A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF FRIENDSWOOD, TEXAS, DESIGNATING THE
MAYOR AS THE CITY'S REPRESENTATIVE IN
SEEKING ELIGIBLE GRANT FUNDS UNDER THE CX-
CRIMINAL JUSTICE PROGRAM SOLICITATION FOR
PLANNING YEAR 2012; AND AUTHORIZING THE
SUBMISSION OF SUCH GRANT APPLICATION TO THE
CRIMINAL JUSTICE DIVISION OF THE OFFICE OF
GOVERNOR.

WHEREAS, the City Council of the City of Friendswood, Texas hereby finds and
determines that application for funding under the CX-Criminal Justice Program Solicitation is in
the best interests of the citizens of the City; and
WHEREAS, the City agrees that in the event of loss or misuse of any Criminal Justice
Division grant funds, the City will return same to the Criminal Justice Division in full; and
WHEREAS, the City Council hereby further finds and determines that the person
serving as Mayor of the City is the appropriate individual to act as the City's authorized official,
and as such should be given the power to apply for, accept, reject, alter or terminate the grant on
behalf of the City, now therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FRIENDSWOOD,
TEXAS:
Section 1. The facts and matters set forth in the preamble of this Resolution are
hereby found to be true and correct.
Section 2. The City Council of the City of Friendswood, Texas, hereby authorizes
and approves the submission of a grant application, pursuant to the CX — Criminal Justice
Program Solicitation for Planning Year 2012, to the Office of the Governor, Criminal Justice
Division.
Section 3. The City Council hereby designates and appoints the Mayor of said City
as the authorized official to apply for, accept, reject, alter, or terminate the grant on behalf of the
City, and to execute any documentation associated with the grant.

Eligibility Information
The Office of the Governor(OOG) publishes funding opportunities, known as Requests for
Applications(RFA),through the Texas Secretary of State. In addition, OOG requires all
applicants and grantee organizations to adhere to the Texas Administrative Code(TAC)as
adopted.
Submission Process
When applying for a grant pursuant to an RFA published in the Texas Register by OOG,
applicants must submit their applications according to the requirements provided in the RFA.
OOG may also consider applications for grants that are not submitted pursuant to an RFA.
Applicants will be selected in accordance with s TAC, §3.7.
Selection Process
All applications submitted to OOG are reviewed for eligibility, reasonableness, availability of
funding, and cost-effectiveness. For applications submitted pursuant to an RFA,the executive
director will select a review group, COG, or other designee to prioritize the applications and
submit a priority listing to the executive director,who will render the final funding decision.A
review group may include staff inembers, experts in a relevant field, and members of an
advisory board or council. For more information regarding the selection process, see 1 TAC,
g3•7•
Funding Decisions
All grant funding decisions rest completely within the discretionary authority of OOG.The
receipt of an application for grant funding by OOG does not obligate OOG to fund the grant or
to fund it at the amount requested. Neither the approval of a project nor any grant award shall
commit or obligate OOG in any way to make any additional, supplemental, continuation, or
other award with respect to any approved project or portion thereof. OOG makes no
commitment that a grant, once funded, will receive priority consideration for subsequent
funding. For more information regarding the application process, see i TAC, §3.7 and 3.g.
Adoptions by Reference
All grantees receiving federal and state funds must comply with the applicable statutes, rules,
regulations, and guidelines related to the funding source under which the grant is funded. In

instances where both federal and state requirements apply to a grantee,the more restrictive

Community Plans
Each community, consisting of a single county or a group of counties, must file with a COG a
community plan that addresses the community's criminal justice priorities.A community plan
should assess local trends and data; identify problems, resources, and priorities; develop
effective strategies; and set goals and objectives. For more information regarding community
plans, see s TAC, §3.5i.
Juvenile Justice and Yo�th Projects
Juvenile justice projects or projects serving delinquent or at-risk youth, regardless of the
funding source, must address at least one of the priorities developed in coordination with the
Governor's Juvenile Justice Advisory Board to be eligible for funding. For more information
regarding these priorities, see s TAC, §3•53•
Monitoring
OOG will monitor the activities of grantees as necessary to ensure that grant funds are used for
authorized purposes in compliance with all applicable statutes, rules, regulations, guidelines,
and the provisions of grant agreements, and that grantees achieve grant purposes. Grantees
must make available to OOG or its agents all requested records relevant to a monitoring

system.

