FRIENDSWOOD DRIVE, FRIENDSWOOD, TEXAS,WITH THE FOLLOWING PRESENT CONSTITUTING A QUORUM: MAYOR DAVID SMITH MAYOR PRO-TEM ANDY RIVERA COUNCILMEMBER MICHAEL BARKER COUNCILMEMBER JIM HILL COUNCILMEMBER LESLIE REID COUNCILMEMBER BILL HOLBERT COUNCILMEMBER J1M BARR CITY ATTORNEY BOBBY GERVAIS CITY MANAGER ROGER ROECKER CITY SECRETARY DELORIS MCKENZIE Mayor Smith called the meeting to order. SPECIAL SESSION � A discussion was held on Lake Friendswood (also known as Lake Windemere off FM 518). The Committee would like to see this project moved forward, it has been discussed for over 25 years. It has been determined that Windemere Road belongs to the City and would like to see the road opened up so that the public can see the possibilities of the development of this property. The road development could be approximately$100,000. A discussion was held concerning posting signage with no swimming due to the rebar that was placed in the lake for erosion control, there is less liability for the City if signage is posted. The Lake must be maintained with a fencing perimeter to keep it secure and could cost approximately $150,000. Fishing piers were envisioned, the park would not have access through Rancho Viejo and could consider combining property that was donated from West Development. This would be worth pursing with the public support. The park dedication funds could be used for this development as a park, there is approximately $200,000 in the park dedication fund. Council may look at grants to support the development of the lake as a park and discuss the possibility of developing walking trails. Rancho Viejo Homeowners Association (HOA) participation is needed in these discussions and the Parks Board needs to meet with West Ranch Management to discuss the agreement for the donation of park property. A discussion was held on holding a town hall meeting with all participating parties involved. A portion of the lake is not owned by the City, one of the owners may be interested in selling the property to the City. The liability has to be looked at both legally and morally for safety issues, will need to look at the enforcement issues and look at requiring adults with a certain age group, would like to include the Youth Advisory Council (YAC) group and Scout Troops in the planning process and suggested the Parks and Recreation Board prepare a preliminary plan with input from the Rancho Viejo HOA for Council consideration. Legal issues will need to be looked at for liability of grant funds, if all of the property is not acquired by using a method of some type of division of the lake from the portion that is owned by the City. Council supported the information provided and urged the Parks and Recreation Board to meet and bring back possibilities within 30 days. ..r. A discussion was held on the Master Parks Plan regarding Stadium Drive parking and the drainage improvements to support the parking needs of Renwick Park and school facilities, would like to add 285 spaces and is going to partner up with Friendswood Independent School District(FISD)to help develop. 11/02/2009 3234 � 7:00 PM—REGULAR SESSION The invocation was given by Pastor Danny Mercer with Friendswood Church of Christ. Mayor Smith led the Pledge of Allegiance to the United States and to the State of Texas. SPECIAL RECOGNITION AND ACKNOWLEDGEMENTS The Mayor presented a proclamation to Helene Zawila on behalf of the Fine Arts Institute. The Mayor presented a proclamation for National Community Education Day to LeAnn Baust from Friendswood Independent School District(FISD). A special presentation of the Five Star Spirit Empioyee Award for the third quarter of 2009 was presented to Cora Crews, Deputy Emergency Management Coordinator in the Fire Marsha�'s Office. Cora is the Deputy Emergency Management Coordinator and has worked part-time for the City of Friendswood since May, 2007. She has been involved with Emergency Management since May of 1992 after moving to Texas from Wyoming. She has also worked for the cities of Dickinson, Pearland and Sugar Land in their emergency management programs. Cora was nominated by her co-workers and also indirectly through correspondence sent by a State of Texas employee working with Cora on the City's Hazard Assessment and Mitigation Plan. Cora's main responsibilities include assisting with updating the City's Emergency Operation Plans and completing the update of the City's Hazard Analysis and Mitigation Plan. Through her day-to-day work, Cora continuously displays all five elements of the Five Star Spirit, including being courteous, competent, reliable, professional and enthusiastic. The City appreciates the service that Cora .A. Crews has provided this community and we congratulate her on being the recipient of the Five Star Spirit Award for the third quarter of 2009. A presentation was given on the Certificate of Achievement for Excellence in Financial Reporting for 2007-08 (CAFR). This is the 21S' consecutive year the Administrative Services Department has been recognized with this outstanding achievement. The Certificate of Achievement is the highest form of recognition in governmental accounting and financial reporting and would like to recognize the efforts of Rhonda Bloskas, Accounting Manager, the Accounting Staff, and the entire Administrative