ORDINANCE NO.2010-19 AN ORDINANCE REPEALING ORDINANCE NO. 70 WHICH DECLARED A SCHOOL SPEED ZONE AND FIXED THE PRIMA FACIE SPEED LIMIT AT 25 MPH ALONG FM 518, FROM A POINT FIFTY FEET NORTHWEST OF MAGNOLIA AVENUE, TO A POINT FIFTY FEET SOUTHEAST OF SPREADING OAKS AVENUE, A DISTANCE OF APPROXIMATELY 0.199 MILES; FIXING THE NEW PRIMA FACIE SPEED LIMIT AT 30 MPH; PROVIDING A PENALTY OF AN AMOUNT NOT TO EXCEED $200 FOR EACH VIOLATION OF ANY PROVISION HEREOF; AND PROVIDING FOR SEVERABILITY. WHEREAS, Ordinance No. 70 declared a school speed zone and fixed the speed limit at 25 mph along FM 518 from Magnolia Avenue to Spreading Oaks Avenue (a distance of approximately 0.199 miles); and WHEREAS, the school speed zone was declared in connection with the establishment of the junior high school; and I WHEREAS, the purposes for the establishment of a school speed zone at this location no longer exist; and WHEREAS, the City Council of the City of Friendswood, Texas, deems it in the best interest of the citizens of Friendswood to repeal Ordinance No. 70 and determine and declare a reasonable and safe prima facie speed limit thereat at 30 mph, which shall be effective when appropriate signs giving notice thereof are erected at such place or part of the street or highwa ; now therefore, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FRIENDSWOOD, STATE OF TEXAS: Section 1. Ordinance No. 70 declaring a school speed zone and fixing the speed limit at 25 mph along FM 518 from a point fifty feet northwest of Magnolia Avenue, to a point fifty feet southeast of Spreading Oaks Avenue, a distance of approximately 0.199 miles, is hereby repealed. Section 2. The prima facie speed limit for vehicles is hereby determined and declared , to be reasonable and safe and such speed limit is hereby fixed at the rate of speed indicated for vehicles traveling upon the following named street, or part thereof, described as follows: (A) Along FM 518 from a point fifty feet northwest of Magnolia Avenue, to a point fifty feet southeast of Spreading Oaks Avenue, a distance of approximately 0.199 miles,the speed limit shall be 10 MPH". Said speed limit shall be effective when appropriate signs giving notice thereof are erected at j such place or part of the street or highway. I Section 3. Any person violating any provisions of this Ordinance shall by deemed guilty of a misdemeanor and, upon conviction thereof, shall by fined in any sum not less than One Dollar($1.00)nor more than Two Hundred Dollars ($200.00). Section 4. In the event any section, paragraph, subdivision, clause, phrase, provision, sentence, or part of this Ordinance or the application of the same to any person or circumstance shall for any reason be adjudged invalid or held unconstitutional by a court of competent l jurisdiction, it shall not affect, impair, or invalidate this Ordinance as a whole or any part or provision hereof other any part or provision hereof other than the part declared to be invalid or unconstitutional; and the City Council of the City of Friendswood, Texas, declares that it would' have passed each and every part of the same notwithstanding the omission of any and every part of the same notwithstanding the omission of any such part thus declared to be invalid or unconstitutional, or whether there be one or more parts.
