ORDINANCE NO. 2010-13
AN ORDINANCE AMENDING THE CODE OF
ORDINANCES OF THE CITY OF FRIENDSWOOD, TEXAS,
CHAPTER 30 "FIRE PROTECTION AND PREVENTION",
ARTICLE III. "FIRE CODES" BY ADOPTING THE 2009
INTERNATIONAL FIRE CODE AND THE 2009 LIFE
SAFETY CODE; ADOPTING LOCAL AMENDMENTS
THERETO; PROVIDING OTHER MATTERS RELATING TO
THE SUBJECT; PROVIDING A PENALTY OF AN AMOUNT
NOT TO EXCEED $2,000 FOR EACH DAY OF VIOLATION
OF ANY PROVISION HEREOF; AND PROVIDING FOR
SEVERABILITY.
WHEREAS, the City Council deems it necessary and appropriate for the health, safety
and welfare of the citizens to approve certain amendments to the City's Code of Ordinances to
update the city's fire and safety codes and adopt local amendments;
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY FRIENDSWOOD, STATE
OF TEXAS: 1
Section 1. The facts and matters set forth in the preamble of this Ordinance are

hereby found to be true and correct.
Section 2. Article III of Chapter 30. "Fire Protection and Prevention", Division 2, of
the Code of Ordinances of the City of Friendswood, Texas, which adopted the International Fire
Code, 2003 Edition, together with certain amendments thereto, is hereby amended as set forth
below. Words being deleted are indicated by brackets and strike throughs, as follow)
"[deleted]." Words being added are indicated by underline, as follows: "underline." Additions
to words or phrases underscored in the existing ordinance text are indicated by a doublle
underline, as follows: "ordinances."
"ARTICLE III. FIRE CODES
DIVISION 1. GENERALLY
Secs. 30-56--30-83. Reserved.
DIVISION 2. INTERNATIONAL FIRE CODE*
*State law references: Fire protection, V.T.C.A., Local Government Code § 342.001 et seq.
Sec. 30-84. International Fire Code adopted; amendments.
The International Fire Code, 2009 [2-0 3] Edition, including appendices B, C, D, E, F, G, H, I,
1 as published by the International Code Council, Inc., an authentic copy of which has been
filed with the city secretary, is hereby adopted and made a part of this division, except as
follows:
(1) Section 101.1 is hereby amended to read as follows:
101.1 Title. These regulations shall be known as the Fire Code of the City of Friendswood,
Texas,hereinafter sometimes referred to as "this code."
(2) Section 102.7 [402.6] is hereby amended to read as follows:
102.7 Referenced codes and standards. The codes and standards referenced in this code shall be�
those that are listed in chapter 47 {4-5] hereof, and such codes and standards shall be considered%
part of the requirements of this code to the prescribed extent of each such reference. Where)
differences occur between the provisions of this code and the referenced standards, thel
provisions of the most restrictive shall apply. Whenever amendments have been adopted to the
referenced codes and standards, each reference to said code and standard shall be considered to
reference the amendments as well.
(3) Section 108.1 is hereby amended to read as follows:
108. Board of appeals. The city zoning board of adjustment and appeals shall act as the fire and
life safety code board of adjustment and appeals.
(4) Section 109.3 is hereby deleted in its entirety.
(5) Section 507.5.1 [5074N] is hereby amended to read as follows:
507.5.1 [507 549] Where required. Where a portion of the facility or building hereafter
constructed or moved into or within the jurisdiction is more than 300 feet from a hydrant on a
fire apparatus access road, as measured by an approved route around the exterior of the facility,
or building, on-site fire hydrants and mains shall be provided where required by the code official!
(6) Section 903.2 is hereby amended to read as follows:
903.2. Where required. Approved automatic sprinkler systems in new buildings and structures
shall be provided in the locations described in this section or when the gross square footage of
the building or structure exceeds 11,999 square feet.
(7) Section 912.2 is hereby amended to read as follows:

912.2 Location. With respect to hydrants, driveways, buildings and landscaping, fire
department connections shall be so located that fire apparatus and hose connected to
supply the system will not obstruct access to the buildings for other fire apparatus. The
location of fire department connections shall be approved by the fire code official.
(8) Section 912.2.1 is hereby amended to read as follows:
912.2.1 Visible location. Fire department connections shall be located on the street side of,
buildings, fully visible and recognizable from the street or nearest point of fire department
vehicle access or as otherwise approved by the fire code official.
(9) Section 912.3 is hereby amended to read as follows:
912.3 Access. Immediate access to fire department connections shall be maintained at all'
times and without obstruction by fences, bushes, trees,walls or any other fixed or movable
obiect. Access to fire department connections shall be approved by the fire code official.
Exception: Fences, where provide with an access gate equipped with a sign
complying with the legend requirements of Section 912.4 and a means of emergencv.

code official and maintained operational at all times.
(10) Section 912.3.2 is hereby amended to read as follows:
912.3.2 Clear space around connections. Working space of not less than 36 inches (762 min)
in width, 36 inches (762 mm) in depth and 78 inches (1981 nun) in height shall be provided
and maintained in front of and to sides of wall-mounted fire department connections and
around the circumference of free-standing fire department connections, except as
otherwise required or approved by the fire code official.
Sec. 30-85. Applicable definitions.
(a) Wherever the word "municipality" is used in the International Fire Code [intematieaal fire
eede], it shall be held to mean this city.
(b) Wherever the term "corporation counsel" is used in the international fire code, it shall be
held to mean the city attorney.
(c) Wherever the term "fire code official" is used in the international fire code, it shall mean the
fire marshal of the city.

Sec. 30-86. New materials,processes or occupancies which require permits.
The city council, city manager and the fire marshal shall act as a committee to determine and
specify, after giving affected persons an opportunity to be heard, any new materials,processes or
occupancies which shall require permits, in addition to those now enumerated in the International
Fire Code. The fire marshal shall post such list in a conspicuous place in his office, and distribute
copies thereof to interested persons.
Sec. 30-87. Penalty for violation of article.

Any person who shall violate or cause to be violated any provision of this article or any code
adopted hereby, or who shall fail to comply therewith or with any of the requirements thereof,
shall, upon conviction thereof, be punished pursuant to section 1-14.

Section 3. Article III of Chapter 30. "Fire Protection and Prevention", Division 3, ofi
the Code of Ordinances of the City of Friendswood, Texas, which adopted the Life Safety Code,
2003 Edition, together with certain amendments thereto, is hereby amended as follows:
"DIVISION 3. LIFE SAFETY CODE
Sec. 30-118. Life Safety Code adopted.
The 2009 [2,0�] Edition of the Life Safety Code, including all appendices thereto, as published
by the National Fire Protection Association, Inc., an authentic copy of which has been filed with
the city secretary, is hereby adopted and made apart of this division, except as follows:
Section 24.3.5.1 is deleted of Chapter 24, One and Two-Family Dwellings, Extinguishment
Requirements.
Sec. 30-119. Penalty for violation of article.
Any person violating any provision of this article shall, upon conviction thereof, be punished
pursuant to section 1-14.
See. 30-120. Appeals.
Whenever the fire marshal shall disapprove an application or when it is claimed that the
provisions of the Life Safety Code do not apply or that the true intent and meaning of such code
have been misconstrued or wrongly interpreted, the applicant may appeal from the decision of
the fire marshal to the building codes board of adjustments and appeals within 30 days from the
date of the decision appealed.

Section 4. Any person who shall knowingly, willingly, or with criminal negligent
violate any provision of this Ordinance shall be deemed guilty of a misdemeanor and upon'
conviction, shall be fined in an amount not to exceed $2,000.00. Each day of violation shall
constitute a separate offense.

Section 5. In the event any section,paragraph, subdivision, clause, phrase, provision,
sentence, or part of this Ordinance or the application of the same to any person or circumstance

shall for any reason be adjudged invalid or held unconstitutional by a court of competent
jurisdiction, it shall not affect, impair, or invalidate this Ordinance as a whole or any part or
provision hereof other any part or provision hereof other than the part declared to be invalid or

unconstitutional; and the City Council of the City of Friendswood, Texas, declares that it would
have passed each and every part of the same notwithstanding the omission of any and every part
of the same notwithstanding the omission of any such part thus declared to be invalid or
unconstitutional, or whether there be one or more parts.