Program Requirements
Preferences—Preference will be given to applicants who demonstrate cost effective programs
focused on a comprehensive and effective approach to services that compliment the criminal
justice system while performing the following activities:
i. Target statistically supported areas of violent crime.
z. Promote the use of inter-local agreements(Texas Government Code, Chapter 79i)to
target statistically supported crime threats to a specified geographical area.
3. Promote intelligence sharing, crime reporting and communication.
4. Promote comprehensive solutions to local criminal justice priorities.
Prohibition on Serving Certain Adult Offenders-Applicants will not serve adult offenders
charged with, given deferred adjudication for, or convicted of violent or other serious crimes
including murder, arson, robbery, sexual assault, aggravated sexual assault, burglary,felony
drug crimes, crimes against children, kidnapping, aggravated kidnapping, and manslaughter,
unless the executive director of UD grants an exception.
Purpose Areas

Law Enforcement- Supports state and local law enforcement agencies that address violent
crime or statistically supported major crime initiatives at the local level.

court ordered to participate, including drug courts and projects that serve as alternatives to
incarceration.
Program Income
Applicant agrees to comply with all federal and state rules and regulations for program income
and agrees to report all program income that is generated as a result of the project's activities.
Applicant agrees to report program income to UD through a formal grant adjustment and to
secure CJD approval prior to use of the program income.Applicant agrees to use program
income for allowable costs and agrees to expend program income immediately after CJD's
approval of a grant adjustment and priorto requesting reimbursement of CJD funds.
Deduction Method - Program income shall be deducted from total allowable costs to
determine the net allowable costs. Program income shall be used for current costs unless UD
authorizes otherwise. Program income which the grantee did not anticipate at the time of the
award shall be used to reduce the CJD award and grantee match rather than to increase the
funds committed to the project.
Asset Seizures and Forfeitures- Program income from asset seizures and forfeitures is
considered earned when the property has been adjudicated to the benefit of the plaintiff(e.g.,
law enforcement entity).
Seizures and ForFeitures
Applicant agrees to comply with the following:
1. Applicant will maintain on file and provide a copy of the asset sharing agreement
between the applicant agency and any other criminal justice agency outlining the
distribution of assets forfeited in the course of grant-related activities.The asset
agreement must clearly describe the distribution of forfeited assets within the grantee
agency in regards to grant funded and non-grant funded personnel participating in
grant-related activities.
z. Applicant shall maintain a logbook of all assets seized in the course of grant-related
activities.The logbook shall record the assets seized,the date and time of the asset
seizure,the case number of the incident involving the asset seizure,the name ofthe
grantee agency employee(s)who were involved in the seizure of the assets,the date
seized assets are forfeited,the date forfeited assets are liquidated if not cash, and the
final disposition of cash from cash forfeitures or property sales to the grantee agency.
Uniform Crime Reporting
Applicant assures that if it operates a law enforcement agency,the agency is current and has
been current in reporting required Part I violent crime data for the three previous years to the
Texas Department of Public Safety, and will continue timely reporting of required crime data
throughout the grant period.

Van for use in high-risk tactical situations.The usability ofthe vehicle has been hindered since
its purchase due to its limited storage areas, seating areas and emergency lighting.Without
upgrading,the use of the ERV will remain limited.

