ORDINANCE NO.2010-05
AN ORDINANCE OF THE CITY OF FRIENDSWOOD, TEXAS,
FINDING AND DETERMINING THAT PUBLIC CONVENIENCE
AND NECESSITY NO LONGER REQUIRE THE CONTINUED
EXISTENCE OF A 19,999 SQUARE FOOT (0.4591 ACRE)TRACT
OF LAND,BEING ALL OF QUEENS LANE,LOCATED WITHIN
THE CITY OF FRIENDSWOOD, GALVESTON COUNTY,
TEXAS; VACATING, ABANDONING, AND CLOSING SAID
PUBLIC RIGHT-OF-WAY; AUTHORIZING THE MAYOR TO
EXECUTE AND THE CITY SECRETARY TO ATTEST,
RESPECTIVELY,- A QUITCLAIM DEED CONVEYING SAID
ABANDONED EASEMENT TO THE PROPERTY OWNER;
PROVIDING FOR SEVERABILITY; AND CONTAINING
OTHER PROVISIONS RELATING TO THE SUBJECT.
WHEREAS, the authorized representative of Mary Queen Catholic Church (Diocese of

Galveston—Houston),the adjacent property owner of the subject property,has petitioned the City of
Friendswood, Texas, to vacate, abandon, and close the hereinafter described right-of-way known
Queens Lane; and
WHEREAS, the City Council has determined that such public right-of-way is no longer
necessary for public convenience and necessity and should be vacated, abandoned,and closed;now
therefore;
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FRIENDSWOOD,
STATE OF TEXAS:
Section 1. The facts and recitations set forth in the preamble of this Ordinance are
hereby found to be true and correct.
Section 2. The City Council of the City of Friendswood, Texas, hereby finds and
determines that public convenience and necessity no longer require the continued existence of the
right-of-way known as"Queens Lane"and described in Section 3 hereof.
Section 3. The right-of-way known as Queens Lane, consisting of 19,999 square feet,

more particularly described and depicted in Exhibit "A" attached hereto and made a part hereof for
all purposes, located within the City of Friendswood, Galveston County, Texas, is hereby vacated„
abandoned,and closed.
Section 4. The Mayor and City Secretary are hereby authorized to execute and attest,
respectively, a quitclaim deed, conveying the hereinabove described abandoned easement to the
property owner.
Section 5. In the event any section, paragraph, subdivision, clause, phrase, provision,
sentence, or part of this ordinance or the application of the same to any person or circumstance
shall for any reason be adjudged invalid or held unconstitutional by a court of competent
jurisdiction, it shall not affect, impair, or invalidate this ordinance as a whole or any part or
provision hereof other than the part declared to be invalid or unconstitutional; and the CiJ
Council of the City of Friendswood, Texas, declares that it would have passed each and ever}
part of the same notwithstanding the omission of any such part thus declared to be invalid of
unconstitutional, or whether there be one or more parts.

All that certain 19,999.square feet bring all of Queens Lane as established by that certain deed
dated 09-23-1982 firm Most Reverend John L.Morkovsky,Bishop of the Diocese of Galveston-
Houston to Ralph Lowe, Mayor of the City of Friendswood as filed in the Official Records of
Real Property of Galveston County at Clerk's File Number 8302394 and that certain deed dated
12-22-1982 from Glynn S. Lunney, at ux. to City of Friendswood, Texas as filed in the Official
Records of Real Property of Galveston County at Clerk's File Number 8320393 and out of the
J.R. Williams League, Abstract 151, Friendswood, Galveston County, Texas, and being more
particularly described by metes and bounds as follows(bearings based on the record plat of Mary
Queen Catholic Church according to the plat thereof as filed in Volume 18,Page 1313 Galveston
County Map Records):
Commencing at a found 5/8" iron rod with cap (stamped HOVIS) marking the most easterly
north comer of Lot 1,Block 1,of said Mary Queen Catholic.Church, said point also marking the
intersection of the southwest right-of-way line Cedar Woad Drive (40' wide) and the southeast,
right-of-way line of Stones Throw; Thence S 44° 57' 25"E—330.12' with the southwest right-
of-way line of said Cedar Wood Drive to a set 5/8" iron rod with cap (stamped C.L. DAVIS
RPLS 4464)marking the POINT OF BEGINNING of herein described tract;
1. Thence S 440 58' 41" E—40.00' to a found 5/8" iron rod with cap (stamped HOVIS) for
comer;
2. Thence S 45° 02' 18"W 499.97' with the southeast right-of--way line of said Queens Lane
(40' wide) to a found 5/8"iron rod for comer;
3. Thence N 45'01''16"W—40.00' to a set"X"cut in concrete for comer;
4. Thence N 45° 02' 18"E—560.00' with the northwest right-of-way line of said Queens Lane
to the POINT OF BEGINNING and containing 19,999 square feet(0.4591 acre)of land more
or less.
This metes and bounds description is accompanied by a separate plat, drawing or exhibit per
Texas Board of Professional Land Surveyor's "General Rules of Procedures and Practices"
