ORDINANCE NO. 2010-25 AN ORDINANCE AMENDING CITY OF FRIENDSWOOD, TEXAS, ORDINANCES NO. 136 AND NO.2001-24,WHICH GRANTED AND AMENDED A SPECIFIC USE PERMIT FOR -PROPERTY LOCATED AT 606 CEDARWOOD DRIVE TO BE USED FOR MARY QUEEN CHURCH, BY ALLOWING THE ADDITION OF AN APPROXIMATE 37,438 SQ FT CHURCH AND ASSOCIATED PARKING AND LANDSCAPING IMPROVEMENTS; PROVIDING A PENALTY OF AN AMOUNT NOT TO EXCEED $2,000 FOR EACH DAY OF VIOLATION OF ANY PROVISION HEREOF; AND PROVIDING FOR SEVERABILITY. WHEREAS, pursuant to Ordinance No. 136, the City Council granted a Specific Use Permit to the Catholic Diocese of Galveston-Houston for Mary Queen Catholic Church; and WHEREAS,pursuant to Ordinance No. 2001-24, the City Council amended the Specific Use Permit granted to the Catholic Diocese of Galveston-Houston for Mary Queen Church by Ordinance No. 136; and WHEREAS,the property is currently developed with 6 buildings; and WHEREAS, the Applicant is seeking to amend the Specific Use Permit in order to add a 3 7,43 8 sq ft church and associated parking and landscaping improvements; and WHEREAS, the Planning and Zoning Commission and the City Council havl conducted, in the time and manner required by law and the Zoning Ordinance of the City, a public hearing on such request; and i WHEREAS, the Planning and Zoning Commission has recommended approval of the proposed amendments and the City Council deems it appropriate to grant such request, subject to certain regulations, restrictions, and conditions; now, therefore, I I BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FRIENDSWOODI STATE OF TEXAS: Section 1. The facts and matters set forth in the preamble of this Ordinance are i hereby found to be true and correct. Section 2. City of Friendswood, Texas, Ordinance No. 136 and Ordinance No. 20017 24, granting and amending a Specific Use Permit to the Catholic Diocese of Galveston-Houston for Mary Queen Catholic Church, located at 606 Cedarwood Drive, is hereby amended as set forth below: A. The addition of an approximate 37,438 sq ft church and associated parking and landscaping improvements is approved. B. The acreage of the total development shall be increased by an additional 2.04 acres (to the original acreage of Ordinance No. 2001-24 SUP of 13.891 acres). C. The allowable height of the new addition shall be 57 feet and 3 %Z inches. D. The landscape buffer shall not be required in front of the existing rectory. E. The site development plan dated October 18, 2001, shall be updated to reflect the approved addition and other changes listed herein. F. Except as expressly stated herein, Ordinance No. 136 and Ordinance No. 2001-24 shall remain in full force and effect. Section 3. The Zoning District Map of the City of Friendswood shall be revised and amended to show the designation of the Property, as described and as provided in Section 2 above, with the appropriate reference thereon to the number and effective date of this Ordinance) and a brief description of the nature of the change. Section 4. Any person who shall violate any provision of this Ordinance shall be deemed guilty of a misdemeanor and upon conviction, shall be fined in an amount not to exceed $2,000.00. Each day of violation shall constitute a separate offense. Ord.2010-25 2 Section 5. In the event any section, paragraph, subdivision, clause, phrase, provision; sentence, or part of this Ordinance or the application of the same to any person or circumstance shall for any reason be adjudged invalid or held unconstitutional by a court of competent jurisdiction, it shall not affect, impair, or invalidate this Ordinance as a whole or any part of provision hereof other any part or provision hereof other than the part declared to be invalid of unconstitutional; and the City Council of the City of Friendswood, Texas, declares that it would) have passed each and every part of the same notwithstanding the omission of any and every part of the same notwithstanding the omission of any such part thus declared to be invalid o unconstitutional, or whether there be one or more parts.
