ORDINANCE NO. 2011-05
AN ORDINANCE AMENDING CITY OF FRIENDSWOOD,
TEXAS, ORDINANCE NO. 93-21 AND ORDINANCE NO.
2003-02, WHICH GRANTED A SPECIFIC USE PERMIT
FOR RELIGIOUS ORGANIZATIONS FOR PROPERTY
LOCATED AT 1804 S. FRIENDSWOOD DRIVE (TO BE
USED FOR HOPE LUTHERAN CHURCH), BY ALLOWING
HOPE LUTHERAN CHURCH TO EXPAND EXISTING
AND PROPOSED BUILDINGS, SHIFT THE FOOTPRINT
FROM THE EXISTING SUP, AND ADD ADDITIONAL
PARKING; PROVIDING A PENALTY OF AN AMOUNT
NOT TO EXCEED $2,000 FOR EACH DAY OF VIOLATION
OF ANY PROVISION HEREOF; AND PROVIDING FOR
SEVERABILITY. i

WHEREAS, pursuant to Ordinance No. 93-21 and Ordinance No. 2003-02, the City
Council approved a Specific Use Permit for Religious Organizations for Hope Lutheran Church
on 8.136 acres located at 1804 S. Friendswood Drive; and

WHEREAS, the property is currently developed with a worship center, education
building and garage; and
WHEREAS, the Applicant is seeking to amend the Specific Use Permit in order to
expand existing and proposed buildings, shift the footprint from the existing SUP, and add
additional parking; and

WHEREAS, the Applicant has requested to be allowed to continue to develop the

property in accordance with the sidewalk requirements in effect when the property was platted in
2002; and

WHEREAS, the Applicant has requested to not be required to provide the landscape'
buffers or the 8' opaque fence along the South property lines bordering Hunter's Creek detention)
reserve because this property will never be developed and is for detention purposes only;
WHEREAS, the Applicant has requested to not be required to provide the landscape;
buffer along the Northwesterly property line bordering Hunter's Creek Subdivision because there,
are existing full-grown trees and an existing eight-foot wood fence to serve as a buffer between
the residential properties and the parking area. Additionally, no buildings are planned in this
area of the site.
WHEREAS, the Planning and Zoning Commission and the City Council have
conducted, in the time and manner required by law and the Zoning Ordinance of the City,
public hearing on such request; and
WHEREAS, the Planning and Zoning Commission has recommended approval of the
proposed amendments and the City Council deems it appropriate to grant such request, subject tl
certain regulations, restrictions, and conditions; now,therefore,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OI
FRIENDSWOOD,STATE OF TEXAS:
Section 1. The facts and matters set forth in the preamble of this Ordinance are
hereby found to be true and correct.

Section 2. City of Friendswood, Texas, Ordinance No. 93-21 and Ordinance No. j
2003-02, granting a Specific Use Permit for Religious Organizations for Hope Lutheran Church,
on 8.136 acres located at 1804 S. Friendswood Drive, is hereby amended as set forth below:
A. The revised footprint and expansion and addition of existing and proposed
buildings and additional parking, as shown on the site plan set, is approved.
B. The Church may continue to develop the property in accordance with the
sidewalk requirements in effect when the property was platted in 2002.
C. The Church shall not be required to provide landscape buffers or the 8' opaque
fence along the South property lines bordering Hunter's Creek detention reserve.
D. The Church shall not be required to provide the landscape buffer along the
Northwesterly property line bordering the residential lots of Hunter's Creek Subdivision.
E. Except as expressly stated herein, Ordinance No. 93-21 and Ordinance No. 2003-
02 shall remain in full force and effect. i
Section 3. The Zoning District Map of the City of Friendswood shall be revised an
amended to show the designation of the Property, as described and as provided in Section 2I
above, with the appropriate reference thereon to the number and effective date of this Ordinance,
and a brief description of the nature of the change.
Section 4. Any person who shall violate any provision of this Ordinance shall b
deemed guilty of a misdemeanor and upon conviction, shall be fined in an amount not to exceed
$2,000.00. Each day of violation shall constitute a separate offense.
Section 5. In the event any section, paragraph, subdivision, clause, phrase, provision,
sentence, or part of this Ordinance or the application of the same to any person or circumstance
shall for any reason be adjudged invalid or held unconstitutional by a court of competent
jurisdiction, it shall not affect, impair, or invalidate this Ordinance as a whole or any part Jr
provision hereof other any part or provision hereof other than the part declared to be invalid or
unconstitutional; and the City Council of the City of Friendswood, Texas, declares that it would
have passed each and every part of the same notwithstanding the omission of any and every part

of the same notwithstanding the omission of any such part thus declared to be invalid or
unconstitutional, or whether there be one or more parts.