Services Department. The cumulative efforts enable the City to reach this achievement. JOINT DOCKETED PUBLIC HEARING Mayor Smith and Planning and Zoning Commission Chairman Kevin Holland called a Joint Docketed Public Hearing to order, to receive comments from the public, either oral or written, regarding the Zone Classification change request for a tract of land containing 2.942 acres in the Sarah McKissick League out of Lot 1, Block 2 of Friendswood Subdivision, property located at 205 E. Edgewood, Galveston County, to change from Single Family Residential (SFR)to Office Park District(OPD). No one spoke in favor or against the proposed zone classification change. Hearing no further comments, Planning and Zoning Commission Chairman Holland closed this portion of the Joint Docketed Public Hearing. Mayor and Council kept this Joint Docketed Public Hearing open. � 11/02/2009 3235 ,... Mayor Smith and Planning and Zoning Commission Chairman Kevin Holland called a Joint Docketed Public Hearing to order, to receive comments from the public, either oral or written, regarding amending Appendix C, Zoning Ordinance of the City of Friendswood Code of Ordinances, regarding amendments to Section 7.3.e. (height exceptions). No one spoke in favor or against the proposed amendment. Hearing no further comments, Planning and Zoning Commission Chairman Holland closed this portion of the Joint Docketed Public Hearing. Mayor and Council kept this Joint Docketed Public Hearing open. COMMUNICATIONS FROM THE PUBLIC There were no communications from the public. COMMUNICATIONS FROM COMMITTEES AND SPECIAL REPORTS An annual report was given by William Rearwick, President of the Friendswood Chamber of Commerce. He reported on the holiday Christmas parade, the golf tournament held jointly with the City for Broker Day, Fig Festival and Halloween in the Park. At Halloween in the Park, there were approximately 5,000 people in attendance and over 50 booths. The Chamber of Commerce is the host of the State of the City and County event annually, monthly luncheons, networking breakfasts and many other community projects. A new map is being worked on for the spring and will serve as an information hub for the City. � CITY MANAGER'S REPORT City Manager Roger Roecker reported on Fall HauI-A-Day and stated it is time once again for the Community Appearance Board's annual Fall HauI-A-Day. The event will take place at Friendswood's Centennial Park. As in years past, only non-hazardous items will be accepted at the event. Examples of non-hazardous waste include tree limbs, grass clippings, old appliances, old furniture, wood, metal, and plastic, large and small. In addition, a nonprofit organization will be on hand at the event to pick up household items such as furniture and household items in good condition. The Community Appearance Board would also like to encourage residents to bring items that would benefit the wildlife rehabbers in Friendswood. They need aquariums, (do not have to hold water), dog and cat kennel carriers, clean rags (towels/shirts), and shallow crock bowls. These volunteers take care of the many injured wild animals that make their homes in Friendswood's green space. This event is for the citizens of Friendswood. If past Spring Sparkle and Fall HauI-A-Days are any indication the City knows that this will be a successful event for Friendswood residents, the City of Friendswood and the Community Appearance Board. The City Manager gave a report on a Goal Setting and Planning Workshop and stated Friendswood has scheduled a City Goal Setting and Planning Workshop at the Friendswood Activity Building. Friendswood's Mayor and City Council as well as all City Boards, Commissions and Committees and the City's Senior Staff members will attend. This workshop is designed to be an opportunity for the City's volunteers to strengthen relationships by providing strategic planning for the next year. Ideas will be shared, input will be provided, and issues will be discussed. The City is looking forward to the opportunity to work together in achieving our strategic planning goals. The City Manager reported the City received a large sum of money from Federal Emergency Management Agency (FEMA)with a little over$3.2 million being received on Friday. As of today, the City �,... has received approximately$8.2 million of the$9.6 million spent for Hurricane Ike recovery. 11/02/2009 3236 .�. Mark McLean, Planning and Zoning Commission member, reported the zone change request for a tract of land containing 2.942 acres in the Sarah McKissick League out of Lot 1, Block 2 of Friendswood Subdivision, property located at 205 E. Edgewood, Gaiveston County, to change from Single Family Residential (SFR) to Office Park District (OPD) was voted in favor unanimously and recommended to Council. ACTION ITEMS **Councilmember Barr moved to approve Martha Cotton to be appointed to the Community Appearance Board (CAB)with a term expiring November 2012. Seconded by Councilmember Reid. The motion was approved unanimously. **Councilmember Hoibert moved to approve expanding the Senior Citizen Advisory Committee to nine members, approve the new appointments of Dorothy Montz with a term expiring November 2010, Paul Gordner and Mary Jane Musser with a term expiring November 2012, reappointments of Ginger