Provide as much supporting data,to include baseline statistics and the sources of your data,

served. Between zoog and zoio,the City had 8 hostage/barricade incidents that resulted in a
tactical team call out.And,the Field Support Unit has produced 4s tactical operations plans.
These are 78 documented events where deployment of an Emergency Response Vehicle would
have efficiently transported tactical team members to the incident scene. In its current
configuration,the vehicle can safely transport only z team members. Following the retrofit,
the vehicle will be able to transport i4 fully outfitted tactical team members and their
equipment.
Community Plan:

development of the Galveston County Community Plan zoio-zois.The plan has identified
gaps in services regarding criminal justice issues to include domestic violence (pg zz), survivors
of violent crime(pg i8), drugs and related criminal activity(pg i9),violent offenders(pg zo),
juvenile mental health (pg z3), and adult mental health (pg z8).The plan addresses
"insufficient resources to meet...the needs of all persons who are fleeing situations of domestic
violence"(pg 1z), "Galveston County[as] a gateway to the Houston metropolitan area for drug
trafficking" (pg i9), "a recent local growth in gangs/criminal enterprises [as] beginning to have
negative efFects in our communities"(pg zl), "studies [showing] economic depravity,family

violence and substance abuse to be catalysts for violence"(pg �i).Those addressed here are
the end users for law enforcement response in high-risk situations requiring tactical
intervention addressed by this application. Furthermore,the Plan cites"i,688 youth in need,
only i8i(ii%) receive [mental health]services"(pg z4)with these disproportionate numbers
ofyouth coming in contact with the police. Furthermore, "in FY zoo9 TDU released 936 ex-
offenders to Galveston County"(pg z9).This is an average of 78 persons per month. "Two-
thirds of all persons incarcerated have mental health and/or substance abuse-related issues
that...go untreated"(pg 30).These alarming numbers put violent offenders back in the
community, reoffending and creating incidents that jeopardize the safety of law enforcement.
Goal Statement:

efficiency in team response to critical incidents in the Friendswood and surrounding areas.
Cooperative Working Agreement(CWA):
When a grantee intends to carry out a grant project through cooperating or participating with
one or more outside organizations,the grantee must obtain authorized approval signatures on
the cooperative working agreement(CWA)from each participating organization. Grantees
must maintain on file a signed copy of all cooperative working agreements, and they must
submit to UD a list of each participating organization and a description of the purpose of each
CWA. Cooperative working agreements do not involve an exchange of funds.

Clear Creek Independent School District and the Galveston County Sheriff's Office - a mutual
aid law enforcement agreement securing the specialized equipment,facilities and trained
personnel of the respective departments are available to each other as requested and required.
Houston Police Department- delineating cooperative law enforcement efforts for the purpose
of interacting to combat illegal and dangerous drugs relating to the Houston High Intensity
Drug Trafficking Area (HIDTA) Initiative. FBI Safe Streets Task Force -delineating the
responsibilities of the Houston Costal Safe Streets Task Force participants, maximizing
interagency cooperation and formalizing relationships between participating agencies.
Pasadena Police Department- makes available the services ofthe SWATteam and Crisis
Negotiation Team as authorized and formalizes the responsibilities and procedures to be
addressed when a public safety risk from a SWAT incident exists. United States Coast Guard -
mutual aid agreement simplifying and streamlining the request and response process in
requesting the USCG Canine Explosives Detection Team (CEDT). City of Galveston - a mutual
aid law enforcement agreement securing the specialized equipment,facilities and trained
personnel of the respective departments are available to each other as requested and required.
Continuation Projects:

