14-FOOT WIDE UTILITY EASEMENT

§ KNOW ALL BY THESE PRESENTS:
COUNTY OF GALVESTON §
That FERNANDEZ FAMILY TRUST ("Grantor(s)"[whether one or more]), for and
in consideration of the sum of One and No/100 Dollars ($1.00) cash to it in hand
paid by the City of Friendswood, Galveston County, Texas, the receipt of which is
hereby acknowledged and the further consideration of the benefits to be received
from the proposed improvements, do hereby GIVE and GRANT unto the said
City of Friendswood ("Grantee"), a Municipal Corporation, of Galveston County,
Texas, the perpetual privilege, right, and easement (the "Easement") in and to
those certain lots, tracts, or parcels of land situated in the County of Galveston,
State of Texas, and more particularly depicted in Exhibit "A" attached hereto and
incorporated herein by reference (the "Easement Area").
The Easement hereby granted is for the purpose of giving to Grantee, its
successors and assigns (including its franchised or authorized utilities), the right
to construct, reconstruct, alter, rebuild, and perpetually maintain utility facilities
over, under, upon, across and within the Easement Area together with the right to
enter the Easement Area to inspect, operate, repair, replace, and remove those
utility facilities.
TO HAVE AND TO HOLD the above described rights, together with all and
singular the appurtenances thereto in anywise belonging unto the City of
Friendswood, its successors and assigns, so long only as said property is used
by Grantee for the purposes above named, but it is understood and made a part
of this conveyance, that Grantor retains for itself, its successors and assigns, all
rights to said tract not inconsistent with this Grant.
