ORDINANCE NO. 2011-03 AN ORDINANCE AMENDING CITY OF FRIENDSWOOD, TEXAS, ORDINANCE NO. 2010-28, PASSED AND APPROVED OCTOBER 4, 2010, SAME BEING AN ORDINANCE APPROVING AND ADOPTING THE CITY'S GENERAL BUDGET FOR FISCAL YEAR 2010-2011 BY APPROVING "BUDGET AMENDMENT H" TO THE "ORIGINAL GENERAL BUDGET OF THE CITY OF FRIENDSWOOD, TEXAS, FOR THE FISCAL YEAR 2010- 2011"; PROVIDING FOR SUPPLEMENTAL 1 APPROPRIATION AND/OR TRANSFER OF CERTAIN FUNDS; PROVIDING FOR SEVERABILITY; AND PROVIDING OTHER MATTERS RELATED TO THE SUBJECT. f� WHEREAS, by Ordinance No. 2010-28, the City Council of the City of Friendswood; Texas, adopted its"Original General Budget for Fiscal Year 2010-2011"; and WHEREAS, the City Council has determined that revenues and/or reserves are available for supplemental appropriation, and/or that the transfer of certain funds interdepartmentally i economically feasible and in the best interest of prudent budgeting and for municipal purposes; and WHEREAS, Section 8.04 of The City Charter provides for amendments after adoption of the budget; and WHEREAS, the City Council desires to amend said Original General Budget to reflect such supplemental appropriation and/or transfer in the fiscal year 2010-2011; now,therefore, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FRIENDSWOOD, STATE OF TEXAS: Section 1. The facts and matters set forth in the preamble of this Ordinance are hereby found to be true and correct. Section 2. The "Original General Budget of the City of Friendswood, Texas, for the Fiscal Year 2010-2011," is hereby amended for municipal purposes as shown on "BudgeI Amendment IF' to the "Original Budget of the City of Friendswood, Texas, For the Fiscal year 2010-2011" attached hereto. Said Budget Amendment II shall be attached to and made a part of such Original General Budget by the City Secretary and shall be filed as required by state law, a true and correct copy of which is attached hereto as Exhibits "A"and "B" and made a part hereof for all purposes. Section 3. In the event any clause,phrase,provision, sentence, or part of this ordinance or the application of the same to any person or circumstance shall for any reason be adjudged invalid or held unconstitutional by a court of competent jurisdiction, it shall not affect, impair, of invalidate this ordinance as a whole or any part or provision hereof other than the part declared to be invalid or unconstitutional; and the City Council of the City of Friendswood, Texas, declares that it would have passed each and every part of the same notwithstanding the omission of any such part thus declared to be invalid or unconstitutional,whether there be one or more parts. Fiscal Year 2010 — 2011 Budget Amendment 11 February 7, 2011 1. Library Generator. $62,458. Appropriate funds in advance for the purchase of a generator for the Library. The Hazard Mitigation Grant program (HMGP) was awarded by the Federal Emergency Management Agency (FEMA) on September 27, 2010. The FEMA grant portion is 75% ($46,484) with the City matching of 25% ($15,974). The grant award acceptance and bid award was approved by City Council on January 17, 2011. The funding source for the expenditure has been identified as undesignated general fund balance. The estimated grant award from FEMA of$46,484 will reimburse undesignated general fund balance used for the project. 2. Loan Star Library Grant, $14,097. Appropriate grant awarded funds from the Texas State Library and Archives Commission to the Friendswood Public Library! Funds will be used to purchase Library books, videos, audio books, and CD's. The grant funds were received on January 14, 2011. The grant period is October } 1, 2010 through September 20, 2011. 3. Program 380 Economic Development Grant (Hometown Bank Developers), 15 000. Appropriate designated general fund balance reserves to Hometown Bank Developers for the Program 380 Economic Development Grant. The economic development agreement, dated May 3, 2010, between the City of Friendswood and Hometown Bank Developers was for reimbursement of costs related to construction and development including downtown landscaping improvements upon project completion and certification of occupancy. The HomeTown Bank project is located in the City's Downtown Neighborhood Empowerment Zone. The occupancy certification was issued on January 4, 2011. 4. Recreation Program Fees, $1880. Appropriate funds generated from Zumba classes offered by the Community Service Recreation Program. The funds will be used to offset instructor fees and class supplies used in the Recreation Program's operating budget. 5. Police Department Animal Control Donation, $250. Appropriate funds donated to the Police Department Animal Control Division. The funds were received January 13, 2011 and will be used for Animal Control division operating services. 2011 BA 11-Exhibit A-02 07 11-REVISED Exhibit A Page 2 6. BP Fabric of America Fund Donation, $300. Appropriate funds donated to the Friendswood Police Department. The funds will be used by the Animal Control division for training. Funds were received on January 4, 2011. 7. Community Services Parks Administration Recycling, $1,107. Appropriate i funds received from the sale of scrap metal. The funds will be used for the Parks Administration operating supplies expenditures. 8. Friendswood Volunteer Fire Department— Blood pressure monitors, ; 13 695. Re-appropriate funds for five non-invasive blood pressure monitors. The equipment was originally ordered in September of 2007. Due to a freeze on equipment updates by Federal Drug Administration, the shipment was placed on j back order and the original purchase order issued for the equipment was canceled. The funds lapsed into fund balance in 2008 and again in 2009. Items on back-order until June 2010 were received in July 2010. 9. Tax Debt Service 2010 GO Bond.Principal and Interest Payment, $179,771. Appropriate Tax Debt Service Fund Balance for initial principal and interest payments on the 2010 General Obligation Bond issue. During fiscal year 2010- 11 budget development, staff anticipated a possible issue of the General Obligation Bonds authorized in 2003.