The City of Friendswood proposes to retrofit and convert a Ford F45o chassis and box truck
into an Emergency Response Vehicle utilizing the services of a turnkey manufacturer.To keep
costs to a minimum,the department is recommending a retrofit ofthis non-traditional vehicle
rather than the purchase of an armored transport vehicle in order to cut costs by about 75%.
Most agencies tactical response vehicles usually cost in excess of�z5o,000 due to the multiple
specialty uses for the vehicle.The Friendswood Police Department responds to critical, high-
risk situations requiring rapid response with specialized equipment.The benefits of retrofitting
the vehicle would allow for the safe and efficient transport of up to 14 fully outfitted tactical
team members and their equipment to incident scenes. During FY zozo,the police department
purchased a zoio Ford F4So Van for use in high-risk tactical situations.A heavy-duty, high-
occupancy vehicle is needed to handle emergency situations, disasters and call outs where
extended service manpower utilization is needed.The usability of the vehicle has been
hindered since its purchase due to its limited storage areas, seating areas and emergency
lighting.These issues can be fixed but require costly expenditures.Without the retrofit,the use
of the ERV will remain limited.The emergency response vehicle was purchased to provide a
platform to store critical equipment and serve as an inner perimeter Command Post.The
proposed retrofit offers a better interior design and space utilization, emergency light and
crime scene lighting, and would enable assigned officers to deploy and efFectively manage
emergency situations. It is critical for the police department to have a reliable, practical truck
ready to rapidly transport specialized equipment designed to bring high-risk incidents to a
peaceful conclusion.There are no other known sources of funding for this specific project,
including City resources.This project is an affordable option that will produce a vehicle that is
very versatile and capable of handling anyjob. It is cost effective, safe, efficient,versatile and
reliable. It will be a custom vehicle tailored to fit our specific needs and applications.The use of
an Emergency Response Vehicle has changed over the years and it is a critical component of
the Department's rapid tactical response to a wide variety of high-risk incidents. Its uses
include response to the rescue of injured persons and police ofFicers, increased security for
officers during the service of high risk search and arrest warrants, hostage/barricaded persons
and homeland security responders to major incidents. Past uses have included hurricanes,
floods, child abductions, special events, and other situations involving tactical readiness.
Designated officers are placed on call and assigned to maintain a level of readiness where the
vehicle can be used in a timely manner.This vehicle will not be an armored transport vehicle.

However,the ERV allows for additional safety measures in the event that personnel need to
transport into a high-risk dynamic tactical situation. Equipment housed in the ERV, such as
ballistic blankets,will provide the cover needed in these types of situations.The vehicle will be
used primarily to safely move personnel and officers in dangerous situations, not battering
down doors. Retrofitting the emergency response vehicle will increase the effectiveness and
safety of responding officers.A more rapid and safer response is critical to the successful and
safe conclusion of high-risk incidents. In the event of a major tactical incident,the mutual aid
use ofthe vehicle can and will be made available to any other regional law enforcement agency
requesting mutual aid assistance.This includes deployment of officers and resources. In the
event that the ERV is requested, area agencies are familiar with each others capabilities and
limitations and have trained in the use and deployment of the mutual aid response.The City of
Friendswood has sufficient high-risk incidents tojustify its own emergency response vehicle.
And once complete,the interior compartment will be capable of housing the logistics needs of
the SWAT team. Nevertheless, if we are unable to respond effectively, it negatively affects our
ability to provide mission critical services for our community as well as those communities to
whom we provide mutual aid.The scope of the project includes a retrofit of the exterior and
interior of the vehicle.This wil) entail installation of street side and curb side exterior running
boards with non-skid extruded aluminum steps with upper mounted hard rails; rebuild rear
bumper with heavy duty style and rear receive hit and 7-pole trailer connector; install heavy