Spade, Jean Bilderback, Frankie Santoro and Sharon Richardson to the Senior Citizen Advisory Committee with terms expiring November 2012 and approved the appointment of Jim Thomas to the Investment Committee with a term expiring November 2012. Seconded by Councilmember Rivera. The motion was approved unanimously. ''*Councilmember Reid moved to approve the disposition of Bid No. 2009-12 for Centennial Park Soccer Field Lighting and waiving the informality with the bid bond requirement, award to C.F. McDonald Electric, Inc., and authorize the Mayor to execute the contract. Seconded by Councilmember Holbert. The motion was approved unanimously. .... **Mayor Smith moved to approve renaming the Concerts in the Parks Series to the Mitch and Artha Wright Concerts in the Parks Series. Seconded by Councilmember Reid. The motion was approved unanimously. "*Councilmember Rivera moved to approve the purchase of finro new vehicles for the Fire Marshal's Office in accordance with the Vehicle Replacement Plan. Seconded by Councilmember Hill. The motion was approved unanimously. *"Councilmember Rivera moved to approve the purchase of two medic vehicles for the Friendswood Volunteer Fire Department in accordance with the 15 Year Capital Plan funded from the volunteer contributions on the water bills. Seconded by Councilmember Hill. The motion was approved unanimously. *"Councilmember Rivera moved to approve a three-year agreement with First Call Network for emergency communication services and authorizing the Mayor to execute the agreement. ""Councilmember Hill moved to approve accepting a proposal from Repipe Construction, LTD., and approving a contract extension for one year for the 2010 Sewer Rehabilitation Project and authorizing the Mayor to execute the contract. Seconded by Councilmember Holbert. The motion was approve unanimously. **Councilmember Rivera moved to approve a contract for two years with the Friendswood Chamber of Commerce in the amount of$20,000 a year and authorizing the Mayor to execute the contract. Seconded by Councilmember Reid. The motion was approve unanimously. "*Councilmember Rivera moved to approve a Notice of Intent to the Texas Comptroller of Public Accounts to accept $75,000 in an Energy Efficiency and Conservation Block Grant Program allocation under the American Recovery and Reinvestment Act. Seconded by Councilmember Reid. The motion was approved unanimously. "*Councilmember Rivera moved to amend an Interlocal Agreement with Harris County for mutual aid in the event of an emergency, by striking the last paragraph regarding jurisdictional authority entering into either jurisdiction without prior request or notification. Seconded by Councilmember Hill. "**Councilmember Rivera withdrew the motion for additional information to be provided to Council. Councilmember Hill withdrew his second. *'`Councilmember Barr moved to approve accepting the FY09 Sub-Recipient Award of the Homeland Security Grant Program and authorizing the Mayor to execute the document. ,,.,,,, Seconded by Councilmember Rivera. RESOLUTIONS **Councilmember Barr moved to approve Resolution R2009-59 -a Resolution of the City of Friendswood, Texas, Galveston/Harris Counties, awarding Bid No. 2009-13 and designating the Friendswood Reporter News as the official city newspaper. Seconded by Councilmember Reid. The motion was approved unanimously. **Councilmember Hill moved to approve Resolution R2009-60 - a Resolution of the City Council of the City of Friendswood, Texas, petitioning the Texas U.S. Congressional Delegation to support continued efforts for the U.S. Army Corps of Engineers General Reevaluation Report on Clear Creek. Seconded by Councilmember Barker. The motion was approved unanimously. **Councilmember Rivera moved to approve Resolution R2009-61 -a Resolution of the City Council of the City of Friendswood, Texas, authorizing and approving the 5-year review and updated City's Hazard Analysis and Mitigation Plan. Seconded by Councilmember Reid. The motion was approved unanimously. **Councilmember Rivera moved to approve Resolution R2009-62 - a Resolution of the City Council of the City of Friendswood, Texas, Galveston/Harris Counties, casting its ballot for the reappointment of Ed Heathcott to the Board of Directors of the Harris County Appraisal District for 2010-2011. Seconded by Councilmember Holbert. The motion was approved unanimously. **Councilmember Reid moved to approve Resolution R2009-63 -a Resolution of the City of Friendswood, Texas, hereby designating Councilmember Andy Rivera as representative and Councilmember Michael .— E. Barker as alternate to the Houston – Galveston Area Council 2010 General Assembly and Board of Directors. Seconded by Councilmember Holbert. The motion was approved unanimously. 11/02/2009 3238 .