R2009-66 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF FRIENDSWOOD, TEXAS, AUTHORIZING THE MAYOR TO EXECUTE, AND THE CITY SECRETARY TO ATTEST, AN AMENDMENT TO THAT CERTAIN MUNICIPAL MAINTENANCE AGREEMENT BETWEEN THE CITY AND TEXAS DEPARTMENT OF TRANSPORTATION, ADOPTED AS PART OF RESOLUTION NO. 8-68. * * * � * BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FRIENDSWOOD, TEXAS: Section 1. That the Mayor and City Secretary be, and they are hereby, authorized and directed to execute and attest, respectively, an amendment to that certain "Municipal Maintenance Agreement," by and between the City and Texas Department of Transportation, in substantially the same form as attached hereto as Exhibit "A" and made part hereof for all purposes. Smith Mayor ATTEST: F R�EIy , � ��� �s�L O De oris McKenzie,T o City Secretary * � s Py ��rF OF '�E� Texas Department of Transportation Municipal Maintenance Agreement Amendment(Rev. 10/2009) Exhibit A � (R2009-66) AMENDMENT TO MUNICIPAL MAINTENANCE AGREEMENT THE STATE OF TEXAS * THE COUNTY OF TRAVIS * This amendment to Municipal Maintenance Agreement is made and entered into by and between the State of Texas, acting through the Texas Department of Transportation, hereinafter referred to as the "State," and the City of Friendswood, hereinafter called the "City," and is to become effective when fully executed by both parties. WITNESSETH WHEREAS, the State and City entered into a certain Municipal Maintenance Agreement, on March 7, 1968, under which the State agreed to assist the City in the maintenance, control, supervision, and regulation of the State highway routes within the City; and WHEREAS, the State and the City desire to alter their respective responsibilities as defined by Item 9 of the General Conditions; AGREEMENT NOW, THEREFORE, the State and the City agrees to amend their agreement previously entered into on March 7, 1968, as follows: The City is permitted to install a parallel storm sewer facility within the median of FM 518, between Willowick and E. Castlewood, in accordance with the approved design plans. The City agrees to assume maintenance responsibilities of the proposed storm sewer facilities. All other provisions are unchanged and remain in full force and effect. • IN WITNESS WHEREOF, the parties hereto have executed this amendment agreement.