transport, disposal, and recycling components of subsections numbered (5) and (6),
immediately above, in order to ensure proper compliance; (8) have in place and/or
implement any required written agreements with the Texas Department of Protective
and Regulatory Services regarding the safety of any minors located at the clandestine
laboratory site, the Texas Commission for Environmental Quality, and other entities
deemed necessary by the State Administrative Agency.
1z. COMPLIANCE WITH LAWS AND GUIDES - It will comply, and assure the compliance
of all its sub grantees and contractors, with the applicable provisions of Title I of the
Omnibus Crime Control and Safe Streets Act of ig68, as amended, the Juvenile Justice
and Delinquency Prevention Act, or the Victims of Crime Act, as appropriate; the
provisions of the current edition of the Office of Justice Programs Financial and
Administrative Guide for Grants, M7ioo.1; and all other applicable Federal laws, orders,
circulars, or regulations.
i3. COMPLIANCE WITH CODE OF FEDERAL REGULATIONS - It will comply with the
provisions of z8 CFR applicable to grants and cooperative agreements including Part
18, Administrative Review Procedure; Part zo, Criminal Justice Information Systems;
Part zz, Confidentiality of Identifiable Research and Statistical Information; Part z3,
Criminal Intelligence Systems Operating Policies; Part 30, Intergovernmental Review of
Department of Justice Programs and Activities; Part 4z, Nondiscrimination/ Equal
Employment Opportunity Policies and Procedures; Part 6i, Procedures for
Implementing the National Environmental Policy Act; Part 63, Floodplain Management
and Wetland Protection Procedures; and Federal laws or regulations applicable to
Federal Assistance Programs.
i4. NONDISCRIMINATION—
A. It will comply with all State and Federal statutes relating to nondiscrimination.
B. It will comply, and all its contractors will comply, with the nondiscrimination
requirements which may include the Omnibus Crime Control and Safe Streets Act
of i968 (4z USC § 378g(d)); Victims of Crime Act (4z U.S.C. § io6o4(e)); Juvenile
Justice and Delinquency Prevention Act of Zooz (4z U.S.C. § 567z(b)); the Civil
Rights Act of ig64 (4z U.S.C. § z000d); the Rehabilitation Act of 1973 (zg U.S.C. § 7
94); the Americans With Disabilities Act (ADA) of i990 (4z U.S.C. g izi3i-34); the

Education Amendments of i97z (U.S.C. g§ z68i, 1683, i685-86); the Age
Discrimination Act of z975 (4z U.S.C. §§ 6ioi-o7); and z8 CFR 38 (Equal Treatment
for Faith-Based Organizations); see Ex. Order z3z79 (equal protection of the laws
forfaith-based and communityorganizations).
C. In the event a federal or state court or federal or state administrative agency makes
a finding of discrimination after a due process hearing on the grounds of race, color,
religion, national origin, sex, or disability against a recipient of funds, the recipient
will forward a copy of the finding to the Office of Justice Programs, Office for Civil
Rights.
D. It will provide an Equal Employment Opportunity Program (EEOP) if required to
maintain one, where the application is for $500,000 or more (or �i,000,000 in an
i8-month period)and the applicant has 50 or more employees.
E. It will maintain EEOP on file for review when the application is for more than
$z5,000 but less than �500,00o and the applicant has 50 or more employees.
i5.COASTAL BARRIERS - It will comply with the provisions of the Coastal Barrier
Resources Act (z6 USC § 35os., et seq.) which prohibits the expenditure of most new
Federal funds within the units of the Coastal Barrier Resources System.
i6.SUPPLANTING PROHIBITION - It will use funds to supplement existing funds for
program activities and may not replace (supplant) non-Federal funds that have been
appropriated for the same purpose. The applicant understands that potential
supplanting will be the subject of monitoring and audit. Violations can result in a range
of penalties, including suspension of future funds under this Program, suspension or
debarment from Federal grants, recoupment of monies provided under this grant, and
civil and/or criminal penalties.
i7.TAXES — It will comply with all State and Federal laws and are solely responsible for
filing all required State and Federal tax forms.
i8.GRANT ADMINISTRATION - It will maintain an appropriate grant administration
system to ensure that all terms, conditions and specifications of the grant, including
these standard assurances, are met.
ig.PUBLIC INFORMATION - It will ensure that all information collected, assembled or
maintained by the applicant relative to a project will be available to the public during
normal business hours in compliance with Texas Government Code, Chapter 55z, unless
otherwise expressly prohibited by law.
zo.CHILD SUPPORT PAYMENTS — It will comply with Section z3i.006, Texas Family
Code, which prohibits payments to a person who is in arrears on child support
payments.
zi.SUSPECTED CHILD ABUSE - It will comply with Section z6i.io1 of the Texas Family
Code, which requires reporting of all suspected cases of child abuse to local law
enforcement authorities and to the Texas Department of Child Protective and
Regulatory Services. Grantees shall also ensure that all program personnel are properly
trained and aware of this requirement.
zz.RELATIVES - It will comply with Texas Government Code, Chapter 573, by ensuring
that no officer, employee, or member of the applicant's governing body or of the