�. "*Councilmember Rivera moved to approve Resolution R2009-64- a Resolution of the City Council of the City of Friendswood, Texas, authorizing and approving the City Manager to pursue all Energy Efficiency and Conservation Block Grant (EECBG) funding made available through the American Recovery and Reinvestment Act (ARRA) and being allocated by the State Energy Conservation Office to be used to assist in reaching the City's goal of energy efficiency; and expressing continued commitment toward energy efficiency for the citizens of Friendswood and all of Texas. Seconded by Councilmember Reid. The motion was approved unanimously. **Councilmember Barr moved to approve Resolution R2009-65 - a Resolution of the City Council of the City of Friendswood, Texas, approving an amendment to the contract with IESI TX Corporation for solid waste coilection and disposal services within the City and authorizing a 4.2% increase in the rates; amending Appendix D of the Friendswood City Code to adopt a revised schedule of solid waste disposal fees; and providing an effective date. Seconded by Councilmember Hill. The motion was approved unanimously. **Councilmember Holbert moved to approve Resolution R2009-66 - a Resolution of the City Council of the City of Friendswood, Texas, authorizing the Mayor to execute, and the City Secretary to attest, an amendment to that certain Municipal Maintenance Agreement between the City and Texas Department of Transportation, adopted as part of Resolution No. 8-68. Seconded by Councilmember Hiil. The motion was approved unanimousiy. ORDINANCES *"Councilmember Rivera moved to approve the Second and Final reading of Ordinance T2009-21, an „� Ordinance accepting a petition of the property owners in The Lake of San Joaquin Subdivision and ordering that the traffic rules that apply to a public road be extended to private roads within this subdivision, pursuant to the provisions of §542.008 of the Texas Transportation Code; and providing a penalty of a fine not to exceed $200 for the violation of this ordinance. Seconded by Councilmember Reid. The motion was approved unanimously. Councilmember Hill recused himself from the meeting at this time. **Councilmember Barr moved to approve the Second and Final reading of Ordinance T2009-24, an Ordinance of the City of Friendswood, Texas, approving the renaming of the portion of Rolling Stone Drive south of Sandy Lake Drive to "Dominion Court"; providing various findings and provisions related to such change; and providing a severability clause. Seconded by Councilmember Rivera. The motion was approved 6-0. Councilmember Hill returned to the meeting. **Councilmember Rivera moved to approve the First reading of Ordinance T2009-25, an Ordinance amending Appendix C of the Friendswood City Code, said Appendix C being City of Friendswood, Texas, Ordinance No. 84-15, as amended, originally adopted the 19th day of November, 1984, and being the Zoning Ordinance of the City, by amending Paragraph 3 of Subsection Q of Section 7 by increasing the maximum allowable height of an accessory structure and adding "wind turbines" and "solar panels" to the height regulation exceptions; providing a penalty of an amount not to exceed $2,000 for each day of violation of any provision hereof; and providing for severability. Seconded by Councilmember Holbert. ***Councilmember Rivera moved to withdraw his motion to send the ordinance back to the Planning and ,.�.,, Zoning Commission for further review on the wind turbines and solar panels. "Councilmember Hill moved to approve the First reading of Ordinance T2009-26, an Ordinance amending Appendix C of the Friendswood City Code, said Appendix C being City of Friendswood, Texas, Ordinance No. 84-15, as amended, originally adopted the 19th day of November, 1984, and being the Zoning Ordinance of the City, by changing the zoning classification of 205 E. Edgewood from Single Family Residential (SFR) to Office Park District(OPD), such tract also being 2.942 acres (128,135 square feet) out of Lot 1, Block 2, Friendswood Subdivision, Sarah McKissick League, Abstract No. 151, City of Friendswood, Galveston County, Texas; providing for the amendment of the City's Official Zoning Map; providing a penalty in an amount not to exceed $2,000 for each day of violation of any provision hereof; and providing for severability. Seconded by Councilmember Reid. The motion was approved unanimously. COMMUNICATIONS FROM THE MAYOR AND COUNCILMEMBERS Councilmembers Barker, Hill, Reid, and Holbert had no report. Councilmember Barr reported on the Fall Haul-a-Day on Saturday at Centennial Park and stated tomorrow is the last day to vote for or against in the Local Option Election. Councilmember Rivera reported on the election the County is holding for the amendments to the Constitution. ,,.,.., Mayor Smith reported he attended the National Award ceremony for Westwood Elementary known as Character Counts, one of 10 in the U.S., great pride bestowed upon this community. Coffee with the Mayor will forgo until December due to the planned retreat on Saturday and would like to invite those interested to attend. Mayor Smith asked Council to begin thinking about 2010 being the 50th year from incorporation and stated Council may want to think about appointing a committee or how to recognize this historical event. CONSENT AGENDA *"Councilmember Rivera moved to approve the Consent Agenda as presented A. Approve License Agreement for buyout property located at 5354 Appleblossom. B. Accept the 2008-09 Concrete Street and Drainage Maintenance Project for the contractor's one-year maintenance period and authorize the Mayor to execute. C. Accept September 2009 Property Tax Report. D. Approve Minutes of September 14, September 28, and October 5, 2009 Meetings. Seconded by Councilmember Reid. The motion was approved unanimously.
