the budget; and WHEREAS, the City Council desires to amend said Original General Budget to reflect such supplemental appropriation and/or transfer in the fiscal year 2010-2011; now,therefore, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FRIENDSWOOD, STATE OF TEXAS: Section 1. The facts and matters set forth in the preamble of this Ordinance are hereby found to be true and correct. Section 2. The "Original General Budget of the City of Friendswood, Texas, for the Fiscal Year 2010-2011," is hereby amended for municipal purposes as shown on "Budget Amendment III" to the "Original Budget of the City of Friendswood, Texas, For the Fiscal year 2010-2011"attached hereto. Said Budget Amendment III shall be attached to and made a part of such Original General Budget by the,City Secretary and shall be filed as required by state law, a, true and correct copy of which is attached hereto as Exhibits"A" and `B" and made a part hereof for all purposes. Section 3. In the event any clause, phrase,provision, sentence, or part of this ordinance; or the application of the same to any person or circumstance shall for any reason be adjudged'' invalid or held unconstitutional by a court of competent jurisdiction, it shall not affect, impair, or, invalidate this ordinance as a whole or any part or provision hereof other than the part declared to be invalid or unconstitutional; and the City Council of the City of Friendswood, Texas, declares that it would have passed each and every part of the same notwithstanding the omission of any such parti thus declared to be invalid or unconstitutional,whether there be one or more parts. (ORD 2011-06) ExhibitA Page 1 i City of Friendswood ' Budget Amendment Summary Fiscal Year 2010 — 2011 Budget Amendment 111 February 28, 2011 1. State Hazard Mitigation Grant, $65,185. Appropriate funds in advance for the purchase of protective window coverings for nine city facilities. The FEMA Hazard Mitigation Grant Program was awarded December 1, 2010; with a 75%/25% match of which the City's portion is $16,296. The funding source for the expenditure has been identified as undesignated general fund balance. The Fire Marshal office staff will request Council approval of the grant award at the February 7, 2011 Council meeting. The FEMA reimbursement of 75% is estimated to be $48,889 which will replenish undesignated general fund balance . used for the project. 2. TDRA Grant, $1,495,657. —Appropriate funds in advance for the purchase and installation of 37 emergency generators. The grant funding from the Texas Department of Rural Affairs (TDRA) was awarded to the City on March 2, 2010 for the emergency generators project. The generators will be installed at 33 Lift Stations, Surface Water Plant#1 and Water Plant#2, Fire Stations #1 and #2. Council approved and accepted the grant award at the April 19, 2010 meeting. The funding source for the expenditure has been identified as undesignated general fund balance. The TDRA grant reimbursement of 100% will replenish undesignated general fund balance for the project expenses. 3. Community Service Senior Program Bus. $99,748. Appropriate funds in advance to Community Service Senior Program for the purchase of a bus. Public Transportation Division of the Texas Department of Transportation (TxDOT) 5310 program provides funds for the purchase of a transportation vehicle for the elderly and persons with disabilities. The vehicle will be purchased under the Section 5310 Program with 80% ($79;798) /20% match. The city's portion will be $19,950. The funding source for the expenditure has been identified as undesignated general fund balance. The adopted budget for fiscal year 2010-11 included a capital lease payment of $30,897 through the Tax Debt Service Fund. The designated amount of$30;897 will be un-appropriated in the Tax Debt Service Fund Balance.