applicant's contractor shall vote or confirm the employment of any person related
within the second degree of affinity or the third degree of consanguinity to any member
of the governing body, or to any other officer or employee authorized to employ or
supervise such person. This prohibition shall not prohibit the employment of a person,
who shall have been continuously employed for a period of two years, or such other
period stipulated by local law, prior to the election or appointment of the ofFicer,
employee, or governing body member related to such person in the prohibited degree.
z3.OPEN MEETINGS - If the applicant is a governmental entity, it will comply with Texas
Government Code, Chapter 55i, which requires all regular, special or called meeting of
governmental bodies to be open to the public, except as otherwise provided by law or
specifically excluded in the Texas Constitution.
z4.HEALTH, HUMAN SERVICES, PUBLIC SAFETY OR LAW ENFORCEMENT AGENCY
- If the applicant is a health and human services agency or public safety or law
enforcement agency, it will not contract with or issue a license, certificate or permit to
the owner, operator or administrator of a facility if the license, permit or certificate has
been revoked by another health and human services agency or public safety or law
enforcement agency.
zS.LAW ENFORCEMENT AGENCY - If the applicant is a law enforcement agency
regulated by Texas Government Code, Chapter 415, it will comply with all rules adopted
by the Texas Commission on Law Enforcement Officer Standards and Education
pursuant to Texas Government Code, Chapter 4i5, or it must provide the Criminal
Justice Division with a certification from the Texas Commission on Law Enforcement
Officer Standards and Education stating that the agency is in the process of achieving
compliance with such rules.
CERTIFICATIONS
i. DRUG-FREE WORKPLACE - The applicant certifies that it will provide a drug-free
workplace by:
A. Publishing a statement notifying employees that the unlawful manufacture,
distribution, dispensing, possession, or use of a controlled substance is prohibited in
the grantee's workplace and specifying the actions that will be taken against
employees for violation of such prohibition.
B. Establish a drug-free awareness program to inform employees about:
i. the dangers of drug abuse in the workplace;
ii. the applicant's policy of maintaining a drug-free workplace;
iii.any available drug counseling, rehabilitation, and employee assistance programs;
and
iv.the penalties that may be imposed upon employees for drug abuse violations.
C. Making it a requirement that each employee to be engaged in the performance of
the grant be given a copy of the statement required by paragraph (a).
D. Notifying the employee in the statement required by paragraph (a) that, as a
condition of employment underthe grant,the employee will:
i. abide by the terms of the statement, and

ii. notify the employer of any criminal drug statute conviction for a violation
occurring in the workplace not later than five days after such conviction.
E. Notifying the agency within ten days after receiving notice under subparagraph (d)
(ii)from an employee or otherwise receiving actual notice of such conviction.
F. Taking one of the following actions with respect to any employee who is so
convicted:
i. taking appropriate personnel action against such an employee, up to and
including termination; or
ii. requiring such employee to participate satisfactorily in drug abuse assistance or
rehabilitation program approved for such purposes by a federal, state, or local
health, law enforcement, or other appropriate agency.
G. Making a good faith effort to continue to maintain a drug-free workplace through
the implementation of paragraphs(a), (b), (c), (d), (e), and (f�.
z. LOBBYING—The applicant certifies that:
A. It will not use grant funds, either directly or indirectly, in support of the enactment,
repeal, modification, or adoption of any law, regulation or policy, at any level of
government,without the express prior approval of the Criminal Justice Division.
B. If any non-grant funds have been or will be used in support of the enactment,
repeal, modification, or adoption of any law, regulation or policy, at any level of
government, it will notify the Criminal Justice Division to obtain the appropriate
disclosure form.
C. It will include the language of paragraphs A. and B. of this section in the award
documents for all sub-awards at all tiers and will require all sub-recipients to certify
accordingly.
