R2010-37 A RESOLUTION APPROVING THE CONSTRUCTION AND OPERATION OF AN ANIMAL CONTROL FACILITY ON A 3.299 ACRE TRACT OF LAND LOCATED AT 2910 WEST PARKWOOD AVENUE, FRIENDSWOOD, TEXAS; MAKING FINDINGS REQUIRED BY TEXAS PARKS & WILDLIFE CODE CHAPTER 26 FOR A CHANGE IN USE OF PARK OR RECREATION LAND ASSOCIATED WITH THE PROJECT; PROVIDING THAT THIS RESOLUTION SHALL BECOME EFFECTIVE FROM AND AFTER ITS PASSAGE AND ADOPTION. * * * * * * * � � WHEREAS, the City intends to locate its animal control facility at 2910 West Parkwood Avenue, Friendswood, Texas 77546, (also described as being a 3.299 acre tract of land situated in the Beatty, Seale and Forwood Survey, TR 3-1, Abstract No. 625, Page 1 and 2, Galveston County, Texas); and WHEREAS, the City intends to improve this site and construct a new Animal Control Facility, access drives, parking for 8 to 12 cars, outdoor pen areas, and a covered and secure animal drop-off area at the back of the building; and WHEREAS, the site may be considered to be part of the Friendswood Sportspark property, which is used as a park and recreation area; and WHEREAS, the City intends to no longer hold or claim this site as a park or recreation area but seeks to change the use to an animal control facility use; and WHEREAS, the Texas Parks & Wildlife Code Chapter 26 requires notice and a hearing before approval of any program or project that requires the use of land designated or used as a park or recreation area; and WHEREAS, City Council has provided notice (a copy of which is attached as Exhibit A hereto) and held a public hearing on October 4, 2010, to consider approval of said project; and BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FRIENDSWOOD,TEXAS: SECTION 1: That the City Council of the City of Friendswood, Texas, hereby approves the construction of a new Animal Control Facility, access drives, parking for 8 to 12 cars, outdoor pen areas, and a covered and secure animal drop-off area at the back of the building at 2910 West Parkwood Avenue, Friendswood, Texas 77546 (Project). The site of the Project is shown in Exhibit B, attached hereto and incorporated herein. SECTION 2: In approving the Project, the City Council has considered clearly enunciated local preferences and hereby determines that: (1) there is no feasible and prudent alternative to the use or taking of such land; and (2)the program or project includes all reasonable planning to minimize harm to the land, as a park, recreation area, scientific area, wildlife refuge, or historic site, resulting from the use or taking.
