AN ORDINANCE AMENDING CITY OF FRIENDSWOOD, TEXAS,
ORDINANCE NO. 2009-22, PASSED AND APPROVED OCTOBER 5,
2009, SAME BEING AN ORDINANCE APPROVING AND ADOPTING j
THE CITY'S GENERAL BUDGET FOR FISCAL YEAR 2009-2010, BY I
APPROVING "BUDGET AMENDMENT III" TO THE "ORIGINAL
GENERAL BUDGET OF THE CITY OF FRIENDSWOOD, TEXAS,
FOR THE FISCAL YEAR 2009-2010'; PROVIDING FOR
SUPPLEMENTAL APPROPRIATION AND/OR TRANSFER OF
CERTAIN FUNDS; PROVIDING FOR SEVERABILITY; AND
PROVIDING OTHER MATTERS RELATED TO THE SUBJECT.
WHEREAS, by Ordinance No. 2009-22, the City Council of the City of Friendswood,j
Texas, adopted its"Original General Budget for Fiscal Year 2009-2010"; and
WHEREAS,the City Council has determined that revenues and/or reserves are available.

for supplemental appropriation, and/or that the transfer of certain funds interdepartmentally is!
economically feasible and in the best interest of prudent budgeting and for municipal purposes;
and
WHEREAS, Section 8.04 of The City Charter provides for amendments after adoption
of the budget; and
WHEREAS, the City Council desires to amend said Original General Budget to reflect
such supplemental appropriation and/or transfer in the fiscal year 2009-2010; now,therefore,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FRIENDSWOOD,
STATE OF TEXAS:
Section 1. The facts and matters set forth in the preamble of this Ordinance are
hereby found to be true and correct.
Section 2. The "Original General Budget of the City of Friendswood, Texas, for the
Fiscal Year 2009-2010," is hereby amended for municipal purposes as shown on "Budget
- Amendment III" to the "Original Budget of the City of Friendswood, Texas, for the Fiscal year
t 2009-2010" attached hereto. Said Budget Amendment III shall be attached to and made a part of
such Original General Budget by the City Secretary and shall be filed as required by state law, a
true and correct copy of which is attached hereto as Exhibits"A" and`B" and made a part hereof
for all purposes.
Section 3. In the event any clause, phrase, provision, sentence, or part of this ordinance
or the application of the same to any person or circumstance shall for any reason be adjudged'
invalid or held unconstitutional by a court of competent jurisdiction, it shall not affect, impair, or;
invalidate this ordinance as a whole or any part or provision hereof other than the part declared to be
invalid or unconstitutional; and the City Council of the City of Friendswood, Texas, declares that itJ
would have passed each and every part of the same notwithstanding the omission of any such part
thus declared to be invalid or unconstitutional,whether there be one or more parts.

Budget Amendment Summary
Fiscal Year 2009 — 2010
Budget Amendment III
February 22, 2010
1 Prior Year Encumbrances. $1,936,789. Appropriate funds for purchase '
orders issued in fiscal year 2009 and outstanding at fiscal year end,
September 30, 2009. Goods and services for these purchase orders will be
received and expensed in 2010.
2 Prior Year Unencumbered Capital, $683,259. Re-appropriate funds fort
capital expenditures budgeted in fiscal year 2009; but not expensed at fiscal'
year end September 30, 2009. Goods and services will be received and;
expensed in 2010.
3 Donation for Police Department Ballistic Blankets, $2,000. Appropriate
funds donated to the Friendswood Police Department. As designated by the!
donor, the funds will be used to purchase two ballistic blankets. Funds were
received on December 30, 2009.
4 Hazard Mitiaation Grant. $49,737. Appropriate grant awarded funds to the'
Fire Marshal Emergency Management departmental accounts. The funding
will be used in fiscal year 2010 to purchase an emergency generator for the'
City Hall building. The grant period expires in September 2011. The grant
award acceptance and cost share match (75%/25%) was approved by City
Council on January 4, 2010.
5 City Hall Generator Cost Share Match. $16,579. Appropriate funds for the
25% cost share match of the Hazard Mitigation Grant to purchase and install
an emergency generator at the City Hall building. The grant award
acceptance and cost share match (75%/25%) was approved by City Council
on January 4, 2010. The funding source for the cost share match wag
identified as undesignated general fund balance.
6 FM 518 Downtown Drainage Project Easement, $1,500. Appropriate funds
for the acquisition of a drainage easement at Mary Queen Catholic Church.
City Council approved the drainage easement acquisition from th6
Archdiocese of Galveston-Houston on January 25, 2010. The funding source
for the easement purchase was identified as undesignated general fun
balance.
7 BP Fabric of America Fund Donation. $250. Appropriate funds donated to
the Friendswood Police Department. The funds will be used to purchase
operating equipment for the Animal Control division. Funds were received on
January 28, 2010.
8 Recovery Act Justice Assistance Grant, $19,848. Appropriate grant
awarded funds to the Police Department departmental accounts. The funding
will be used in fiscal year 2010 to purchase a digital video system server for
patrol in-car video equipment. The grant period expires in June 2010. The
grant award acceptance was approved by City Council on January 4, 2010.
Funds were received from Galveston County on January 28, 2010.

9 FM 518 Drainage Improvements, $2,578,191. Appropriate funds to
complete FM 518 drainage improvements. The partial funding for project was!
included in the Galveston County Bond Package approved in November of!
2008. On January 25, 2010, City Council awarded the construction contracts
in the amount of $2,428,191.12 plus $150,000 for materials testing and
contingencies to SER Construction Partners, Ltd. Galveston County's portion
of the cost is $1,578,191 and the City's portion of the cost is $1,000,000.,
The City will invoice Galveston County for its portion of the cost as expenses
are incurred. The funding source for the City's portion of the cost was'
identified as undesignated general fund balance.
10 Program 380 Economic Development Grant (Crystal Creek Developers,:.
-- LLC), $30,000. Appropriate funds for payment to Crystal Creek Developers;
LLC for the Program 380 Economic Development Grant. On January 14 1
2008, the City of Friendswood and Crystal Creek Developers, LLC signed the
economic development agreement for reimbursement of building fees
following the issuance of occupation certification and commercial lease of
25% of the facility. All requirements of the agreement have been met by the
developer. The funding source for the reimbursement is designated general
fund balance.
