A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
FRIENDSWOOD,TEXAS,AUTHORIZING THE FRIENDSWOOD
POLICE DEPARTMENT AND FRIENDSWOOD FIRE
MARSHAL/ARSON INVESTIGATOR TO USE UNMARKED
VEHICLES IN CONNECTION WITH OFFICIAL DUTIES OF
THE POLICE DEPARTMENT AND OFFICE OF THE FIRE
MARSHAL/ARSON INVESTIGATOR.

WHEREAS, Texas Transportation code, Section 721.005(a)(1)(A), provides the
governing body of a municipality may exempt automobiles used by a police department used in
the performance of official duties from the marking requirements of Section 721.004 of the
Texas Transportation Code; and
WHEREAS, Texas Transportation code, Section 721.005(a)(1)(E), provides the
governing body of a municipality may exempt automobiles used by a municipal fire marshal or
arson investigator used in the performance of official duties from the marking requirements of
Section 721.004 of the Texas Transportation Code; and
WHEREAS, The City Council of the City of Friendswood desires to authorize the police
department and fire marshal/arson investigator to use unmarked vehicles as they may deem
necessary in connection with their official duties.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF FRIENDSWOOD, TEXAS:
Section 1. That, pursuant to the authority granted by the Texas Transportation Code,
Section 721.005(a)(1)(A), exemption is hereby made for the use of unmarked vehicles for the
purpose of performing official duties by the Friendswood Police Department.
Section 2. That, pursuant to the authority granted by the Texas Transportation Code,
Section 721.005(a)(1)(E), exemption is hereby made for the use of unmarked vehicles for the
purpose of performing official duties by the office of Fire Marshal/Arson Investigator of the City
of Friendswood.
Section 3. The Police Chief and Fire Marshal/Arson Investigator of the City of
Friendswood are hereby authorized and directed to designate those vehicles to be unmarked
pursuant to Section 721.005 of the Texas Transportation Code.
EFFECTIVE: January l,2010 through December 31,2010.
